2026-016 - Adopt the Fee Schedule FY 26-27 RESOLUTION 2026-016 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ADOPTING THE "2026/27 COMPREHENSIVE FEE SCHEDULE"WHICH IMPOSES NEW FEES,AMENDS EXISTING FEES AND RETAINS UNCHANGED FEES FOR VARIOUS TOWN DEPARTMENTS WHEREAS, for the previous fiscal year 2025/26 (July 1, 2025 to June 30, 2026) certain fees were adopted by Resolution No. 2025-022 and were then incorporated into the "Town of Los Gatos Comprehensive Fee Schedule" ("Fee Schedule"); WHEREAS,the Town desires to impose new fees, amend existing fees and retain unchanged certain fees based on the document entitled "Comprehensive Fee Schedule"; WHEREAS, where the fees for service are imposed by the Town to support government services and not for the purpose of providing a market-based fee for services that are also provided by the general public,the proposed fees are hereby determined to be reasonable in that they do not exceed the estimated reasonable costs of providing the public services proposed to be rendered; WHEREAS,the proposed fees for rentals of Town facilities are consistent with neighboring jurisdictions; WHEREAS, in adopting the fees and this Resolution,the Town is exercising its power under Article XI, Section 7, and Article XIIIC of the California Constitution, Section 50076 of the California Government Code, its Town Code, and other applicable laws; WHEREAS,for fees that are noted in the fee schedule as new or increasing, relevant information regarding those new or increased fees were made available for public review and comment for ten (10) days prior to the public hearing at which this resolution was considered and adopted; WHEREAS, on April 7, 2026,the Town Council held a public hearing on the fees and charges set forth in the revised fee schedule; WHEREAS, on March 27 and April 3, 2026,timely notice of the public hearing was published in a newspaper of general circulation in the manner set forth in Government Code Sections 6062a and 66018; and WHEREAS, notice of the public hearing was mailed to all persons requesting such notice pursuant to Government Code Section 66016. 1of2 Resolution 2026-016 April 7,2026 NOW,THEREFORE, BE IT RESOLVED that the Town Council of the Town of Los Gatos does hereby declare, determine, and order as follows: 1. That the Town Council hereby finds that the above Recitals are true and correct by this reference makes them a part thereof. 2. Adoption of Fees, Rates and Charges. The fees, rates, and charges (hereinafter collectively, "fees") contained in the document entitled "Comprehensive Fee Schedule" are hereby adopted and are to be set forth in a document entitled "Comprehensive Fee Schedule." 3. Effect of Fees Prior to effective Date of Resolution. This Resolution shall not be construed so as to affect any fee or charge payable or paid under any applicable fee schedule operative prior to the effective date of this Resolution. 4. Effective Date. The fees set forth in the "Comprehensive Fee Schedule" shall be effective July 1, 2026. The Fee Schedule will be adjusted annually by the average Consumer Price Index (Bureau of Labor Statistics, U.S. Department of Labor for the San Francisco/Oakland/San Jose Metropolitan Statistical Area) for the calendar year and/or by the percentage increase in actual operating costs for the current year —whichever is greater. For FY 2026-2027, the fees are adjusted by 2.2% CPI. This Fee Schedule also provides for minimum annual adjustments for those fees that are directly related to personnel costs. Other adjustments may be made to maintain consistency with the surrounding municipalities within the Town of Los Gatos region but in no case are fees charged in excess of service delivery costs. Town of Los Gatos FY 2026-2027 Comprehensive Fee Schedule 6 DEVELOPMENT SERVICES Seismic Hazards Mapping Program Fee (SMIP) For residential construction of three stories and less (Category 1), the permit fee is $13.00 per $100,000. For all other construction (Category 2), the permit fee is $28.00 per $100,000. This fee is required by the State of California to identify and map zones of particular seismic hazards. Five percent of the fee is retained by the Town to be used solely for earthquake preparedness.
