RECOMMENDATION:
1. Declare MCH General Engineering Contractors, Inc. of San Jose to be the lowest responsible bidder on the
project.
2. Award a construction contract to MCH General Engineering Contractors, Inc. in the amount of $526,156.
3. Authorize staff to issue change orders to the contract up to an amount of $78,920.
4. Adopt Resolution authorizing the Town Manager/Executive Director to execute a construction contract with
MCH General Engineering Contractors, Inc. in the amount of $526,156.
5. Approve recommended amendments to the adopted FY 00-01 Capital Budget as described under Fiscal
Impacts.
DISCUSSION:
Sealed bids for the five subject storm drain improvement projects were received and opened by the Town Clerk on July
12. Qualified contractors were required to bid on all five projects as it is statf's intention to award a single construction
contract for all of the work. In general, the bundled project involves the replacement of both deficient and defective
storm drainage facilities at five separate locations throughout the Town, one of which is within the limits of the Town's
Redevelopment Project Area which will be funded by the RDA. For the remaining four projects, staff proposes using
Storm Drainage Impact Fees imposed on prior development projects to fund the recommended construction contract

and contingency amounts. Chapter 60 of Title 24 of the Town's Municipal Code authorizes the assessment of storm
drainage impact fees on most new developments in the Town. These fees may then be used by the Town to improve
its publicly maintained storm drainage system to adequately convey the additional runoff generated by these
developments. It is proposed to use Storm Drainage Impact Fees to fund the four non -RDA projects because each of
these projects will enhance the capacity of the Town's storm drainage system within the Town's three drainage basins.
CONCLUSION:
A total of three contractors submitted bids for the work, however staff deemed one of the bids to be non -responsive due
to the contractor's failure to appear at the mandatory pre -bidding conference held on June 28. A summary of the two
responsive bids is attached. MCH General Engineering Contractors, Inc. of San Jose submitted the lowest bid of
$526,156, which is 18% below the Engineer's Estimate of $642,133. Staffhas carefully canvassed the bids and checked
the low bidder's references, and has determined that the bid submitted by MCH General Engineering Contractors, Inc.
is responsive to the Town's Notice to Contractors.
Consequently, it is recommended that the Council declare MCH General Engineering Contractors, Inc. to be the lowest
responsible bidder on the project; that the Council award the attached construction contract to this firm in the amount
of $526,156, the total of their bid for all five projects; and that the Council adopt the attached Resolution authorizing
the Town Manager/Executive Director to execute the construction contract on behalf of the Town/Agency.
It is further recommended that the Council authorize staff to execute change orders to the contract up to an amount
of $78,920, roughly 15% of the construction contract amount, to cover any unforeseen circumstances and/or conditions
that may arise during the course of construction. If the Council acts as recommended, construction is expected to begin
in early September, and last through mid -November.
ENVIRONMENTAL ASSESSMENT:
All five projects have been determined to be Categorically Exempt under CEQA.
FISCAL IMPACT:
Project #00-24 - Massol/Nicholson/Tait/Hernandez Avenues is the one project within the limits of the Town's
Redevelopment Project Area. Sufficient funding for both the recommended construction contract and contingency
amounts for this project exists within the adopted FY 2000-2005 RDA budget.
To fund the four Basin projects, the following adjustments to the adopted FY 00-01 budget will be required:

Since staff believes that the bid amounts for each of the five drainage projects are fair, and because these projects will
correct existing drainage problems throughout the Town, it is recommended that the Council approve the above budget
adjustments as indicated.

CONTRACT
THIS AGREEMENT is between the Town of Los Gatos (hereinafter referred to as
"Owner") and MCH General Engineering Contractors, Inc. (hereinafter referred to as
"Contractor"). Owner and Contractor, for the consideration hereinafter named, agree as follows:
A. SCOPE OF WORK
Contractor shall furnish all materials and perform all of the work for the construction of Project #_
00-12, 00-24 00-35, 00-36, 00-39 in accordance with the Contract Documents.
B. CONTRACT PRICE
As full compensation for furnishing all materials, equipment, labor, appurtenances and incidentals,
and for doing all the work contemplated and embraced in this Contract, also for all loss or damage
arising out of the nature of the work aforesaid, or from the actions of the elements, or from any
unforeseen difficulties or obstructions which may arise or be encountered in the prosecution of the
work until its acceptance by Owner, and for all risks of every description connected with the
Work, also for all expenses incurred by or in consequence of the suspension or discontinuance of
work, and for well and faithfully completing the Work, and the whole thereof, in the manner and
according to the Contract Documents, Owner shall pay Five -Hundred -Twenty -Six -Thousand -
One -Hundred -Fifty -Six dollars ($526,156), which shall supersede any other amount specified in
the Contract Documents.
C. CONTRACT DOCUMENTS
All rights and obligations of Owner and Contractor are fully set forth and described in the
Contract Documents. All parts of the Contract Documents are intended to be correlated so that
any work called for in one part and not mentioned in the other, or vice versa, is to be executed the
same as if mentioned in all said documents. The Contract Documents are defined in Part I,
Section 1-1.01(A) of these Specifications and are incorporated herein by reference the same as
though set out in full.
D. BEGINNING OF WORK
Following the execution of this Contract and the approval of bonds and insurance policies and
certificates, Owner shall issue a Notice to Proceed with the Work. Commencing work or the
entrance of equipment or materials on the site of the Work by Contractor before receipt of the
Notice to Proceed is at the sole risk and expense of Contractor, and the Contractor shall be fully
liable for any damage or injury sustained by Owner or third persons resulting therefrom.
E. TIME OF COMPLETION
The Work called for herein shall be fully completed within the time limit set forth in the Special
Conditions.
F. CORRECTION OF WORK AFTER ACCEPTANCE AND
FINAL PAYMENT BY TOWN
Contractor shall remedy any defects due to faulty materials and/or workmanship and pay for any
damages to other work and/or existing facilities resulting therefrom which shall appear within a
period of 2 years from the date of recording of the Notice of Completion.
G. LIQUIDATED DAMAGES
The undersigned has reviewed and is thoroughly familiar with the appropriate sections of the
Contract and Part I, Section 8-1.03 of these Specifications pertaining to liquidated damages.

entrance of equipment or materials on the site of the Work by Contractor before receipt of the
Notice to Proceed is at the sole risk and expense of Contractor, and the Contractor shall be fully
liable for any damage or injury sustained by Owner or third persons resulting therefrom.
E. TIME OF COMPLETION
The Work called for herein shall be fully completed within the time limit set forth in the Special
Conditions.
F. CORRECTION OF WORK AFTER ACCEPTANCE AND
FINAL PAYMENT BY TOWN
Contractor shall remedy any defects due to faulty materials and/or workmanship and pay for any
damages to other work and/or existing facilities resulting therefrom which shall appear within a
period of 2 years from the date of recording of the Notice of Completion.
G. LIQUIDATED DAMAGES
The undersigned has reviewed and is thoroughly familiar with the appropriate sections of the
Contract and Part I, Section 8-1.03 of these Specifications pertaining to liquidated damages.

WHEREAS, bids were sought in conformance with State and Town law for the
following storm drainage improvement projects:
Project 00-12 - Hollywood/Yosemite/Wheeler Avenues;
Project 00-24 - Massol/Nicholson/Tait/Hernandez Avenues;
Project 00-35 - Cypress/High Streets;
Project 00-36 - Lora Drive;
Project 00-39 - Bachman Park; and
WHEREAS, MCH General Engineering Contractors, Inc. of San Jose, California
submitted the lowest bid which the Town Council/Redevelopment Agency deems to be
responsive to the Town's Notice Inviting Sealed Bids.
NOW, THEREFORE, BE IT RESOLVED by the Town Council/Redevelopment
Agency of the Town of Los Gatos, County of Santa Clara, State of California, that: 1) MCH
General Engineering Contractors, Inc. of San Jose, California is declared to be the lowest
responsible bidder for Projects 00-12, 00-24, 00-35, 00-36, and 00-39; and 2) the Town
Manager/Executive Director is authorized to execute a construction contract (attached as Exhibit
A) for said projects on behalf of the Town.

Music In The Plaza:
Ray Davis, resident, spoke highly of the Music in the Plaza program and encouraged others to attend.
Anti Graffiti Program:
John Tice, 570 University Ave, #13, has been working with San Jose on the severe graffiti problem on
the Highway 85/Winchester overpass and asked Council to agendize this issue and address the three
overpasses in this location at the same time. The City of San Jose, CalTrans and Union Pacific are all
taking a part in this graffiti program. Council Consensus to put this subject on the agenda as soon as
information is compiled.
PUBLIC HEARINGS
ABATEMENT OF HAZARDOUS VEGETATION (BRUSH)/RESOLUTION 2000-101 (14.28)
Mayor Blanton announced that this was the time and place so noted for public hearing to consider and
confirm report and assessment on abatement of brush within the Town of Los Gatos.
