RECOMMENDATION:
Accept the attached AB 939 1995 Annual Report.
BACKGROUND:
The California Integrated Waste Management Act of 1989 (AB 939) requires that each jurisdiction in California divert
from disposal 25% of its waste stream by December 1995 and 50% by January 1, 2000. Each municipality in California
must submit a Plan describing proposed activities or services in order to comply with the diversion mandates. The
Town's plan (referred to as the Source Reduction and Recycling Element - SRRE) was approved by the California
Integrated Waste Management Board (CIWMB) in 1992.
DISCUSSION:
The attached 1995 Annual Report summarizes the progress made by the Town in reducing solid wastes from disposal
from 1991 through 1995. State law requires an annual report submitted each year until the year 2000.
This report indicates that, in 1995, the Town diverted 35% of its waste stream thereby complying with the 1995 diversion
mandate. The report also summarizes the status of planned and new activities.
Diversion rates in the County run the range from 19.78% to 53.29%. Statewide, only about half of all municipalities
have reached the 25% diversion mandate. Diversion rates depend greatly upon diversion practices in place in 1991 and
the communities' composition.
1) 1991 Diversion Practices
As stated earlier, the Annual Report reflects the change in diversion rates between 1991 and 1995.
Municipalities with effective diversion practices in place in 1991 have experienced less dramatic increases in
diversion than communities with minimal diversion efforts. For example, Los Gatos was the only West Valley
city to have variable can rate services in 1991 and households disposed significantly fewer pounds per
households than neighboring cities. Other West Valley cities, which did not have variable can rates were able
to experience greater change in diversion.

2) Community Composition
Communities composed largely of residential units have greater diversion rates (if they also have
comprehensive recycling services). Households are easier to target than businesses because significant portions
of the waste stream are recyclable and similar from household to household. This is not true with businesses
for which recycling programs are more difficult to establish.
CONCLUSION:
Recycling and other diversion efforts have resulted in our compliance with the State mandate.
ENVIRONMENTAL ASSESSMENTS:
Completion of the AB 939 Annual Report is not a project defined under CEQA, and no further action is required.

Introduction
Public Resources Code (PRC) Section 41821(f) mandates that after the approval by the California
Integrated Waste Management Board (CIWMB) of a jurisdiction's integrated waste management
planning document, each California city or county must submit an annual report to the CIWMB
summarizing its progress in reducing solid waste, as required by PRC 41780. Statutes and
regulations require that the following planning documents be addressed in the Annual Report (as
applicable to each jurisdiction):
• the Source Reduction and Recycling Element (SRRE) with the Solid Waste Generation
Study (SWGS);
• the Household Hazardous Waste Element (HHWE);
• the Non -Disposal Facility Element (NDFE); and
• the Countywide Integrated Waste Management Plan (CIWMP) which includes the
SRREs, HHWEs and NDFEs for all jurisdictions within the county and the countywide
Summary Plan and Siting Element.
The County of Santa Clara Integrated Waste Management Program is responsible for meeting
countywide reporting requirements.
This Annual Report contains the requisite data for the Town of Los Gatos, including:
• the disposal reduction calculations for the Town (Section A, Measurement of Disposal
Reduction);
• a summary of the progress made in implementing the programs selected in the SRRE
(Section B, SRRE Program Implementation Assessment); and
• a response to the Areas -of -Concern raised by the CIWMB when it approved the SRRE
(Section F).
This report does not include Sections C (HHWE Program Implementation Assessment), D
(Summary Plan Assessment) and E (Siting Element Assessment). Section C is not required until
August 1997, since the HHWE was approved in April 1996. Sections D and E are prepared and
submitted by the Santa Clara County Integrated Waste Management Program.

Appendix F-1: Areas of Concern
The following responds to April 20, 1995, correspondence from the CIWMB:
SRRE Analysis:
The Town accepts the revisions indicated in the correspondence for the Solid Waste Generation
Study.
Areas of Concern:
The correspondence from the CIWMB identified four issues:
• The Implementation Schedule from the Education and Public Information Component is
not missing from the Integration Component, as was indicated in the correspondence.
• The Implementation Schedule for the Funding Component is located in that component,
not the Integration Component since program staff were not aware at the time of
preparation that a copy of the Implementation Schedule for the Funding Component
needed to be inserted in the Integration Component. Funding for all of the services is
adequate; revenue sources are discussed in Sections 9.4 and 9.5 of the Funding
Component. Michelle Lawrence, CIWMB, advised that this report indicate that program
staff will prepare additional documents, if requested.
• No Master Implementation Schedule was included in the SRRE because program staff
were not aware at the time the SRRE was being prepared that such a schedule was
required. Michelle Lawrence, CIWMB, advised that this report indicate that program staff
will prepare a Master Implementation Schedule for the first five-year revision, if
requested.
• The Town will not be including any wood chips for diversion in its base year disposal
tonnage since no yard waste recycling program had been implemented in 1991, the base
year. The statement in the SRRE that the Town may market wood chips as fuel was
intended to indicate the Town's intent to seek various market development options for the
future.

through November 3, 1996 paid on November 8, 1996, in the amount of $577,195.36. Carried
unanimously.
ACCOUNTS PAYABLE/RATIFICATION/SEPTEMBER 1996 (04.V)
Motion by Mrs. Lubeck, seconded by Mr. Attaway, that Council ratify the accompanying check
registers for accounts payable invoices paid on November 1 and November 8, 1996 in the amount
of $349,415.51. Carried unanimously.
TREASURER'S REPORT (05.V)
Informational report submitted by the Treasurer to the Council as of September 30, 1996 was
received and filed.
MINUTES OF NOVEMBER 4, 1996 (06.V)
Motion by Mrs. Lubeck, seconded by Mr. Attaway, that Council approve the Minutes of
November 4, 1996 as submitted. Carried unanimously.
AMICUS BRIEF/ARCHBISHOP OF SAN FRANCISCO V. CITY OF SAN MATEO (07.01)
Motion by Mrs. Lubeck, seconded by Mr. Attaway, that Council authorize Town Attorney to
include the Town of Los Gatos as an amicus curiae in the case of Roman Catholic Archbishop
of San Francisco v. The City of San Mateo. First Appellate District, Division Four, at no cost
to the Town. Carried unanimously.
AMICUS BRIEF/METROPOLITAN WATER DISTRICT V. FRANCIS DOMENIGONI (08.01)
Motion by Mrs. Lubeck, seconded by Mr. Attaway, that Council authorize Town Attorney to
include the Town of Los Gatos as an amicus curiae in the case of Metropolitan Water District
of Southern California v. Francis N. Domenigoni, et al. Fourth District Court of Appeal Division
Two, Case E017416, at no cost to the Town. Carried unanimously.
SOLID WASTE MANAGEMENT/AB 939/ANNUAL REPORT FOR 1995 (09.08)
Motion by Mrs. Lubeck, seconded by Mr. Attaway, that Council accept the attached AB 939
Annual Report. Carried unanimously.
