L C� COUNCIL AGENDA REPORT DATE: March 27, 2001 TO: MAYOR AND TOWN COUNCIL FROM: TOWN MANAGER SUBJECT: ADOPT RESOLUTION ALLOCATING COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS FOR FISCAL YEAR 2001-2002 RECOMMENDATION: Adopt resolution allocating Community Development Block Grant Funds for fiscal year 2001-2002. BACKGROUND: The Town administers two grant programs, the Community Development Block Grant (CDBG) program, and the Community Grant program. CDBG funds are provided by the federal Department of Housing and Urban Development (HUD), through the County of Santa Clara, for individual jurisdictions to allocate. Community Grant funds come from the Town's General Fund. Each fiscal year, the Town solicits and receives applications from nonprofit agencies and Town departments for both grant programs. This report covers the CDBG allocations for FY 2001-2002; the Council will consider Community Grant allocations for FY 2001-2002 as part of next year's Operating Budget. Each year, the Community Services Commission is charged with reviewing the CDBG applications and making funding recommendations to Council. The Commission's Evaluation Committee first reviews the applications and makes allocation recommendations to the entire Commission at the Commission's regularly scheduled March meeting. Applicants are invited to attend this meeting and make a presentation. This meeting of the Community Services Commission fulfills the public hearing requirement; to receive funds, Council must adopt a resolution specifying the allocation of funds. A draft resolution is included as Attachment 2. DISCUSSION: The Commission's recommendations and a summary table is included as Attachment 1. This is a $2,167 increase from 00/01 level of $34,500. This program received total funding of $16,750 in the current fiscal year ($6,650 CDBG and $10,100 Community Grant). The increase in the recommended CDBG funding for the Health Place in 2001/02 will likely result in an equal decrease in Community Grant funding. New agencies will be referred to the Community Grant process. A current summary of nonprofit human service and arts requests is attached as Attachment 3. Category II: Affordable Housing and Handicap Accessibility Retrofits $109,207 is available for Category II projects, projects which construct affordable housing or other activities that benefit disabled persons and low income residents. The Commission recommends that this entire amount be allocated for future affordable housing projects. Funds are thereby available for affordable housing projects as they are proposed, often in concert with other Town or Redevelopment Agency funds. The Town's General Plan 2000 calls for the Affordable Housing Fund to assist with the funding of 15 new units of affordable housing by 2005. Although ADA retofitting is an eligible activity, no requests for such projects were received this year. CDBG dollars allocated to ADA retrofits in past years are expected to be completed next fiscal year. Administration $15,000 is allocated to "General Administration," to reimburse the Town for its staff time spent managing the CDBG program. Town staff was responsible for marketing the program, processing applications, producing loan documents, and servicing loans. The Town was reimbursed for this staff time under the "Housing Rehab Admin." allocation in Category II. This year, the County has agreed to assume administration of the program, on behalf of any municipality in the Urban County, for an annual fee of $20,000. Cupertino and Saratoga will be availing themselves of this opportunity; the Commission recommends that Los Gatos do the same, by allocating $20,000 to "Urban County Rehab Services." The Town would retain responsibility for marketing the program to Town residents. This transfer would provide the following benefits to the Town: 1. A more cost effective program. As the County already manages numerous projects each year, it can achieve economies of scale not possible in the Town's smaller program. 2. Eliminate duplication of effort between Town and County staff. All administration activities would be centralized at the County. 3. Free up CDBG funds. Funds currently allocated for rehabilitation administration could be allocated for affordable housing, ADA, or other capital improvement projects. It is important to note that the Community Services Department's Administrative Analyst position was reduced from 1.0 to 0.5 FTE; the reduction was made, in part, in anticipation of this action. Transfer of the Housing Conservation Program administration to the County will also entail transferring $200,000 of the Town's revolving loan fund to the County, to be used solely for funding Los Gatos housing rehabilitation projects. This transfer will be addressed in the 2001-02 Proposed Operating Budget. ENVIRONMENTAL ASSESSMENT: Allocation of funds is not a project defined under CEQA, and no further action is required. BACKGROUND CDBG funds are provided by the United States Department of Housing and Urban Development (HUD), through the County of Santa Clara, for individual jurisdictions to allocate. Summaries of all grant applications received for FY 2001/2002 are attached in Exhibit B. The Town will receive $180,874 in CDBG funds for FY 2001/2002. No more than $36,667 may be allocated to Category I, "Public Services," projects. $35,000 is automatically allocated to General Administration and Urban County Rehab Services. The remainder, $109,207, is available for Category II, "Housing and Other," projects. The Committee's recommendations are summarized in Exhibit A, in the column titled "2001/02 Eval. Comm. Funding Recmnd." DISCUSSION Category I - Public Services: The Town received six applications from nonprofit agencies requesting funding under Category I, for a total of $76,246. Due to the large difference between funds requested and funds received, the Committee recommends that both Emergency Housing Consortium and Next Door Solutions to Domestic Violence not receive CDBG funds, but be considered under the Town Community Grant process. It further recommends that Catholic Charities, Live Oak Adult Day Services, and Second Harvest Food Bank be funded at FY 2000/2001 levels. The remaining applicant, San Jose State University Foundation (SJSU) has historically received both CDBG and Community Grant funds. The Committee recommends that SJSU receive the balance of available Category I funds, and that the remainder of its request be considered for Community Grant funds. Category 11- Housing and Other: Historically, funds have been allocated to Housing Rehab Admin., which reimburses the Town for staff time spent administering the Housing Rehabilitation Program (HCP). We anticipate that this program will be transferred to the County beginning FY 2001/2002. The greatly reduced amount of time that Town staff will spend working on the HCP can be paid for through previous fiscal years' allocations; no funds need be allocated for FY 2001/2002. Therefore, the entire Category II amount, $109,978, is available for housing projects. No applications were received requesting CDBG funding under Category II. Therefore, the Committee recommends that the entire amount be allocated for future affordable housing projects. The majority of clients are seniors, but the program accepts disabled clients of any age. N:1csd122I 8\exhibits.002.wpd Attachment 2 RESOLUTION NO. 2001- RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ALLOCATING COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO THE TOWN OF LOS GATOS FOR FISCAL YEAR 2001-2002 WHEREAS, the Town of Los Gatos receives Community Development Block Grant funds from the U.S. Department of Housing and Urban Development through the County of Santa Clara as a non -entitlement city pursuant to the provisions of Title I of the Housing and Community Development Acts of 1974 and 1977, as amended; and WHEREAS, the Community Services Commission reviewed all applications for funding from community agencies and whereas, the Community Services Commission held a public hearing on March 15, 2001, and received public testimony; and WHEREAS, the Town Council considered the Community Services Commission's funding recommendations at a regularly scheduled council meeting on April 4, 2001; and WHEREAS, the Town has been notified that the CDBG allocation for Fiscal Year 2001-2002 is $180,874. NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY RESOLVE AS FOLLOWS: A. The Town Council finds that CDBG funds are available for Fiscal Year 200 ] - 2002; and B. ORDINANCES MUST BE READY FOR IMMEDIATE PUBLICATION TC:D7:RESO-ORD i RESOLUTION 2001- 35 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ALLOCATING COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO THE TOWN OF LOS GATOS FOR FISCAL YEAR 2001-2002 WHEREAS, the Town of Los Gatos receives Community Development Block Grant funds from the U.S. Department of Housing and Urban Development through the County of Santa Clara as a non -entitlement city pursuant to the provisions of Title I of the Housing and Community Development Acts of 1974 and 1977, as amended; and WHEREAS, the Community Services Commission reviewed all applications for funding from community agencies and whereas, the Community Services Commission held a public hearing on March 15, 2001, and received public testimony; and WHEREAS, the Town Council considered the Community Services Commission's funding recommendations at a regularly scheduled council meeting on April 4, 2001; and WHEREAS, the Town has been notified that the CDBG allocation for Fiscal Year 2001-2002 is $180,874. NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY RESOLVE AS FOLLOWS: A. The Town Council finds that CDBG funds are available for Fiscal Year 2001- 2002; and B. The Town Council adopts the recommendation of the Community Services Commission; and 1 C. The Town Council does hereby authorize the expenditure of $180,874 to those CDBG programs set out in Exhibit A, attached and incorporated herein. Marc Jensen, 120 Oak Rim Way #1, asked for bicycle lanes on Los Gatos Boulevard for students to use on the way to school, and also to use those lanes as links to the Creek Trail which goes down to the High School. Council Consensus to consider at the next meeting a request to VTA to rescind the proposed grant application, and request VTA to carryforward the current grant funds to next fiscal year if staff can identify a qualifying project that could be accomplished next year. COMMUNITY HOUSING DEVELOPERS/LOCAL DEVELOPMENT CORPORATION LOS GATOS CREEK VILLAGE/MILES AVENUE 71 (19.15) Mayor/Chairman Pirzynski announced that this was the time and place so noted for public hearing to consider: a. Accepting report of Seifel Consulting Incorporated "due diligence analysis of funding request for Los Gatos Creek Village" b. Making a finding that Los Gatos Creek Village provides a significant community benefit by meeting current needs for affordable housing, and exempt Los Gatos Creek Village from the traffic impact mitigation fee c. Providing conceptual approval of a loan of $233,800 to Community Developers - Local Development Corporation from Redevelopment Agency housing set -aside funds Mayor/Chairman Pirzynski noted that this item has been pulled from the agenda. Staff will be having further discussions on this issue with Community Housing Developers - Local Development Corporation. Motion by Mr. Blanton, seconded by Mr. Attaway, to continue this item to April 16, 2001. Carried unanimously. COMMUNITY DEVELOPMENT BLOCK GRANTS FY 2001-02/RESOLUTION 2001-35 (20.39) Regina Falkner, Community Services Director, spoke of the Public Hearing which was held by the Community Services Commission after having evaluated the applications which had been received. The recommendation for funding of the various agencies has been forwarded to the Town Council for consideration this evening. The CDBG funds are approximately $180,000 of federal grants that come to us through the County of Santa Clara, and federal law regulates how the funds can be allocated. Allocations for next year are $37,000 for human service activities, $109,000 for housing and related activities, and $35,000 for administration of the CDBG grant and the Town's Housing Conservation Program. She noted that Alistair Dallas, Chair of the Community Development Commission, was present to answer any questions on the recommendations. Council thanked the Community Services Director and the Chair of the Community Services Commission for a job well done. Special note was taken as to our award of funds to the Emergency Housing Consortium to help deal with the problems of the homeless and with hope that some of those aids help the homeless from Los Gatos. Motion by Mr. Glickman, seconded by Mr. Blanton, that Council adopt Resolution 2001-35 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ALLOCATING COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO THE TOWN OF LOS GATOS FOR FISCAL YEAR 2001-2002.
