RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING THE FEES IN SUPPORT OF THE TOWN'S ADOPT A BENCH PROGRAM FOR
INCLUSION IN THE COMPREHENSIVE FEE SCHEDULE EFFECTIVE JULY 1, 2026,
THROUGH JUNE 30, 2027
WHEREAS, on April 7, 2026 Town Council adopted Resolution 2026-016 "Town of Los
Gatos Comprehensive Fee Schedule" ("Fee Schedule");
WHEREAS,the motion of adoption of said resolution excluded adoption of a fee for the
Adopt a Bench Program pending additional information from staff;
WHEREAS, after receiving the additional information and recognizing that the fees for
service are imposed by the Town to support government services the proposed fees are hereby
determined to be reasonable in that they do not exceed the estimated reasonable costs of
providing the public services proposed to be rendered;
WHEREAS, in adopting the fees and this Resolution, the Town is exercising its power
under Article XI,Section 7, and Article XIIIC of the California Constitution, Section 50076 of the
California Government Code, its Town Code, and other applicable laws;
WHEREAS, since this fee is new, relevant information regarding the fees was made
available for public review and comment for ten (10) days prior to the public hearing at which
this resolution was considered and adopted;
WHEREAS, on June 16, 2026,the Town Council held a public hearing on the fees and
charges set forth in the revised fee schedule;
WHEREAS, on May 29 and June 5, 2026, timely notice of the public hearing was
published in a newspaper of general circulation in the manner set forth in Government Code
Sections 6062a and 66018; and
WHEREAS, notice of the public hearing was mailed to all persons requesting such notice
pursuant to Government Code Section 66016.
NOW,THEREFORE, BE IT RESOLVED that the Town Council of the Town of Los Gatos
does hereby declare, determine, and order as follows:
1. That the Town Council hereby finds that the above Recitals are true and correct by this
reference makes them a part thereof.
2. Adoption of Fees. The fee for an initial bench application and installation shall be
$7,517.00 for the initial 10-year term,the fee for each subsequent 10-year renewal term

shall be $2,958.00, and the fee for a plaque on an existing bench and initial 10-year
maintenance period shall be $3,638.00.
3. Staff is directed to amend the Town's "Comprehensive Fee Schedule" Accordingly.
4. Effect of Fees Prior to effective Date of Resolution. This Resolution shall not be
construed so as to affect any fee or charge payable or paid under any applicable fee
schedule operative prior to the effective date of this Resolution.
5. Effective Date. The fees set forth in the "Comprehensive Fee Schedule" shall be effective
July 1, 2026.

Gatos, California, held on June 16, 2026, by the following vote:
