ADOPT RESOLUTION REGARDING USE OF NEIGHBORHOOD CENTER BY SANTA CLARA COUNTY TRANSPORTATION AGENCY AND RESCIND RESOLUTION 1991-248 RECOMMENDATION: 1. Adopt Resolution regarding the Santa Clara County Transportation Agency's use of the Los Gatos Downtown Neighborhood Center. 2. Rescind Resolution 1991-248. BACKGROUND: The Council has established a policy to provide services at cost recovering rates. Consequently, a maintenance fee is charged to all Neighborhood Center tenants at $1.17 per square foot per month in accordance with Resolution 1991-94. DISCUSSION: Last November, Council adopted a resolution stating that maintenance fees for use of the Neighborhood Center would be charged to the County effective July 1, 1992. It was anticipated that the County would submit a Community Grant request to cover the agency's FY 1992/93 costs. The County staff, however, did not submit a grant request anticipating that the program would be eliminated due to lack of funds. Fran Timoteo, Customer Services Superintendent, has requested that Council delay charging maintenance fees another year to July 1, 1993. According to Ms. Timoteo, she does not have funds to pay the fee this year. The Santa Clara County Transportation Agency's senior transit advisor uses approximately 36 square feet of office space in the reception area of the Neighborhood Center. This has a value of $505 per year. It appears that there was a verbal agreement in 1979 through which the Town provided space and a telephone for the senior transit advisor. The Town's Community Grant Program provides a process through which the Council allocates limited resources, including funding for office costs. If Council agrees to begin charging the County for maintenance fees July 1, 1993, then the County will have an opportunity to apply for grant funds from the Town or other sources or relocate. FISCAL IMPACT: The revenues from the Agency for use of the space are not included in the FY 1992-93 operating budget. Therefore, adoption of the resolution will not negatively impact the budget. VERBAL COMMUNICATIONS WATER SEEPAGE ON PROPERTY Susan Fish, 16070 Greenridge Terrace, updated Council on events relating to water seepage on her property, and appealed to Council for help in solving this problem. Council concluded that staff could work on this issue and referred the item to the Town Manager for further review and assignment. HEARING COMMERCIAL & RESIDENTIAL DESIGN GUIDELINES (25.47) Mayor Carlson stated that this was the time and place duly noted for public hearing to consider adoption of resolution approving commercial and residential design guidelines as recommended by Planning Commission. No one from the audience addressed this issue. Motion by Mr. Ventura, seconded by Mrs. Benjamin, that Council close the public hearing. Carried by a vote of 4 ayes. Mr. Attaway absent. Motion by Mrs. Benjamin, seconded by Mr. Blanton, that Council approve in concept the guidelines as submitted this evening, and redirect the subcommittee and staff to work out the inconsistencies.
