SESSION
The Town Council of the Town of Los Gatos met in the Counci l
Chambers of the Town Hall at 7 :45 p .m .,in an adjourne d
session .
PRESENT :"Ruth Cannon,Thomas J . Ferrito, MarLyn J . Rasmussen ,
Brent N . Ventura and Mayor Peter W . Siemens .
ABSENT :None .
Mayor Siemens reported on the Executive Session that was hel d
prior to the Council meeting, stating the following matter s
were discussed :
1.Litigation re State State Supreme Court level on Electio n
consolidation, and authorized the Town Attorney t o
proceed, only is Supreme Court holds a hearing .
2.Town of Los Gatos joining with San Mateo in litigatio n
re loss of representation in recent reapportionments .
(No cost to the Town).
3.Litigation relative to possible zoning violations .
4.Litigation of Los Gatos Mobile Home Park in relation t o
Rent Mediation Ordinance . Authorized the Town Attorne y
Attorney to proceed on this matter .
Voting on the above were unanimous by Council except for No .3
which Mr . Ventura voted no
. Mr. Kurt Anslinger reported to Council on the action of th e
Board of Supervisors re the proposed building of an Educationa l
Retreat (Tandem Computers), on Black Road . He stated at th e
hearing that the Board seemed to feel Los Gatos was not intereste d
and he would lice to urge,or request Los . Gatos to file a n
appeal . After some discussion, it was consensus of Counci l
that they advise Mr . Anslinger to file an appeal requesting tha t
a focused EIR be prepared and the Town will direct staff t o
send a letter to the Baord of Supervisors stating strongly th e
Town's position . Council also requested a report from staff o n
this Issue by February 16,1982 .
The Town Manager, Dave Mora, stated the new job description s
have been developed for the Town by the Santa Clara Employe e
Relations Services and this is a result of an item in th e
Memorandum of Understanding, between the Town and AFSCME whic h
mandated that a classification study be undertaken . Mrs . Cannon
moved for adoption of Resolution No .1982-43 entitled,A
RESOLUTION OF THE COUNCIL OF THE TOWN OF LOS GATOS APPROVIN G
AMENDMENTS TO THE TOWN'S CLASSIFICATION PLAN . Mr . Ventur a
seconded . Unanimously carried .
The Town Manager stated this Resolution deals with th e
implementation of the classification study for employee s
represented by the Corporation Yard Unit, AFSCME . After some
discussion, Mrs . Cannon moved for adoption of Resolution No .
1982-44 entitled, AMENDMENTS TO SALARY SCHEDULE RESOLUTIO N
NO .1981-44 TO BE EFFECTIVE SEPTEMBER 1,1981 .Mrs . Rasmusse n
seconded . Unanimously . carried .
The Town Manager referred to the report on the Mid-Year Budge t
re status of various funds and various departmental budgets a s
of December 31,1981 .After some discussion, Mr . Ventura move d
Council accept staff recommendation and take the followin g
actions :
1.Revise Town revenue estimates for the current fisca l
year as detailed in the Mid-Year Revenue Analysis (Pag e
4 of this report).
2.Appropriate $203,000,in additional revenue to the curren t
year appropriated General Fund contingency .

4.Establish a reserve account in the amount of $125,000 t o
fund the Town's potential liability for employee contribution s
to the Town Pension Plan ; funds would be transferred fro m
the appropriated unallocated reserve .
5.Transfer an additional $500,000, from appropriated unallocate d
reserve to the reserve for Economic Uncertainties, providin g
a reserve equal to approximately one-third of the Genera l
Fund budget .
6.Establish a $250,000 ., reserve for acquisition and/or constructio n
of a bus station site ; funds will be transferred fro m
appropriated unallocated reserve .
7.Direct staff to prepare alternative amendments to th e
Construction Tax Ordinance .
8.Reserve. the appropriation made in July 1980 of $280,000, o f
Construction Tax to undersignated utility undergroundin g
projects ; the appropriation was never designated for a
specific project, and the funds have not been used .
9.Authorize a loan from the Utility Tax portion of the Constructio n
Tax to be paid back as revenue is generated .
Mrs . Cannon seconded . Unanimously carried on all but No . 3 .
Mrs . Rasmussen voted no on No . 3 re supplemental appropriatio n
for Town Attorney's budget of $17,000 .
CALL FOR Mr . Ferrito moved for adoption of Resolution No . 1982-45 entitled ,
ELECTION ON A RESOLUTION CALLING ADVISORY ELECTION IN CONSOLIDATION WIT H
ADVISORY THE REGULAR ELECTION OF JUNE 8, 1982, FOR THE PURPOSE OF ALLOWIN G
MEASURE FOR THE VOTERS TO INDICATE TO THE TOWN COUNCIL WHETHER THEY DESIR E
JUNE, 1982 COUNCIL ELECTIONS TO BE CONSOLIDATED WITH NOVEMBER ELECTIONS I N
ODD OR EVEN YEARS . Mr . Ventura seconded . Mrs . Rasmussen aske d
for discussion of possibility of rescinding previous Ordinanc e
and only extend terms to June, 1982 election and also includ e
the advisory measure .. No discussion . Motion carried by vot e
of three ayes . Mrs . Cannon and Mrs . Rasmussen voting no .
ADJOURNMENT Mayor Siemens declared meeting adjourned at 9 :15 p .m . t o
executive session . Mayor declared he would report re executiv e
session at the beginning of the next regular Council meeting .
