AN ORDINANCE PRESCRIBING REGULATIONS FOR FIRE PREVENTION AND
LIFE SAFETY IN CONNECTION WITH HAZARDOUS 14ATERIALS AND PRO-
CESSES, AND REGULATING BURNING WITHIN THE TOWN OF LOS GATOS
AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS :
Section 1. No person shall kindle or maintain any bonfire or
"shall knowingly furnish the materials for any such fire, or
authorize any such fire to be kind-led or maintained on or in,any

street, alley, road; land or public grounds or upon any private
lot within the limits of the Torn of Los Gatos, unless a written
permit so to do shall first have been secured from a regular
member of the Los Gatos Fire Department, and unless during the
hours of six A.I. and twelve noon on Tuesdays, Wednesdays,
Thursdays, Fridays, Saturdays and Sundays, and unless said burn-
ing shall not create a dense smoke or offensive odor.
Section 2. No person within the limits of the Town of Los Gatos
shah deposit ashes, smouldering coal or embers, greasy or oily
substances or other matters liable to create spontaneous ignition
within ten feet of any wooden or plastered wall, partition, fence,
floor, sidewalk, lumber, hay shavings, rubbish or other combus-
tible materials, exdept in metallic or other non-combustible
receptacles. Such receptacles, unless resting on a non-combustible
floor or on the ground outside the building, must be placed on
non-combustible stands, and in every case must be kept at least
two feet away from any combustible wall or partition.
Section 3. No person within the limits of the Town of Los Gatos
shall permit to remain upon any roof or in any court, yard, vacant
lot or open space, any accumulation of waste paper, hay, grass,

straw, weeds, litter or combustible or inflammable waste or rubbish
of any kinds All weeds, grass, vines or other growth, when same
endangers property, or is liable to be fired, shall be removed by
the owner or occupant of the property it is on.
Section 4. No person making, using, storing or having charge
or control of any shavings, excelsior, rubbish, sacks, bags,
litter, hay, straw or combustible trash, waste or fragments shah
fail, neglect or refuse at the close of each day to cause all
such material which ismt compactly baled and stacked in an
orderly manner to be removed from the premises or stored in
suitable vaults or in metal or metal lined covered receptacles
or bins. The Chief of the Los Gatos Fire Department shall recuire
suitable baling presses to be installed in stares, apartment
buildings, factories and similar places where accumulations of
paper and waste materials are not removed at least every second
day.
Section 5. The storage of empty packing cases, boxes, barrels
or other similar combustible containers is forbidden without a
permit except in the open. Provided, however, that no permit
shall be reojuired for the storage within a manufacturing or
other establishment of suffieient packing cases, boxes, barrels,
or other similar containers to properly carry on its operations,
but such storage shall be orderly and not so located as to
endanger exit from the building. Storage in the open of pack-
ing cases, boxes, "carrels or other similar combustible containers
shall not be more than twenty feet in height, and shall be at
least fifty feet from the nearest building. All such storage
shall be in a compact and orderly manner.
Section 6. Cotton batting,. straw, dry vines, leaves, trees, cellu-
loid or other highly inflammable materials shall not be used for

decoration purposes in show windows or stores without a permit,
provided, however, that nothing in this section shall be held to
prohibit the display of saleable goods permitted and offered for
sale in the store. Electric light bulbs in stores or public
halls shall not be decorated with paper or other combustible
materials unless such materials shall first have been rendered
flameproof.
Section 7. No person shall take into any building, barn or any
other place where highly inflammable, combustible or explosive
materials is kept, an open flame unless such light or flame
shall be well secured in a glass globe, -rtrir a mesh cage or
similar approved device.
Section 8. All chimneys, smokestacks or similar devices for
conveying smoke or hot gases to the outer air and the stoves,
furnaces, fire boxes or boilers to which they are connected
shall be constructed and maintained in such a manner as not to
endanger adjacent property, and in accordance with the Building
Code.
Section 9. No heating apparatus with an open flame, and no
artificial lighting system other than incandescent electric
lights shall be used in any warehouse for the storage of rage,
excelsior, hair or other inflammable or combustible material; nor
in any shop or factory used for.the manufacture, repair or reno-
vating of mattresses or bedding; nor in any establishment for
the upholstery of furniture.
Section 10. Any personviolating any provision of this ordinance
shall be deemed guilty of a misdemeanor, and upon conviction
thereof shall be punishable by a fine not exceeding Five Hundred
Dollars ($500.00)., or by imprisonment in the County Fail of the
County of Santa Clara, for a period not exceeding six (6) months,

or by both such fine and imprisonment.
Section 11. This Ordinance shall take effect and be in force
thirty (30) days from and after date of its passage and before
the expiration of fifteen (15) days after its passage it shall
be published once with the names of )),,the members voting for and
against the same in th 6-7 l hew , a newspaper published
in the Town of Los Gatos.
Introduced at a regular meeting of the Town Council of
the Town of Los Gatos, State of California, held on the 5th day
of May, 1947.
Passed and adopted as an Ordinance of the Town of
Los Gatos, California, at a regular meeting of the.Town Council
