IMPROVEMENTS
ADOPT RESOLUTION ACCEPTING WORK OF CUPERTINO

MANAGER/EXECUTIVE DIRECTOR TO EXECUTE CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETIQN FOR RECORDING BY
THE TOWN CLERK/SECRETARY OF THE REDEVELOPMENT
AGENCY
Adopt resolution accepting work of Cupertino Electric,Inc.and authorizing the Town
Manager/Executive Director to execute Certificate of Acceptance and Notice of Completion for
recording by Town Clerk/Secretary of the Redevelopment Agency.
BACKGROUND:
On April 21 ,2003,the Town CouncillRedevelopment Agency approved plans and specifications for
Project 02-33B -Santa Cruz Avenue Electrical Improvements.On August 18,2003,the
CounciV Agency awarded the contract for this work to Cupertino Electric,Inc.as the lowest
responsible bidder.On November 21,2003 ,the project was substantially completed.The execution
and recordation of the Certificate of Acceptance is now required to finalize the Town's acceptance
of the project.
DISCUSSION:
The Town of Los Gatos had prepared a conceptual streetscape plan for the downtown area along
Santa Cruz Avenue and Main Street in 1996.Implementation of this plan began in 2001.The first
phase of the improvements along Santa Cruz Avenue (Bean Avenue to Bachman Avenue)which
included construction of new curb,gutter,and sidewalk with landscaped planters and intersection

The Santa Cruz Avenue Electrical Project included placement or wiring,replacement ofsubstandard
electric panels,and replacement of street lights.Street lights were replaced on the west side ofSanta
Cruz Avenue due to their overall age and poor condition.The same style of street lights will be used
to match the rest of the lights on Santa Cruz Avenue.The street lights on the east side of Santa Cruz
Avenue,from Baclunan to Main Street,can be rep laced i~the future.This work wi 11 take p lace from
BaClunan Avenue to Main Street.As a result of this project,all overhead tree lights have been
undergrounded along Santa Cruz Avenue.
The contracted work has been completed by C lpertino Electric.Inc.arid is accepted by the Parks
and Public Works Department.Ten percent of the faithful performance bond will remain in effect
for a period of two years to guarantee any needed repair and/or replacement caused by defective,
materials and workmanship.Staff recommends that the Certificate of Acceptance and Notice of
Completion be executed and recorded.,
ENVIRONMENTAL ASSESSMENT:
This project is Categorically Exempt pursuant to (Sections 15301 (c),15304 (b)ofthe State CEQA
Guidelines.
FISCAL IMPACT:
Project 02-33B -Santa Cruz Avenue Electrical Improvements was funded in ~he2002/03 C~pital
Improvement Program -Fund 930.
The original contract approved by Council was for $199,700.97 with a contingency budget of
$30,000.The total project approved budget was $229,700.97.The project was completed for
$229,632.24 which is under the total project approved budget.

ACCEPTING WORK OF CUPERTINO ELECTRIC.INC.FOR
PROJECT 02-33B -SANTA CRUZ AVENUE ELECTRICAL IMPROVEMENTS AND
AUTHORIZING THE TOWN MANAGERJEXECUTIVE DIRECTOR TO EXECUTE
CERTIFICATE OF ACCEPTANCE AND NOTICE OF COMPLETION
FOR RECORDING BY THE TOWN CLERK/SECRETARY
.WHEREAS,on April 21 ,2003,the Town Council/Redevelopment Agency approved plans
and specifications for Project 02-33B -Santa CI'UZ Avenue Electrical Improvements;and
WHEREAS,on August 18,2003,the Town Council/Redevelopment Agency awarded the
contract for the proposed work to Cupertino Electric,Inc.;and
WHEREAS,Cupertino Electric,Inc.substantially completed the project in conformance
with the plans and specifications pursuant to CounciVAgency approval;and
WHEREAS,ten percent ofthe performance bond provided by Cupertino Electric,Inc.shall
remain in place for two years until January 5,2005 to guarantee the work;and
WHEREAS,the work on Project 02-33B -Santa Cruz Avenue Electrical Improvements is
hereby accepted as complete pursuant to the plans and specifications for the project.
NOW THEREFORE BE IT RESOLYED,that the Town Manager/Executive Director is
authorized and directed to execute the Certificate ofAcceptance and Notice of Completion attached
as (Exhibit A)hereto.
BE IT FURTHER RESOLYED,that the Town Clerk/Secretary is directed to transmit this
Certificate of Acceptance and Notice of Completion to the Recorder of Santa Clara County for
recording.

work is listed in the specifications prepared by the Town of Los Gatos and generally consisted of '
furnishing all labor,materials,tools,equipment,and services required for completion ofthe Santa
Cruz Avenue Electrical Improvements located in the TOWN OF LOS GATOS,County of Santa
Clara,State of California and was completed,approved and accepted January 5,2004.
