FIGONE, TOWN MANAGER SUBJECT: MEETING DATE: April 1, 2002 ITEM NO. 0 ADOPT RESOLUTION AUTHORIZING THE WEST VALLEY SOLID WASTE MANAGEMENT JOINT POWERS AUTHORITY TO APPLY FOR BEVERAGE CONTAINER RECYCLING GRANT FUNDS RECOMMENDATION: Adopt the attached resolution authorizing the West Valley Solid Waste Management Authority to apply for and administer funds pursuant to the Department of Conservation Beverage Container Recycling the Litter Reduction Act. BACKGROUND: Over the last two fiscal years, the Department of Conservation has distributed funds to eligible cities and counties for beverage container recycling and litter cleanup activities. The request for funds and fund administration were handled by the West Valley Solid Waste Management Authority. In Fiscal Year 2000/2001, the funds were used for public information program promoting the recycling of beverage containers. In the current fiscal year, the funds are being used to purchase recycling containers for multifamily dwellings. DISCUSSION: The Department of Conservation now requires that individual cities authorize the West Valley Solid Waste Management Authority to submit funding requests and administer the funds. The Town of Los Gatos' anticipated share in each of the next two fiscal years is $8,250.00. Staff of the four cities comprising the Authority are currently discussing options for how the funds may be spent including the option of completing the distribution of recycling containers to multifamily dwellings. VALLEY SOLID WASTE MANAGEMENT AUTHORITY TO ADMINISTER FUNDS March 8, 2002 ENVIRONMENTAL ASSESSMENT: The recommended action is not a project defined under CEQA, and no further action is required. FISCAL IMPACT: The Town of Los Gatos' portion of the Beverage Container Funds will be shown as both revenue and an expense in the proposed operating budgets for the next two fiscal years. The Town will expend funds for the approved beverage recycling option, then be reimbursed by the Authority. There will be no impact on existing Town funds. Attachments: 1. WHEREAS, the people of the State of California have enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures for cities and counties or their designees under the program; and WHEREAS, per Section 14581 (a)(4)(E) of the California Beverage Container Recycling and Litter Reduction Act, the eligible participant must submit the Funding Request Form by the due date and time in order to request funds from the Department of Conservation's Division of Recycling. NOW, THEREFORE, BE IT RESOLVED that the Town of Los Gatos authorizes its Joint Powers Authority West Valley Solid Waste Management Joint Powers Authority (hereinafter "JPA") to submit the Funding Request Form to the Department of Conservation's Division of Recycling on its behalf. The Executive Director of the JPA, is hereby authorized and empowered to execute in the name of the JPA all necessary forms hereto for the purposes of securing payment to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, and provide information regarding this program to the Department of Conservation's Division of Recycling upon request. The JPA will be the responsible parry to provide records to the Department of Conservation's Division of Recycling should an audit be performed. STREET REPAIR & RESURFACING/PROJECT 0106/RESOLUTION 2002-41 & 8RD (15.25) Motion by Mr. Glickman, seconded by Mr. Blanton, that Council adopt Resolution 2002-41 & 8RD entitled, RESOLUTION OF THE TOWN COUNCIL AND THE REDEVELOPMENT AGENCY OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN MANAGER/EXECUTIVE DIRECTOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH HARRIS AND ASSOCIATES FOR CONSTRUCTION MANAGEMENT SERVICES IN CONNECTION WITH THE STREET REPAIR AND RESURFACING PROJECT 0106 FOR THE YEAR 2001-2002 FOR AN AMOUNT NOT TO EXCEED $98,030. Carried unanimously. VERBAL COMMUNICATIONS (XX.28) Broken Cable Box: Carla Dougher, 189 Wedgewood, spoke of a broken cable box in her neighborhood. She asked that Council help with contacting the cable company to have the box repaired. General Comments: Ray Davis, resident, spoke of being monitored by police during the Planning Commission Meeting, and asked for the Attorney's removal. Customer Service: Louis Hernandez, 180 Calle Margarita, noted that he is a member of our community and would like polite attention given to him by the staff.
