SUBJECT: ADOPT RESOLUTION DESIGNATING THE ASSISTANT TOWN MANAGER AS AN
ENFORCING OFFICER AS DEFINED BY TOWN CODE SECTION 13.20.015(f)
RECOMMENDATION:
Adopt the attached draft resolution designating the Assistant Town Manager as an Enforcing Officer
as defined by Town Code Section 13.20.015(f).
DISCUSSION:
Chapter 13, Article II establishes a comprehensive framework for regulating storage and
unauthorized discharages of hazardous materials. Enforcement authority is delegated to an Enforcing Officer
as defined in Section 13.20.015(f). Efficient administration of these provisions makes it desirable to designate
an additional Enforcing Officer.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DESIGNATING THE ASSISTANT TOWN MANAGER AS AN ENFORCING OFFICER
AS DEFINED BY TOWN CODE SECTION 13.20.015(f)
WHEREAS, the Town Code section 13.20.015(f) authorizes the Town Council to designate an
enforcing officer to take action on behalf of the Town in response to an unauthorized discharge of a
hazardous material.
WHEREAS, the appointment of an additional Enforcing Officer is desirable to ensure orderly
enforcement and administration of Article II of Chapter 13;
RESOLVED, that the Assistant Town Manager is hereby designated an Enforcing Officer for purposes
of taking action on behalf of the Town in response to an unauthorized discharge of hazardous material as
described in Town Code Chapter 13.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,

Absent: Mayor Carlson and Mr. Ventura.

TOWN MANAGER AS AN ENFORCING OFFICER AS DEFINED BY TOWN SECTION
13.20.015(f), Carried unanimously.

RESOLUTION 1992-40 (02.07)
Motion by Mr. Attaway, seconded by Mr. Blanton, that Council adopt Resolution 1992-40
entitled, RESOLUTION OF THE TOWN OF LOS GATOS DESIGNATING AND
INSTRUCTING CHIEF OF POLICE AS HEARING OFFICER PURSUANT TO SECTION
13.20.890(b). Carried unanimously.
ADJOURNMENT
Vice -Mayor Benjamin stated at 7:03 p.m. that the meeting was adjourned to a study session with
the Library Board followed by the Parking Commission.
