RECOMMENDATION:
Adopt resolution authorizing the Town Manager to enter into an agreement with Santa Clara County Central Fire
Protection District to provide Nonpoint Source Pollution Prevention Inspections of Industrial/Commercial Facilities.
BACKGROUND:
The City of Campbell and the Town have discussed with the Central Fire Protection District (CFPD) the possibility of
the CFPD conducting Nonpoint Source (NPS) inspections during annual or hazardous materials inspections. Many of
the CFPD inspection criteria and the NPS are similar and the CFPD already makes regular inspections of these facilities.
The City of Campbell and Town staff have evaluated the costs of conducting separate NPS inspections and find that the
CFPD can provide this service more cost effectively than the Town. Since the CFPD already makes regular inspection
to these facilities, business owners would appreciate not having to tour another inspector through the facility. The
concept of combined inspections for safe handing storage and disposal of toxic and hazardous material is moving forward
with the passage of Senate Bill 1082. The agreement before you is in keeping with the spirit of the law and furthers the
causes of streamlining and efficiency.
DISCUSSION:
The CFPD is willing to conduct NPS inspections for a fee. The fee is based on the pro rata time increase for the CFPD
to include the NPS inspections in the annual inspection of virtually all Town businesses. The CFPD will train and educate
their staff in NPS matters. The CFPD staff will inspect and record results; should a violation occur which requires
followup. Town Staff will perform those activities. The CFPD will deliver guidelines and Best Management Practices
(BMP) to further Public Outreach and Education of the NPS Program.
CONCLUSION:
The proposed agreement is in the best interest of all parties involved and is recommended for approval.

BE IT RESOLVED, by the Town Council of the Town of Los Gatos, County of
Santa Clara, State of California, that the Town Manager is authorized to enter into an agreement
(attached as Exhibit A) with Santa Clara County Central Fire Protection District to provide
Nonpoint Source Pollution Prevention Inspection of Industrial/Commercial Facilities.
