RECOMMENDATION:
1. Open and hold the public hearing and receive public testimony.
2. Close the public hearing.
3. Make the required findings (Attachment 1) and approve the modification to the Conditional
Use Permit application U-08-015 subject to conditions (Attachment 2) (motion required).
4. Refer to the Town Attorney for the preparation of the appropriate resolution (no motion
required).
BACKGROUND:
The subject site is located on the east side of North Santa Cruz Avenue, north of Highway 9 in the
Los Gatos Shopping Center. The existing Use Permit for a high turnover sit down restaurant (Aldo's
Deli) was approved by the D evelopment Review Committee in May of 2007. The approval included
a 22 seat restaurant with maximum operating hours of 11 AM to 9 PM daily. The applicant would
like to modify the Use Permit to include beer and wine service and the ability to seasonally locate 2
of the 22 approved seats in the existing outdoor patio area to be shared by Starbucks. No alcohol
will be permitted in the outdoor seating area.
On November 12, 2008, the Planning Commission considered the subject application and voted 6-0
to recommend approval of the proposed modifications to the existing CUP with the recommended
conditions.

DISCUSSION
Project Summary:
The applicant is requesting approval to modify the existing CUP to allow beer and wine service. The
applicant is also applying to seasonally locate two of the 22 approved seats in the existing outdoor
seating area.
Alcohol Polic :
The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be approved
by the Town Council. The request complies with the requirements of the Town Alcohol Policy.
PLANNING COMMISSION ACTION
The Planning Commission voted 6-0 to recommend approval of the request with the modified
conditions of approval recommended by staff. The Commissioners only concerns were in relation to
the implementation of the outdoor seating and the number of teens that linger in the vicinity. The
Commissioners believed the business owner's long tern management of Aldo's Restaurant at
Winchester and Knowles showed an understanding and respect for the Town's alcohol policy.
Attachment 3 is a verbatim transcript of the Commission's discussion.

CONCLUSION:
If the Council decides to approve the modifications to the CUP, it should make the required findings
specified in Attachment 1, and approve the application, subject to the conditions in Attachment 2.

The deciding body, on the basis of the evidence submitted at the hearing, may grant a
conditional use permit when specifically authorized by the provisions of the Town Code if it
finds that:
(1) The proposed uses of the property are essential or desirable to the public convenience or
welfare; and
(2) The proposed uses will not impair the integrity and character of the zone; and
(3) The proposed uses would not be detrimental to public health, safety or general welfare;
and
(4) The proposed uses of the property are in harmony with the various elements or objectives
of the General Plan and the purposes of the Town Code.

Conditional Use Permit U-08-015

TO THE SATISFACTION OF THE PLANNING DIRECTOR:
(Planning Section)
1. APPROVAL: This application shall be completed in accordance with all of the
conditions of approval listed below and in substantial compliance with the plans
approved and noted as received by the Town on June 23, 2008. Any changes or
modifications to the approved plans and/or business operation shall be approved
by the Community Development Director or the Planning Commission/Town
Council, depending on the scope of the changes.
2. EXPIRATION OF APPROVAL: The Conditional Use Permit will expire two
years from the date of approval unless it is used before expiration. Section
29.20.335 defines what constitutes the use of an approval granted under the
Zoning Ordinance.
3. USE: The approved use is a high turn over sit down restaurant.
4. HOURS OF OPERATION: Hours of operation shall not exceed 11:00 am to 9:00
pm daily.
5. SEATING: A maximum of twenty two (22) seats are allowed inclusive of indoor
and outdoor seating. A maximum of two seats may be placed in the outdoor
seating area adjacent to 442 North Santa Cruz Avenue.
6. OUTDOOR SEATING: The outdoor seating shall be approved by Town staff
prior to installation to ensure that the furniture is complimentary to the existing
Starbucks furniture, but will be easily distinguished for patron use. There shall be
no alcohol permitted in the outdoor seating area.
7. ACCESSIBLE SEATING: The applicant shall provide accessible seating which
complies with current building codes.
8. ALCOHOL SERVICE: The service of alcoholic beverages is permitted only with
meals. A meal is defined as a combination of food items selected from a menu
(breakfast, brunch, lunch, or dinner). Appetizers such as popcorn, nachos,
pretzels, potato skins, relish trays, etc. (hot or cold) are not meals. No "off sale"
of alcohol beverages is permitted.
9. TAKE OUT: Take out food shall be served in recycled material containers.
10. UTENSILS: All beverages and food served on site shall be served on reusable
materials.
11. LIVE ENTERTAINMENT: No live entertaimnent shall be provided unless the
applicant receives future approval of live entertainment.

12. ONE YEAR REVIEW: Town staff shall review the Conditional Use Permit
within one year from approval to determine if there are any problems associated
with the Permit and report their findings to the Planning Commission. The
Planning Commission may direct that a public hearing be held to review the
permit as specified in Section 29.20.3 10 of the Town Code.
13. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use
Permit has been granted is discontinued for a period of one (1) year, the approval
lapses pursuant to Section 29.20.340 of the Zoning Ordinance.
14. TOWN INDEMNITY: Applicants are notified that Town Code Section 1. 10.115
requires that any applicant who receives a permit or entitlement from the Town
shall defend, indemnify, and hold harmless the Town and its officials in any
action brought by a third party to overturn, set aside, or void the permit or
entitlement. This requirement is a condition of approval of all such permits and
entitlements whether or not expressly set forth in the approval.
TO THE SATISFACTION OF THE CHIEF OF POLICE:
15. UNIFORMED SECURITY: Uniformed privately provided security guards may
be required in or around the premises by the Chief of Police if alcohol related
problems recur that arc not resolved by the licensed owner.
16. CONSULTATION AND TRAINING: At the discretion of the Chief of Police,
periodic meetings will be conducted with representatives from the Police
Department for on-going employee training on alcoholic beverage service to the
general public.
17. TRAINING MANUAL: The restaurant operator shall use an employee trailing
manual that addresses alcoholic beverage service consistent with the standards of
the California Restaurant Association.
18. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively
promote a designated driver program such as complimentary non-alcoholic
beverages for designated drivers.
19. POSTING OF TAXICAB TEI..EPIIONI NUMBERS: Taxicab telephone
numbers shall be posted iii a visible location.

20. TABLE SERVICE: Food ordered at the counter shalt be delivered to tables by
restaurant stair. 'fable service is mandatory to maintain the High Turnover Sit-

BACKGROUND:
The subject site is located on the east side of North Santa Cruz Avenue approximately 500 ft
north of Los Gatos-Saratoga Road. The current Conditional Use Permit (CUP) was approved by
the Development Review Committee on May 15, 2007. The Permit established a minor
restaurant with 22 seats and operating hours of 11 AM to 9 PM daily.
PROJECT DESCRIPTION:
The applicant is requesting approval to modify the existing CUP to allow beer and wine service
with meals. They would also like to be able to offer two seats outdoors in the defined patio
space along with Starbucks. These two seats would be in lieu of two indoor seats. Alcohol will
not be permitted outside the restaurant.
ANALYSIS :
A. Alcohol Polite
The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be
approved by the Town Council. The request complies with the requirements of the Town
Alcohol Policy.
The Police Department has reviewed the application, and had no concerns specific to this
application. However, based on the Police's past experiences of dealing with transients and
alcohol use within the area, a condition was included that staff would review the application
within one year of approval to ensure there are no problems associated with the permit.
B, Traffic and Parking
There is no proposed intensification of the existing use, therefore, traffic and parking will
not be impacted by this application.

C. CEQA Determination
It has been determined that this project is Categorically Exempt pursuant to Section 15301
of the State Environmental Guidelines as adopted by the Town.
NCLUSION AND RECOMMENDATION:
A. Conclusion
The proposed modifications of the CUP comply with the regulations set forth for the C-1
zone and the Town's Alcohol Policy.
B. Recommendation
Staff recommends that the Planning Commission recommend approval of the Conditional
Use Permit to the Town Council:
1. Find that the project is categorically exempt pursuant to Section 15301 of the State
Environmental Guidelines;
2. Make the findings as required by Section 29.20.190 of the Town Code for granting a
Conditional Use Permit, subject to conditions (Exhibit 2); and
1 Determine that the proposed modifications are in compliance with the 'town's
Alcohol Policy.

TO THE SATISFACTION OF THE PLANNING DIRECTOR:
(Planning Section)
1. APPROVAL: This application shall be completed in accordance with all of the
conditions of approval listed below and in substantial compliance with the plans
approved and noted as received by the Town on June 23, 2008. Any changes or
modifications to the approved plans and/or business operation shall be approved
by the Community Development Director or the Planning Commission,
depending on the scope of the changes.
2. EXPIRATION OF APPROVAL: The Conditional Use Permit will expire two
years from the date of approval unless it is used before expiration. Section
29.20.335 defines what constitutes the use of an approval granted under the
Zoning Ordinance.
3. USE: The. approved use is a high turn over sit down restaurant.
4. HOURS OF OPERATION: Hours of operation shall not exceed 11:00 am to 9:00
pm daily.
5. SEATING: A maximum of thirty two (22) seats are allowed inclusive of indoor
and outdoor seating. A maximum of two seats may be placed in the outdoor
seating area adjacent to 442 North Santa Cruz Avenue.
6. OUTDOOR SEATING: There shall be no alcohol permitted in the outdoor seats.
7. ALCOHOL SI~RVICE: The service of alcoholic beverages is permitted only with
meals. A meal is defined as a combination of food items selected from a menu
(breakfast, brunch, lunch, or dinner). Appetizers such as popcorn, nachos,
pretzels, potato skins, relish trays, etc. (hot or cold) are not meals. No "Off sale"
of alcohol beverages is permitted.
8. TAKE OUT: Take out food shall be served in recycled material containers.
9. UTENSILS: All beverages and food served on site shall be served on reusable
materials.
10. LIVE ENTERTAINMENT: No live entertainment shall be provided unless the
applicant receives future approval of live entertainment.
11. ONE YEAR REVIEW: Town staff shall review the Conditional Use Permit
within one year from approval to determine if there are any problems associated
with the Permit and report their findings to the Planning Commission. The
Planning Commission may direct that a public hearing be held to review the
permit as specified in Section 29.20.3 10 of the "Down Code.

12. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use
Permit has been granted is discontinued for a period of one (1) year, the approval
lapses pursuant to Section 29.20.340 of the Zoning Ordinance.
13. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115
requires that any applicant who receives a permit or entitlement from the Town
shall defend, indemnify, and hold harmless the Town and its officials in any
action brought by a third party to overturn, set aside, or void the permit or
entitlement. This requirement is a condition of approval of all such permits and
entitlements whether or not expressly set forth in the approval.
TO THE SATISFACTION OF THE CHIEF OF POLICE:
14. UNIFORMED SECURITY: Uniformed privately provided security guards may
be required in or around the premises by the Chief of Police if alcohol related
problems recur that are not resolved by the licensed owner,
15. CONSULTATION AND TRAINING: At the discretion of the Chief of Police,
periodic meetings will be conducted with representatives from the Police
Department for on-going employee training on alcoholic beverage service to the
general public.
16. TRAINING MANUAL: The restaurant operator shall use an employee training
manual that addresses alcoholic beverage service consistent with the standards of
the California Restaurant Association.
17. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively
promote a designated driver program such as complimentary non-alcoholic
beverages for designated drivers.
18. POSTING OF TAXICAB TELEPHONE NUMBERS: Taxicab telephone
numbers shall be posted in a visible location.

(Building Section)
7. PERMITS REQUIRED: A building permit shall be required for any proposed tenant
improvements to the existing commercial building. Separate permits and required for
electrical, mechanical, and plumbing work as necessary.
8. - CONDITIONS OF APPROVAL: The Conditions of Approval must be blue-lined in full on
the cover sheet of the construction plans. A Compliance Memorandum shall be prepared and
submitted with the building permit application detailing how the Conditions of Approval will
be addressed.
9. SIZE OF PLANS: For sets of construction plans,maximum size 24" x 36".
10. BACKWATER VALVE: The scope of this project may require the installation of a sanitary
sewer backwater valve per Town Ordinance 6.50.025. Please provide information on the
plans if a backwater valve is required and the location of the installation. The Town of Los
Gatos Ordinance and West Valley Sanitation District (WVSD) requires backwater valves on
drainage piping serving fixtures that have flood level rims less than 12-inches above the
elevation of the next upstream manhole.
11. TITLE 24 - COMMERCIAL: For any proposed tenant improvements, on-site general path of
travel shall comply with the latest California Title 24 Accessibility Standards. Work shall
include, but not be limited to, accessibility to building entrances from parking facilities and
sidewalks.

13. SPECIAL INSPECTIONS: When a special inspection is required by UBC Section 1701, the

Inspection form must be completely filled-out, signed by all requested parties, and be blue-
lined on the construction plans: Special Inspection forms are available from the Building
Division Service Counter or online at www.losg_atosea.gov/building
14. NONPOINT SOURCE POLLUTION STANDARDS SHEET: The Town standard Santa
Clara County Valley Nonpoint Source Pollution Control Program Sheet (or Clean Bay Sheet
2406) shall be part of the plan submittal as the second page. The specification sheet is
available at the Building Division Service Counter for a fee of $2 or at San Jose Blue Print
for a fee.
15. PLANS: The construction plans shall be prepared under the direct supervision of a licensed
architect or engineer. (Business and Professionals Code Section 5538)

17. TRAFFIC IMPACT MITIGATION FEE (COMMERCIAL). The developer shall pay a fee
proportional to the project's share of transportation improvement needed to serve cumulative
development within the Town of Los Gatos. The fee amount will be based upon the Town
Council resolution in effect at the time the building permit application is made. The fee shall
be paid before the building permit is issued, The traffic impact mitigation fee for this project,
using the current fee schedule and the preliminary plans is $ 8,621.61. This fee estimate is
based on conversion of 1,679 square feet of specialty retail space to high turnover sit-down
restaurant use with 22 seats, resulting in an average daily traffic increase of 31.85 trips, and a
PM peak hour increase of 4.69 trips. The final fee shall be calculated from the final plans
using the rate schedule in effect at the time of the building permit application, using a trip
generation rate based on high turnover sit-down restaurant use.
18. TABLE SERVICE. Food ordered at the counter shall be delivered to tables by restaurant
staff. Table service is mandatory to maintain the High Turnover Sit-Down Restaurant use

Aldos' Deli is requesting an amendment to its conditional use permit which would allow
the sale of on site beer and wine to its customers. As it pertains to this application, we
would like to address the following factors:
Aldo's Deli is unique in that we offer deli services, but we also offer sit down
lunches and dinners. We have fall lunch and dinner menus and daily specials.
2. There are some supermarkets that sell some imported Italian goods, and there is a
coffee house that carries a couple of items), but as the Los Gatos Weekly Times
article on the deli dated 711512008, there isn't an authentic Italian deli in town.
Many customers have remarked "We're glad you're here!"
3. Offering beer and wine would add to the authentic Italian flare of the deli.
Wine is definitely a part of the Italian culture.
4. People enjoy wine with their Italian cuisine.
5. Ours is an upscale establishment. The food and wine go "hand in hand."
6. Aldo's Deli is affiliated with Aldo's Ristorante & Bar, also in Los Gatos. Aldo's
Ristorante & Bar has operated in Los Gatos since 1999 with a full liquor license
and has never had any complaints or problems or charges against it regarding
alcohol.

Requesting approval to modify a conditional use permit to allow beer
and wine service and allow outdoor seating (Aldo's Deli) on a
property zoned C-1. APN: 529-07-094
It is recommended that the following conditions from Exhibit 3, be modified to correct an error
and to regulate the seating (previous wording is struck out and new wording is in italics).
5. SEATING: A maximum of flikty twenty two (22) seats are allowed inclusive of indoor
and outdoor seating. A maximum of two seats may be placed in the outdoor seating area
adjacent to 442 North Santa Cruz Avenue.
6. OUTDOOR SEATING: The outdoor seating shall be approved by Town ,staff prior to
installation to ensure that the furniture is complimentary to the existing Starbucks
furniture, but will be easily distinguished for patron use. There shall be no alcohol
permitted in the outdoor seat-sing area.
It is also recommended that the following condition of approval be added to ensure that
accessibility requirements are met:
ACCESSIBLE SEATING. The applicant shall provide accessible seating which
complies with current building code requirements.
