RECOMMENDATION:
1. Open and hold the public hearing.
2. Close the public hearing.
3. Adopt the attached resolution to approve and adopt the County of Santa Clara Integrated Waste Management
Summary Plan and Siting Element (CoIWMP) as described in California Public Resources Code (PRC)
Sections 41721 and 41760.
BACKGROUND:
The California Integrated Waste Management Act of 1989 (AB 939) redefined solid waste management in terms of both
objectives and planning responsibilities for local jurisdictions and the State. The Act requires cities and counties to
reduce solid waste disposal 25 percent by January 1, 1995, and 50 percent by January 1, 2000. That law also established
a hierarchy that local jurisdictions must comply with in addressing waste management issues. the new planning
hierarchy includes, in order of priority, source reduction; recycling and composting; and environmentally safe landfill
disposal and transformation (incineration of solid waste materials).
To carry out waste management in accordance with this hierarchy, AB 939 requires each local jurisdiction to prepare
and implement planning documents. The town has prepared and adopted each of the required plans:
• a Source Reduction and Recycling Element (SRRE);
• a Household Hazardous Waste Element (HHWE); and,
• a Nondisposal Facility Element (NDFE).
In addition, each county must prepare a Countywide Integrated Waste Management Plan (CoIWMP).
DISCUSSION:
County staff has completed required revisions to the Preliminary Draft CoIWMP and has issued a Final CoIWMP for
Town approval. A copy of the document is available for review in the Town Clerk's office. The CoIWMP must be
submitted to the State by February 29, 1996.

The CoIWMP includes a Summary Plan and a Siting Element. The Summary Plan describes local integrated waste
management programs and practices contained in local waste management plans. It also identifies programs that will
be implemented on a countywide basis to provide better coordination and minimize duplication of effort. No new
programs are proposed. The Siting Element identifies existing and proposed solid waste disposal facilities, existing
countywide disposal capacity, and establishes goals and siting criteria for siting new (or expanding existing) disposal
facilities. There is no facility planned for siting in Los Gatos. Most landfills in the County have more than 20 years life
expectancy. Only one facility, to be sited in San Jose, is included in the document.
ENVIRONMENTAL ASSESSMENTS:
The CoIWMP includes the required California Environmental Quality Act (CEQA) documentation pursuant to California
Code of Regulations Section 18783. The Town approved negative declarations for each of the three previously adopted
solid waste plans (SRRE, I� IWE, and NDFE).
FISCAL IMPACT:
The Town's Solid Waste Management Program is funded solely through fees.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
APPROVING AND ADOPTING THE COUNTY OF SANTA CLARA
INTEGRATED WASTE MANAGEMENT PLAN
SUMMARY PLAN AND SITING ELEMENT
WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939)
imposes responsibility for solid waste management on cities and counties; and
WHEREAS, the County of Santa Clara Integrated Waste Management Plan Summary
Plan and Siting Element (CoIWMP) has been prepared by County staff in accordance with
requirements of Public Resources Code (PRC) Section 41750 et seq.; and
WHEREAS, PRC Section 41760 et seq. requires that the CoIWMP shall be approved
by the county and by a majority of the cities within the county which contain a majority of
the population of the incorporated areas of the county; and
WHEREAS, pursuant to the California code of Regulations Title 14, Division 7,
Chapter 9, Article 8 (CCR), Section 18779, the Preliminary Draft CoIWMP has been
circulated for a 45-day public review period (September 13, to November 3, 1995), and has
been reviewed and commented on by the Solid Waste Commission of Santa Clara County,
acting as the Local Task Force; and all comments received have been responded to; and
WHEREAS, pursuant to the CCR Section 18733, the adoption of the CoIWMP is
subject to the environmental review requirements of the California Environmental Quality
Act; and
WHEREAS, pursuant to CEQA, an Initial Study of the Environmental Impact of the
CoIWMP, and a Proposed Negative Declaration of Environmental Impact for the CoIWMP

have been issued by the County of Santa Clara Department of Planning and Development and
have been recommended for approval by the Board of Supervisors of the County of Santa
Clara; and
WHEREAS, pursuant to CCR Section 18766, the Town has conducted a public
hearing on the CoIWMP, and after testimony was presented, and upon a review of all
evidence in the record;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Los Gatos that the CoIWMP is hereby approved and adopted.
NOW, THEREFORE, BE IT ALSO RESOLVED that the Town Council of the
Town of Los Gatos hereby authorizes the County of Santa Clara to submit a copy of the
resolution, the CoIWMP, and other related documents required to be submitted pursuant to
PRC Section 41750 to the California Integrated Waste Management Board on the Town's
behalf.
THEREFORE, BE IT RESOLVED:
This decision constitutes a final administrative decision pursuant to Code of Civil
Procedure section 1094.6 as adopted by section 1.10.085 of the Town Code of the Town of
Los Gatos. Any application for judicial relief from this decision must be sought within the
time limits and pursuant to the procedures established by Code of Civil Procedure section
1094.6, or such shorter time as required by state or federal law.

Carried unanimously.
Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council adopt Resolution 1996-12
entitled, RESOLUTION OF THE TOWN OF LOS GATOS APPROVING AND ADOPTING THE
COUNTY OF SANTA CLARA INTEGRATED WASTE MANAGEMENT SUMMARY PLAN AND
SITING ELEMENT. Carried unanimously.
ROBERTS ROAD 17050/RESIDENTIAL DEVELOPMENT/APPEAL (19.09)
Mayor Attaway stated that this was the time and place duly noted for public hearing to consider
appeal of a decision of the Planning Commission denying a request for approval of a Planned
Development application to change the existing zone on 1.3 acres of property from R-1:8000
(Single Family Residential) to R-M:5-12:PD (Multiple Family Residential, 5-12 dwelling units
Per Net Acre, Planned Development), to demolish an existing single family residence, and to
construct 9 new single family residences. If no significant environmental impacts are identified
as a result of this project, a Negative Declaration will be recommended and an Environmental
Impact Report will not be required. Property located at 17050 Roberts Road. Zone Change
Application Z-94-3. Negative Declaration Application ND-94-5. Property Owners: Marjorie
Neal, Frank Nickson and Janice Ramatici. Applicant: Santa Clara Development Co. Appellant:
Mark Robson, Santa Clara Development.

The following people from the audience spoke to this issue:
Mark Robson, representing Santa Clara Development Co., explained the design elements of the
project and requested Council's consideration concerning the appeal.
Dick Stowers, 17809 Cresent Drive, architect for the project, spoke in support and answered
questions.
Speaker from Campbell believes apartments would be a better alternative but not in that
location due to traffic concerns. He was pleased with the more affordable housing in Los Gatos
near schools and stores.
Banley Waters, 505 Blossom Hill Road, spoke about the additional traffic exiting on Roberts and
Blossom Hill and of access on a very congested intersection.

Motion by Mr. Blanton, seconded by Mrs. Benjamin, to close the public hearing. Carried
unanimously.
