Dir., Santa Clara County Congestion Management Agency Reviewed by: Attorney Clerk Finance Treasurer COUNCIL ACTION/ACTION DIRECTED TO: RESOLUTION 1991-68 RESOLUTION OF THE TOWN OF LOS GATOS DESIGNATING A CONGESTION MANAGEMENT AGENCY FOR SANTA CLARA COUNTY WHEREAS, the voters of the State of California approved an $18.5 billion dollar transportation funding program through Propositions 111 and 108 at the June 1990 election; and WHEREAS, the voter approval included the requirement that each urbanized county in California prepare, update, administer and enforce a Congestion Management Program; and WHEREAS, for highway and rail projects to be eligible for state funding, such projects must be included in a Congestion Management Program; and WHEREAS, if a city or county is found not to conform to the Congestion Management Program, its new gas tax revenues pursuant to Proposition 111 shall be withheld; and WHEREAS, an agency must be designated to prepare, update, administer, and enforce the Congestion Management Program by a majority of the cities representing a majority of the population and the County Board of Supervisors; and WHEREAS, a majority of the cities representing a majority of the population and the Board of Supervisors of Santa Clara County have designated the Santa Clara County Congestion Management Agency to be the said Agency. L8\resos\congst.mgt NOW THEREFORE, be it resolved that the Town of Los Gatos does designate the Santa Clara County Congestion Management to prepare, update, administer and enforce the Congestion Management Program for Santa Clara County. AND BE IT FURTHER RESOLVED that the Mayor is authorized to execute the Joint Powers Agreement, dated March 20, 1991, which defines the purpose, objectives, functions and responsibilities, powers, organization and special provisions of the Santa Clara County Congestion Management Agency. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 22nd day of April 1991, by the following vote. Cosgrove CLERK OF THE TOWN OF LOS GATOS L8\resos\congst,mgt 2 TOWN OF LOS GATOS CALIFORNIA TOWN COUNCIL/PARKING AUTHORITY April 22, 1991 Minutes TOWN COUNCIL The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers of the Town Hall, 100 East Main Street, at 8:05 p.m., Monday, April 22, 1991, in adjourned regular session and special session. ROLL CALL Present: Randy Attaway, Joanne Benjamin, Steven Blanton, Eric D. Carlson and Mayor Brent N. Ventura. Absent: None. CLOSED SESSION Mayor Ventura, reported that Council had met in Closed Session prior to this evening's meeting pursuant to Government Code Section 54957.6 to discuss to discuss Labor Relations. There was no report from that discussion. Pursuant to Government Code Section 54957 to discuss a Personnel matter. There is no report at this time. ROUTE 85/POLLARD ROAD/LANDSCAPING Motion by Mr. Carlson, seconded by Mr. Attaway, that Council appoint Mayor Ventura to work with the City of Campbell in negotiating Pollard Road landscaping issues regarding Route 85, (providing it does not cost the Town any money) and request staff prepare a letter for the Mayor's signature to the City of Campbell. Carried unanimously. PARKING CONTROL VEHICLES/ACQUISITION Motion by Mrs. Benjamin, seconded by Mr. Carlson, that Town does not acquire parking control vehicles this year. Carried by a vote of 3 ayes. Mr. Attaway voted no, stating that the parking restrictions in Town should be changed for uniformity and clarity and the action of enforcement should be upheld by Council. Mr. Ventura voted no, stating that this item should be part of 1991-92 budget. CONGESTION MANAGEMENT/SANTA CLARA COUNTY/JOINT POWERS AGREEMENT RESOLUTION 1991-68 Motion by Mr. Carlson, seconded by Mr. Attaway, that Council adopt Resolution 1991-68 entitled, RESOLUTION OF THE TOWN OF LOS GATOS DESIGNATING A CONGESTION MANAGEMENT AGENCY FOR SANTA CLARA COUNTY. Carried unanimously. ANNEXATIONS/LAFCO PAYMENTS/TRANSFER OF FUNDS Motion by Mr. Carlson, seconded by Mr. Blanton, that Council authorize the following transfer of $6,000 from the Engineering Department salaries and benefits to General Town Administration (010-230-6210) to cover the costs of the annexation program for the remainder of Fiscal Year 1990-91 and ask staff to begin work on GIA to be submitted back to Council.
