Open the public hearing; 2. Close the public hearing; 3. Adopt Resolution amending traffic impact mitigation fees and rescinding Resolutions 1990-144 and 1993-134. PURPOSE OF FEE: Section 15.70.015(b) of the Town Code states the purpose of traffic impact mitigation fees is: "The Town Council finds that the purpose of the traffic impact mitigation fee is to assure that each new development or expansion of use pays its fair share of the transportation improvements needed to accommodate the cumulative traffic impacts. Existing and known future sources of revenue are inadequate to fund a substantial portion of the transportation improvements necessary to avoid unacceptable levels of service, congestion, and related adverse impacts." BACKGROUND: At its September 11, 1991 meeting, the General Plan Committee recommended that the Planning Commission forward a new formula for calculating traffic impact mitigation fees to the Council. The Planning Commission endorsed this formula at its October 9, 1991 meeting, referring the matter to Council for adoption on November 18, 1991. At the April 5, 1993, Council requested that the matter of amending traffic impact mitigation fees be reconsidered prior to the budget hearings for FY 1994-1995. Reviewed by: Attorney Clerk ance Treasurer PAGE 2 MAYOR AND TOWN COUNCIL SUBJECT: ADOPTION OF RESOLUTION AMENDING TOWN -WIDE TRAFFIC IMPACT MITIGATION FEES March 31, 1994 The existing formula uses a table of fees assessed by floor area for classes of land use. The fee for new uses is reduced by a credit based on the fee that would have been charged for the existing or former use on the property. While residential fees are calculated on a linear basis (e.g. $600 per average daily trip), commercial fees are not. Commercial uses that are high traffic generators pay Tess per trip than some low traffic generators. This occasionally resulted in a situation where the credit for new developments actually exceeded the fee even though the increase in traffic was fairly substantial. The General Plan Committee felt that this situation was unfair. Since that time staff has encountered situations where the reverse was also true. The new formula is based on tables which assign trips to both the new and former use with the credit established by subtracting the old trips from the new trips and then assessing a fee of $600/trip for the first 10 new trips and $60/trip for the remainder. Since that time, Town staff met with the legislative committee of the Chamber of Commerce for several months regarding this and other issues, culminating in the committee endorsement of the proposed Traffic Impact Fee Resolution. However, the committee did not want the fee for medical office use to be reduced. The proposed resolution (Attachment 1) provides that the fee for medical office use be calculated at $600 per Average Daily Trip (ADT) for the first (10) trips and $120 per ADT thereafter. By calculating the fee for medical office use in this manner, the fee will remain about the same as under the current fee schedule. The proposed fees will not change the current Traffic Policy or Traffic Impact Fee Ordinance. Projects that generate over 20 A.M. or P.M. Peak Hour trips will still be required have a traffic report, and to mitigate specific traffic impacts in addition to paying a Traffic Impact Mitigation fee. The draft resolution (Attachment 1) only affects the cost of the traffic fee. Attachment 2 established the existing fee schedule and upon adoption of the draft resolution, will be rescinded. The resolution included as Attachment 3 adopted the Institute of Transportation Engineers Trip Generation as the new rates, and the provisions of Resolution 1993-134 have been incorporated into the draft resolution. DISCUSSION: Section 15.70.035 of the Town Code requires that the amount of the Traffic Impact Mitigation Fees be established by resolution, and shall be subject to periodic review by the Town Council. Council included this provision because it recognized that adjustments in the fee would be necessary from time to time as staff gained experience implementing the fee schedule. The main area of concern to staff has been the method currently used to assign credit for previous uses. In most instances, when commercial property is redeveloped, the new use is different than the former use. In some instances, the new project will generate more traffic but that is not reflected in the fee. This very problem is what originally prompted Council to ask staff to revise the traffic impact fees. On the other hand, in reviewing proposed projects at the counter or at the Development Review Committee, there have been cases where the traffic has not increased, but a significant fee is required by the current fee schedule. Many of these projects have been dropped or have failed to proceed because of the cost of the fee. Attachment 4 shows the changes in the existing and proposed fee on various uses. The first half of the table shows the difference in fees for development of vacant property. The second half of the table, which is a summary of Attachments 5 - 9 and the discussion below, shows that the fee and the increase in ADT's are linked. Since this matter was last heard by Council, staff has identified several examples that illustrate why the method of calculating traffic fees should be revised. Attachment 5 shows the fee calculation for a project at 15166 Los Gatos Boulevard (Nissan -Volvo site). The proposed project will significantly decrease the ADT and add only four additional P.M. Peak Hour trips. Based on the way the credit for a previous use is calculated, this project would be required to pay in excess of $100,000 in Traffic Impact Mitigation Fees. PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: ADOPTION OF RESOLUTION AMENDING TOWN -WIDE TRAFFIC IMPACT MITIGATION FEES March 31, 1994 This is because fees for housing are based on the maximum fee allowed based on a nexus evaluation ($600 X 9.87 ADT), and all other uses are based on a chart that places each use into a general category. Under the current fee schedule there is no correlation between the increase in the number of trips generated by a use and the fee. On the other hand, Attachment 6 shows the fee calculation for demolition of a convalescent hospital and building a new medical office building located at 15400 National Avenue. The project would significantly increase traffic but under the current fee schedule the fee was only $12,033. Under the proposed fee schedule the fee would be over $70,000. Attachment 7 shows the fee calculations for a medical office building on a vacant lot at 555 Knowles Drive. The traffic fee under the current fee schedule and the proposed fee schedule are comparable, which was a goal of the Chamber of Commerce legislative committee. To Accomplish this goal, the fee for medical offices is higher than other uses such as retail and restaurants. This is justified by the fact that medical office uses only generate property tax revenue, whereas retail uses generate sales tax and property tax revenue. The attachment also shows medical office fees calculated at the same rate as other uses. The proposed fee schedule will increase the traffic fee for restaurants. Attachment 8 shows that the fee under the proposed fee schedule correlates directly with the increase in traffic. This example is for a McDonald's restaurant that was proposed in a building previously occupied by a bank at 497 N. Santa Cruz Avenue. McDonald's withdrew this application on March 23, 1994. The last example, Attachment 9, shows the fee calculation for another restaurant that was proposed in a building previously occupied by retail uses. When this application originally went to the Planning Commission, a Spanish restaurant was proposed (it is now proposed to be a yogurt shop). The restaurant category from ITE, is not reflected in the existing fee schedule since all restaurants are grouped into one category, it is the same for all restaurants. Under the proposed fee schedule, the type of restaurant will dramatically affect the fee. I.T.E. has three restaurant categories; quality, high -turnover sit down and fast food and each category has significantly different ADT's. Restaurants will be required to pay a fee based on the type of restaurant and the ADT generated by that type of restaurant. The final issue that will be resolved by the proposed fee schedule has to do with businesses that are defined as a restaurant by the Zoning Ordinance but are not considered restaurants by ITE. Walk-in, impulse shops, such as yogurt shops, juice bars and donut shops are considered restaurants by the Zoning Ordinance but are considered Specialty Retail by ITE. These uses simply do not generate the amount of additional traffic as shown by ITE for restaurants. To resolve this issue, staff will use the traffic generation rate for Specialty Retail uses to calculate the traffic fee. As a result, these businesses would not be charged a fee unless they increased the size of the building. CONCLUSION: Adoption of the proposed fee resolution (Attachment 1) will resolve numerous issues that have come to light since the current fee schedule was originally adopted in July, 1990. The proposed fee schedule is consistent with the objectives of the Town's Traffic Policy and Traffic Impact Mitigation Fee Ordinance. FISCAL IMPACT: The new fee schedule will directly tie the fee to the increase in traffic. The revenue generated will depend on the number and type of projects ultimately approved. Further, projects which would be assessed these fees might also be conditioned to construct public improvements, reducing the need for future capital expenditures. The Town Council may exempt housing developments for very low, low and moderate income residents (as defined by Town Ordinance, General Plan, or statute) from all or a portion of the traffic impact mitigation fee upon making a finding that the development provides a significant community benefit by meeting current needs for affordable housing. The exempted fees will be made up from other sources of revenue. Traffic mitigation fees paid by other developers will not be used to subsidize the exempted projects. Each year the Town will identify how much money is to be allocated in the Capital Improvement Program for traffic improvement projects. X LS Rev: 3 /30 /94 TTACHMENT RESOLUTION 1994-55 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS AMENDING TRAFFIC IMPACT MITIGATION FEES AND RESCINDING RESOLUTIONS 1990-144 AND 1993-134 RESOLVED, the Town Council hereby establishes a traffic impact fee payable pursuant to Chapter 37 of the Town Code as follows: A. The fee for residential uses shall be calculated at $600 per Average Daily Trip (ADT). B. The fee for medical office use shall be calculated at $600 per ADT for the first ten (10) trips and $120 per ADT thereafter. C. The fee for all other uses shall be calculated at $600 per ADT for the first ten (10) trips and $60 per ADT thereafter. D. The Town Council may exempt housing developments for very low, low and moderate income residents (as defined by Town Ordinance, General Plan, or statute) from all or a portion of the traffic impact mitigation fee upon making a finding that the development provides a significant community benefit by meeting current needs for affordable housing. The exempted fees will be made up from other sources of revenue. Traffic mitigation fees paid by other developers will not be used to subsidize the exempted projects. Each year the Town will identify how much money is to be allocated in the Capital Improvement Program for traffic improvement projects. Additional revenue sources will be identified to cover exempted fees. SM06\RESOS\TRAFFIC. RES E. Traffic credit may be granted for an existing or former use. When applicable, existing or former use traffic (ADT) shall be subtracted from the project traffic prior to calculating the fee. The first ten trips of the difference will be charged at the higher $600 per trip rate. F. ADT is defined as the number of average daily trips associated with an identified land use as determined or derived from the most recent edition of Trip Generation by the Institute of Transportation Engineers or a Town sponsored traffic study - whichever is less. The Town approved traffic study will be paid for by the applicant. FURTHER RESOLVED, this Resolution rescinds Resolution No. 1990-144 and Resolution No. 1993-134. She requested a more visible sign located soon enough to warn drivers of the dead end. HEARINGS TRAFFIC MITIGATION FEES/REVISED PLAN/HEARING/RESOLUTION 1994-55 (18.46) Mayor Attaway stated that this was the time and place duly noted for public hearing to consider adopting a resolution revising town -wide traffic impact mitigation fees.
