ORDINANCE ~ IM. AN ORDINANCE REGULATING THE MAINTENANCE AND OPERATION OF GASOLINE
SERVICE STATIONS.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
PART A
GASOLINE SERVICE STATIONS
SECTION 1. Dispensing Devices---Design and. Construction.
Class I and Class Il flammable liquids shall be transferred from
underground tanks by means of fixed pumps so designed and equipped
as to allow= control of the flow and to prevent leakage or accidental
discharges. Supplemental means shall be provided outside of the
dispensing devices whereby the source of power may be readily dis-
connected in the event of fire or other accident. Dispensing devices
for Class I or Class II flammable liquids shall be of approved type.
Devices meeting the standards of the Underwriter's Laboratories, Inc.,
shall be deemed to be in compliance with this Section. Dispensing
devices using elevated or glass bowl compartments or containers from
which liquids are drawn by gravity shal.l be prohibited on and after
October 20, 1949
Glass I flammable liGluids are liquids with a flash point below
25degrees Fahrenheit (4 degrees Centigrade) closed cup tester, as
for examples ether, gasoline, naphtha, benzol, collodion, acetone.
Class II flammable liquids are liquids with flash point above
that of Class I and below ?O degrees Fahrenheit (21 degrees Centigrade)
ciosedcup tester, as for example: alcohol, amyl acetate, toluol,
ethyl acetate, methyl acetate.
SECTION 2. Dispensing Devices--Location. Dispensing devices
at automobile service stations shall be so located that all parts
of the vehicle being served will be on private property.

SECTION 6, Signs. "No Smoking" and "Stop Your Motor" signs of
contrasting colors, shall be placed on each pump island and so
located as to be visible from either side.of the island.
SECTION 4. Attendants. Attendants engaged or employed in
the dispensing of gasoline or oil shall be responsible persons over
the age of O xteen (16) years., who shall be instructed in first
aid fire fighting appliances.
SECTION 5. Open. Flame Devices - Refuse - Buildings.
or Class II flammable liquids shall not be transferred from one
-c~Qntainer to another, or used, or dispensed within a room in
which any open flame device is-used, and the premises shall be
kept free from all unnecessary combustible material and refuse.
No building shall be located within twenty-five (25) feet
of any gasoline pump unless such building is constructed of non-
combustible material.
SECTION 6. Spillage. All spillage of flammable liquids
shall be immediately mopped up, or such spillage shall be absorbed
by sand or other non-combustible absorbent material which shall
be removed and placed in an incombustible container. The mop
and incombustible container shall be kept in a ventilated place,
free from open flame or other sources of ignition.
SECTION 7. Self-service. Unlawful. It shall be unlawful
for any person other than the station owner or lessee, his employee
or other agent, to dispense flammable liquids into the fuel tank
of a motor vehicle, except at a self-service gasoline station for
which a permit has been issued pursuant to the provisions of Part
B of this Ordinance.
SELF-SERVICE GASOLINE STATIONS
SECTION B.Definition. "Self-service" shall mean the dispensing
or obtaining of flammable liquid from a filling or service
station by any manner or method other than by the personal service
and actual direct dispensing of said liquid solely by the operator
of such station, his agents or employees.

SECTION 9. Permit Required. Self-service station owners
or operators shall make application to the Fire Chief of the Town
of Los Gatos for a permit for the use, handling and sale of
flammable liquids. It shall be unlawful for any person to operate
a self-service gasoline station without first having obtained a
permit to do so.
SECTION 10. Regulations. In addition to compliance with
the provisions of Part .A of this Ordinance, a permit shall be
issued only upon the compliance of the following additional
conditions and regulations:
SECTION 10.(a). The installation of gasoline tanks, pumping
equipment, piping and appliances shall be grade in accordance with
the provisions of this Ordinance.
SECTION 10 (b). Nozzles on gas lines shall be equipped
with "dSad man3 control valve and with vacuum operated overflow
check valve.
SECTION 10 (c). Pumps and facilities for delivery of gasoline
shall be of a type approved by a recognized laboratory, and shall
provide effective means to prevent public access to supplies
of gasoline during periods when the station operators, employees
or authorized representatives are absent. The use of coin-operated
self-service gasoline vending facilities is prohibited.
SECTION 10 (d). One 002 extinguisher of at least four (4)
pounds size shall be placed at each pump islands in addition to
the one 002 extinguisher, of at least fifteen (15) pounds size
which shall be maintained on the premises. Dry powder or other
approved type of extinguisher may be substituted for 002 extinguishers
with the approval of the Fire Chief. Extinguishers shall be
conspicuously,.loeated in a readily accessible place and shall be
so distributed as to be immediately available in the event of
fire. Extinguishers shall be kept full and in operating condition
at all ties, and shall be refilled immediately after use although
only partly discharged.

MOTION 10 (e). Two water lines of at least one inch in
size, properly equipped with hose and nozzle to be provided and
so located that complete coverage of the-entire premises can
be made. Such hose lines and nozzles to be used for first aid
fire equipment only.
SECTION 10 (f). Telephone facilities to be provided on
premises.
SECTION 10 (g). Each pump shall be equipped with manually
operated shut-off switch or lever which can be operated both
a, the pump or by remote control from the control tower.
SECTION 10 (h). All electrical futures within ten (10)
feet of any pump or vent pipe to be vapor- or explosion-proof
and shall meet the requirements of the National Electrical Code
for hazardous installations.
SECTION 10 (1). If a control tower is required the door
to control room to be over twenty-five (25) feet from nearest
pump and to open away from direction of pumps.
SECTION 10 (j). All attendants to be thoroughly instructed
in the'use of extinguishers and water in case of fire. Also to
be instructed in prohibiting and preventing patrons from smoking
around the pumps. Service to be refused and pump shut off when
persons do not follow instructions.
SECTION 10 (k). No open-flame device to be located or
permitted within twenty-five (25) feet of any pump.
SECTION 10 (1). No combustible material to be stored or
on display within twenty-five (25) feet of any pump.
SECTION 10 (m). No mops or rags which have been used for
cleaning purposes to be permitted in any buildings.
SECTION 10 (n). All waste material and rubbish to be placed
and kept in an all-metal or metal-lined container, such container

to be equipped with self-closing top. All such waste material
and rubbish to be kept in such container until it is disposed of
or removed from the premises.
SECTION 10 (o). In the interest of public safety, based
upon the number of gasoline islands and their location on the
premises, whenever there are more than three islands within a
radius of fifty (50) feet, the Fire Chief may require a control-
room to be so located on the premises, and so designed and con-
structed that an operator within the control-room will have an
unobstructed view of all pumps and operations at all times.
The control-room shall be equipped with a public address system
andloud speakers capable of being heard at all pump islands.
SECTION 10 (p).- When a control-room is required upon the
premises, there shall be not'less than one male attendant over
the age of eighteen (13) years on duty in the control-room during
hours of operation, except between the hours of twelve (12) mid-
night and six (6) o'clock A. M.
SECTION 10 (q). -There shall be not less than one attendant
on duty for each three (3) pumps or fraction thereof open to the
public. Attendants shall be on duty continuously within a radius
of thirty (30) feet of the pump islands while tanks are being filled.
It shall be unlawful for an attendant to permit service to persons
Vho are smoking, or who are under the influence of liquor.
SECTION 10 (r). The use of skates or other artificial or
mechanical means of locomotion by operators or attendants upon
the premises is prohibited.
SECTION 10 (s). When a control-room is required by the Fire
Chief, a two-way communication system shall be provided to facilitate
direct and individual communication between the control-room and
each island. A telephone shall be located in the control-room.
There shall be provided in the control-room and on each island, a

a switch for the control of the gasoline pumps upon the islands.
The switch control and island assembly shall be so arranged that
the person in the control room can shut off the motors in the
pumps on each island.
SECTION 10 W. Motor vehicles shall not be parked upon the
premises within a radius of fifty (50) feet of the gasoline pumps
except those which are actually receiving or waiting to receive
gasoline and oil.
SECTION la (u). When portions of the station are closed
to the pudic for the receiving of tank delivery of gasoline
for the station, that portion shall be so designated at closed
with adequate signs and the area so closed shall be barricaded
by "Au type barriers.
SECTION 11. Revocation of Permit. The Fire Chief shall
revoke the permit for the operation of any self-service station
which does not comply with the provisions of this Ordinance,
and for violation of any of the provisions of this Part.
SECTION 12. This Ordinance shall be. printed once in
