RECOMMENDATION:
Adopt Resolution authorizing the West Valley Solid Waste Management Authority to submit a funding request to the
California Department of Conservation for Beverage Container Recycling and Litter Cleanup activities.
DISCUSSION:
Pursuant to the California Beverage Container Recycling and Litter Reduction Act, the Department's Division of
Recycling is required to distribute a total of $10,500,000 to eligible cities and counties for beverage container recycling
and litter cleanup activities. Each city may receive a minimum of $5,000 or an amount calculated by the Division on
a per capita basis. Eligible activities have a primary emphasis on:
• the collection and recycling of beverage containers at large venues, public areas, residential communities or
schools; and,
• public education promoting beverage container recycling and/or litter prevention; or,
• beverage container litter prevention and/or abatement in public places including community clean-up projects
or other related activities involving recycling of beverage containers.
To request funds, the Joint Powers Authority must complete the Funding Request Form and include a resolution from
each of the Member Agencies authorizing the JPA to act on behalf of the jurisdiction as primary contact.
Table 1 summarizes the Funding Request Forms submitted by the May 31 deadline for each of the Member Agencies.

The application stated that the requested funds "would be used for the preparation and distribution of public education
materials promoting JPA programs and other community opportunities (e.g., downtown street recycle containers,
supermarket -based recycling centers) to recycle beverage containers and avoid litters."
Joint Powers Authority Member Agencies have been asked to approve the required resolutions by June 30. The JPA
will approve a resolution identifying the City of Campbell, as Authority treasurer, as authorized to receive and expend
the requested funds.
ENVIRONMENTAL ASSESSMENT:
Is not a project defined under CEQA, and no further action is required.

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS AUTHORIZING THE WEST VALLEY SOLID WASTE
MANAGEMENT AUTHORITY TO SUBMIT A FUNDING REQUEST TO THE
CALIFORNIA DEPARTMENT OF CONSERVATION FOR BEVERAGE CONTAINER
RECYCLING AND LITTER CLEANUP ACTIVITIES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS RESOLVES AS
FOLLOWS:
WHEREAS, the people of the State of California have enacted the California Beverage
Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage
container recycling and litter cleanup activities; and,
WHEREAS, the California Department of Conservation's Division of Recycling has
been delegated the responsibility for the administration of the program within the State, setting up
necessary procedures for cities and counties or their designees under the program; and,
WHEREAS, per Section 14581 (a)(4)(E) of the California Beverage Container
Recycling and Litter Reduction Act, the eligible participant must submit the Funding Request Form
by the due date and time in order to request funds from the Department of Conservation's Division
of Recycling.
NOW THEREFORE, BE IT RESOLVED that the Town Council of the Town of Los
Gatos does hereby authorize the Joint Powers Authority, the West Valley Solid Waste Management
Authority, to submit the Funding Request Form to the Department of Conservation's Division of
Recycling on its behalf. The Executive Director of the West Valley Solid Waste Management
Authority is hereby authorized and empowered to execute in the name of the Town of Los Gatos all
necessary forms hereto for the purposes of securing payment to implement and carry out the
purposes specified in Section 14581 (a)(4)(A) of the California Beverage Container Recycling and
Litter Reduction Act, and provide information regarding this program to the Division upon request.

records to the Division should an audit be performed.
