COUNTY TRANSPORTATION AGENCY AND RESCIND RESOLUTION 1991-248
RECOMMENDATION:
1. Adopt Resolution regarding the Santa Clara County Transportation Agency's use of the Los Gatos
Downtown Neighborhood Center.
2. Rescind Resolution 1991-248.
BACKGROUND:
The Council has established a policy to provide services at cost recovering rates. Consequently, a
maintenance fee is charged to all Neighborhood Center tenants at $1.17 per square foot per month in
accordance with Resolution 1991-94.
DISCUSSION:
Last November, Council adopted a resolution stating that maintenance fees for use of the Neighborhood
Center would be charged to the County effective July 1, 1992. It was anticipated that the County would
submit a Community Grant request to cover the agency's FY 1992/93 costs. The County staff, however,
did not submit a grant request anticipating that the program would be eliminated due to lack of funds.
Fran Timoteo, Customer Services Superintendent, has requested that Council delay charging maintenance
fees another year to July 1, 1993. According to Ms. Timoteo, she does not have funds to pay the fee this
year.
The Santa Clara County Transportation Agency's senior transit advisor uses approximately 36 square feet
of office space in the reception area of the Neighborhood Center. This has a value of $505 per year. It
appears that there was a verbal agreement in 1979 through which the Town provided space and a telephone
for the senior transit advisor. The County has not been charged for these services.

CONCLUSION:
In fairness to users of the Neighborhood Center, it is necessary to apply policies and procedures uniformly.
The Town's Community Grant Program provides a process through which the Council allocates limited
resources, including funding for office costs.
If Council agrees to begin charging the County for maintenance fees July 1, 1993, then the County will have
an opportunity to apply for grant funds from the Town or other sources or relocate.
FISCAL IMPACT:
The revenues from the Agency for use of the space are not included in the FY 1992-93 operating budget.
Therefore, adoption of the resolution will not negatively impact the budget.

WHEREAS, Council has established a policy that Town
services are provided at cost recovery rates;
WHEREAS, the maintenance fee charged to Neighborhood

WHEREAS, the value of the space provided to the Santa
Clara County Transportation Agency (SCCTA) is $505 per year; and
WHEREAS, the services provided by the senior transit
advisor are of immediate and continued public benefit; and
WHEREAS, imposing the fee immediately could result in the
interruption of the services; and
WHEREAS, the SCCTA states that it has not included funds
in its budget to pay the maintenance fees;
WHEREAS, Council adopted Resolution 1991-248 stating that
SCCTA will be invoiced July 1, 1992.

NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DOES HEREBY RESOLVE AS FOLLOWS: (1) invoicing the SCCTA for space
will be postponed to July 1, 1993, and (2) Resolution 1991-248 is
rescinded.
PASSED AND ADOPTED at a regular meeting of the Town
Council of the Town of Los Gatos, California, held on the 17th day
of August, 1992, by the following vote:

A decision has been made to continue the Santa Clara County Transportation
Agency's Senior Advisor Program. It is therefore requested that the County be
exempt from any maintenance fee at the Los Gatos Neighborhood Center for the
current fiscal year. Should this program continue to be maintained in fiscal
year 93/94, we will apply for community grant funds to cover the maintenance
costs for the Senior Transit Advisor's office space.

TOWN FIRE CODE 1991/ORDINANCE 1911 (24.13)
Motion by Mr. Ventura, seconded by Mrs. Benjamin, that Council adopt Ordinance 1911 entitled,
ORDINANCE OF THE TOWN OF LOS GATOS AMENDING, RESCINDING AND ADDING
SECTIONS TO CHAPTER 9 OF THE TOWN OF LOS GATOS TOWN CODE RELATING TO
FIRE PREVENTION AND PROTECTION REGULATIONS AND ADOPTING THE 1991
UNIFORM FIRE CODE WITH 1991 STATE OF CALIFORNIA AMENDMENTS, which was
introduced at the Town Council meeting of July 10, 1992. Carried by a vote of 4 ayes. Mr.
Attaway absent.

WATER SEEPAGE ON PROPERTY
Susan Fish, 16070 Greenridge Terrace, updated Council on events relating to water seepage on
her property, and appealed to Council for help in solving this problem. Council concluded that
staff could work on this issue and referred the item to the Town Manager for further review and
assignment.
HEARING
COMMERCIAL & RESIDENTIAL DESIGN GUIDELINES (25.47)
Mayor Carlson stated that this was the time and place duly noted for public hearing to consider
adoption of resolution approving commercial and residential design guidelines as recommended
by Planning Commission.
No one from the audience addressed this issue.
Motion by Mr. Ventura, seconded by Mrs. Benjamin, that Council close the public hearing.
Carried by a vote of 4 ayes. Mr. Attaway absent.
Motion by Mrs. Benjamin, seconded by Mr. Blanton, that Council approve in concept the
guidelines as submitted this evening, and redirect the subcommittee and staff to work out the
inconsistencies. The conceptual document may be used by the public with the word draft marked
on it. Carried by a vote of 4 ayes. Mr. Attaway absent.
