A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
RATIFYING THE EMERGENCY PROCUREMENT OF SERVICES FOR FLOOD
RESTORATION AT CIVIC CENTER
WHEREAS,the Town of Los Gatos experienced substantial rainfall on the morning of
December 25, 2025; and
WHEREAS, stormwater associated with that rainfall entered the Civic Center both
upstairs and downstairs,flooding lobby areas at the Clerk's office and Community Development
Department, and various office locations; and
WHEREAS,the Los Gatos Town Code Sections 2.59.130(b) and 2.50.145,Town
Purchasing Policy 4-06,Town Emergency Procurement Policy 4-10, and Public Contract Code
Section 22050 provide the Town Manager authority to authorize repairs that are necessary to
preserve property in the event of an emergency; and
WHEREAS,flooding is known to contribute to the growth of mold if mitigation measures
are not implemented immediately, leading to potential health and safety impacts for staff and
the public; and
WHEREAS, in accordance with CEQA Guidelines Section 15301, repairs to an existing
facility are exempt from the California Environmental Quality Act (CEQA);
BE IT RESOLVED that the Town Council of the Town of Los Gatos does hereby declare,
determine, and order that:
1. The Town Council ratifies the emergency procurement of services from
ServiceMaster to support remediation and restoration of the Civic Center and confirms
that the Town Manager was authorized to execute the necessary agreement for this
work.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 20th day of January, 2026, by the following vote:
