BACKGROUND:
The California Vehicle Code (CVC) requires engineering and traffic surveys to be completed at least
once every seven years to support radar enforcement of prima facie speed limits, e.g., speed limits that
are not statutory such as local streets (25 mph) and the maximum speeds on highways and freeways
(55, 65,and 70 mph).
The previous town -wide engineering and traffic survey was completed in November 1996 and was
approved at the February 3, 1997 Town Council meeting. It has been seven years and the renewal of
the engineering and traffic survey has been completed. The report is on file in the department of Parks
and Public Works and is over 100 pages in length. A summary table of the report is attached. A
sample copy of the engineering and traffic survey for one street segment is also attached. No changes
in posted speed limits are recommended in this report.

DISCUSSION:
Many of the local streets, which were surveyed previously, were removed from the new survey list
as they meet the local street definition in the CVC for 25 mph speed limits, which do not require
engineering and traffic surveys for radar enforcement. Section 15.30.235 of the Town Code needs
to be amended to reflect the removal of these streets from the list of streets for which speed limits
must be established. As noted in the Background section, no changes in posted speed limits are
recommended; however, additional amendments to Section 15.20.235 are required to align the
established speed limits in the ordinance with the posted speed limits.
Council approval of this survey is required before the document can be sent to the Municipal and
Juvenile Courts for "judicial notice." Judicial Notice is where the court recognizes the engineering
and traffic survey as containing facts that are self evident and no additional speed limit study evidence
is necessary in a particular speed violation case.
An engineering and traffic survey includes measuring the prevailing speeds and evaluating the
existing roadway and traffic conditions, accident history, and pedestrian and bicyclist safety. The
speed limit is normally established at the first five mile per hour increment below the 85 percentile
speed. In matching existing conditions with the traffic safety needs, engineering judgment may
indicate the need for further reduction of five miles per hour.
CONCLUSION:
The attached study should be approved so that the Police Department may legally enforce speed limits
on all Town streets by using radar.
FISCAL IMPACT:
The speed study will be charged to the PPW - FY 2003/04 operating budget. (Acct. No. 5030-61551).

AMENDING SECTION 15-30.235 OF THE LOS GATOS
TOWN CODE FOR ESTABLISHING SPEED LIMITS
ON CERTAIN STREETS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY
ORDAIN:
SECTION I
Section 15-30.235, of the Town Code is hereby repealed in its entirety.
SECTION II
Based on an engineering and traffic survey, Section 15-30.235 of the Los Gatos
Town Code is hereby enacted to read as follows:
Sec. 15.30.235. Establishing speed limits on certain streets.
It is hereby determined upon the basis of an engineering and traffic survey that the following
speed limits will facilitate the orderly movement of vehicular traffic and are reasonable and safe and
are declared the prima facie speed limits and shall be effective when appropriate signs giving notice
thereof are erected upon the street.

such streets at the locations he determines are suitable.
SECTION IV
This Ordinance takes effect 30 days after the date it is adopted. Within 15 days after this
Ordinance is adopted, the Town Clerk shall cause it to be published once in a newspaper of general
circulation published and circulated in the Town.
This Ordinance was introduced at a regular meeting of the Town Council of the Town of Los
Gatos on , 2003, and adopted by the following vote as an ordinance of the Town of Los

ADOPT--A--PLANTER PROGRAM CONT. (15.33)
Motion by Mr. Pirzynski, seconded by Mr. Wasserman, that Council accept report and approve the
Adopt -a -Planter Program as proposed in the report. Carried unanimously.
ENGINEERING AND TRAFFIC SURVEY 2003/ESTABLISHING SPEED LIMITS (16.41)
Director of Public Works, John Curtis, gave the staff report on this item explaining how the traffic study
survey data has remained consistent with our current speed signs throughout Town. He also noted that
these speed studies were needed to help law enforcement when traffic tickets are disputed in court and
that the Town can use radar enforcement on the surveyed streets.
The following people from the audience addressed this issue:
Ray Davis addressed traffic on South Santa Cruz Avenue where the cars exit the freeway. He
expressed concern with the diagonal parking alongside the Post Office which causes sight difficulties
as drivers exit Montebello Way and attempt to see the oncoming traffic from the freeway. He also
asked why there was no mention of a school zone in the report.
John Curtis, Director of Public Works, reported that there was additional back up information that
augments this survey. He spoke of a gateway that is being planned for the Wood Road area that will
help slow traffic and announce entrance into Town.
Doug McNeal spoke of the Winchester and Daves intersection area and displayed a chart showing the
peak zones of speed at this location. He requested more specific monitoring of the traffic and
aggressive enforcement of the 25mph speed signs.
No one else from the audience addressed this subject.
Motion by Mr. Glickman, seconded by Ms McNutt, that Council accept the 2003 Engineering and
Traffic Survey for the Town of Los Gatos. Carried unanimously.
The Town Clerk read the Title of the Proposed Ordinance.
Motion by Mr. Glickman, seconded by Mr. Pirzynski, that Council waive the reading of the Proposed
Ordinance. Carried unanimously.
Motion by Mr. Glickman, seconded by Ms McNutt, that Council introduce Proposed Ordinance
entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING SECTION 15-30.235 OF
THE LOS GATOS TOWN CODE FOR ESTABLISHING SPEED LIMITS ON CERTAIN
STREETS. Carried unanimously.
