RECOMMENDATION:
Adopt resolution authorizing Town Manager to sign right-of-way certifications in connection with State and federally
funded road projects.
BACKGROUND:
The Department of Transportation Seismic Safety Retrofit program was enacted following the Lorna Prieta earthquake
of I989. The Caltrans' division of Structures identified seismic design structural deficiencies in approximately 1,094
local bridges throughout the State of California. The two bridges in Los Gatos are located at Los Gatos Creek at Blossom
Hill Road, and Los Gatos Creek at Lark Avenue. Both were screened by Caltrans and approved for the Seismic Retrofit
Program.
DISCUSSION:
The authorization is a requirement by the State of California, Department of Transportation, prior to the processing of
the Request for Authorization for Construction of the Seismic Retrofit Projects at the Los Gatos Creek bridges at Lark
Avenue and Blossom Hill Road.
The Town is responsible for completing the plans, specifications and estimates for advertisement and construction of
the retrofit project. Caltrans' Engineering Consultant completed the technical plans and specifications and will assist the
Town in completion of the field review, preparing and filing all permits, environmental documents and right-of-way
certification. The construction work will be completed by a private contractor. All work directly related to the seismic
retrofit project is reimbursable with Federal and State funds. Completion of construction is scheduled for Summer of
2000.
CONCLUSION:
The adoption of this resolution is a compliance of the Department of Transportation requirement for the processing of
the Request for Authorization for the Construction.

RESOLUTION
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SIGN RIGHT-OF-WAY CERTIFICATIONS
IN CONNECTION WITH STATE AND FEDERALLY FUNDED ROAD PROJECTS
WHEREAS:
1. In order to obtain Federal and State assistance in connection with State and Federally funded road
projects, and for the State Department of Transportation to approve the projects for advertising, it is necessary
that the Town of Los Gatos certify to the State Department of Transportation that the right-of-way necessary
for the proper execution of the project will be or have been acquired; and
2. The State of California Department of Transportation, as provided in the Local Program Manual
Volume I, will now accept right-of-way certifications signed by the Town Manager if the Council of the
Town has by resolution authorized him to sign said certifications.
BE IT RESOLVED:
The Town Council of Los Gatos hereby authorized the Town Manger to execute, on behalf of the Town of
Los Gatos, all Right -Of -Way Certifications required for State and Federally funded projects and directs him
to forward a copy of this resolution to the appropriate office of the State of California Department of
Transportation.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,
California, held on the 22nd day of February, 2000 by the following vote.
