ADOPT RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR
THE TOWN PLAZA FILTRATION SYSTEM UPGRADE.
RECOMMENDATION:
Adopt resolution approving plans and specifications for the Town Plaza Foundation Filtration
System Upgrade.
BACKGROUND:
The Town Plaza Interactive Fountain was constructed as a part of the Town Plaza Reconstruction
Project in 2003. The fountain was built with the most current and state-of-the-art filtration
system for this time period.
In 2006, the discovery of the microorganism protozoa Cryptosporidium in interactive fountains
nationwide caused the Santa Clara County Health Department to notify the owners and operators
of the associated public health risks. The County has directed all cities with interactive fountains
to eliminate the risk of the microorganism in their fountains. Other interactive fountains in Santa
Clara County, including the fountain at Plaza de Cesar Chavez in San Jose, were shut down due
to this discovery, while new treatment systems could be installed. Interactive fountains are most
at risk for exposure because water is re-circulated through a series of jets, increasing the
opportunity for Cryptosporidium and other contaminants to potentially cause human health
problems. The current filtration system at Town Plaza uses a combination of chemical treatment
and an ozonator. Ozone is one of the most powerful sterilizing agents in the world; however, it
cannot neutralize Cryptosporidium. Technical and health experts familiar with the protozoa have
determined the only treatment method is the ultraviolet treatment of water.

DISCUSSION:
On, April 21, 2008, the Council authorized the Town Manager to execute a Professional Service
Agreement with CMS Collaborative to provide design services for an ultraviolet filtration system
for the Town Plaza fountain,
This firm was the original designer of the fountain at the Town Plaza and has designed nearly all
other such fountains in the Bay Area. The design of the upgraded water treatment system has
been completed. The addition of a new ultraviolet (UV) filtration system will bring the fountain
into compliance with new County health regulations and provide a long term solution to the
Cryptosporidium problem, UV purification is a proven technology (EPA approved) that can
protect the public from waterborne disease causing microorganisms, such as Cryptosporidium,
bacteria, viruses, and fungi. UV disinfection works by delivering concentrated amounts of UV
light energy to the reproductive mechanism of the microbe, effectively killing it. As water passes
through the UV chamber, it instantly disinfects it.
It is anticipated that the construction of the UV filtration system will take place in early 2009
during winter months, while the fountain is not in operation.
CONCLUSION:
It is recommended that the Council adopt the attached Resolution approving plans and
specifications for the Town Plaza Fountain Filtration System Upgrade.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301 c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
Sufficient funds are available for this project pending upon the Town Council's approval of the
Year End Fund Balance Reserve Designation of $300,000, which is addressed on a separate
report submitted by Finance for the December 15t" Council meeting. $200,000 was estimated in
the Council approved CIP, but an additional $100,000 is needed due to the pending reallocation
of State Park Bond monies.

RESOLUTION
RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
APPROVING THE PLANS AND SPECIFICATIONS FOR
PPW JOB NO. 08-14 - TOWN PLAZA FOUNTAIN FILTRATION SYTEM
WHEREAS, plans and specifications for the Town Plaza Fountain Filtration System
have been prepared by the Town Engineer and duly filed with the Clerk Administrator; and
WHEREAS, the Town Council of the Town of Los Gatos has reviewed said plans and
specifications.
NOW, THEREFORE, BE IT RESOLVED THAT the Town Council hereby approves
the plans and specifications for the Town Plaza Fountain Filtration System.
BE IT FURTHER RESOLVED THAT the Clerk Administrator is hereby authorized
and directed to advertise the Town Fountain Filtration System for bids in the manner prescribed
by the Town Municipal Code.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos held on the 15th day of December, 2008 by the following vote:
