RECOMMENDATION:
1. Open and hold the public hearing;
2. Close the public hearing;
3. Find that the ordinance amendment is consistent with the General Plan;
4. Move to waive the reading;
5. Request that the Clerk read the title;
6. Move to introduce the Draft Ordinance;
7. Direct Clerk to publish a summary at least five (5) days prior to adoption;
8. Adopt the resolution establishing standards for review of applications for 24 hour operation;
9. Consider whether to reduce fees for existing businesses.
DISCUSSION:
On October 4, 1993, the Town Council considered this matter and received public testimony. The Council
continued the hearing to see if additional complaints are filed regarding Kinko's Copy Center. Since the last
hearing on this matter, the Town has received three letters from residents on Ashler Avenue complaining
about traffic, noise and glare from Kinko's Copy Center. Copies of these letters are attached to this report.

Dear Council Members:
As a resident of Los Gatos, I would like to call your attention to a problem which can no
longer be ignored. The problem to which I am referring is the constant parking congestion
on Ashler Avenue where I reside.
This once quiet, safe street has become in recent months a literal parking lot The parking
problems, and congestion in general, stem from two sources: Kinko's Copies (a new
business which operates 24 hours a day, 7 days a week), and the Chapel of the Hills
Funeral Home. Both businesses are located on the comers of Ashler Avenue and N. Santa
Cruz Avenue. Parking on this street has become so difficult (especially during Funeral
Services), that residents must park up to one full block away from their own homes!!
Although I have great compassion for any persons who are attending services at the
Funeral Home, I also have the right as a resident of this street to park my vehicle in front of
my own hone I have often been forced to park my car up to a block away and walk to my
home during Funeral Services. Persons attending these services have, on occasion,
completely blocked my driveway preventing me from being able to leave my home!

nuisance. Recently, a Victorian Tea Room which is to open downtown had it's hours of
operation and number of patrons limited by the town of Los Gatos because of the town's
concern for the traffic and parking problems it might create. Yet the town of Los Gatos is
allowing a 24 hour business to operate in what is greatly a residential neighborhood! I ask
the council, where is the logic in this? This is not a Hospital or Emergency Care facility,
nor a Grocery or Convenience store, which would at least offer some explanation for being
open 24 hours a day, 7 days a week. This is a print and copy store, and should only be
allowed to operate during "normal" business hours.
In addition to contributing to the traffic congestion, Ifinko's has been a public nuisance
because it extremely bright lights are, at the very least, annoying to residents in the
evening hours. I would invite any members of the Town Council to attempt to get a restful
night's sleep in a home adjacent to Kinko's blaring lights and neon signs!

This situation cannot be allowed to continue, and therefore I would like to propose the
following solutions which would return the quality of life on Ashler Avenue to it's prior
state.
1. Kinko's Copies should be allowed to operate only during "normal" business hours
(i.e.: Mon - Fri, 8 AM to 6 PM, Sat -Sun, 10 AM to 5 PM)
2. Parking on Ashler Avenue should be Permit Parking only - this is the only solution
to the parking congestion caused by people attending fimerals, or doing business
at Kinko's. Both of these businesses have inAdequate parking, and this oversight

Copies of this letter will also be made available to the following: Mayor JoAnne
Benjamin, Town Manager David Knapp, and the Los Gatos Weekly Times.
In addition, a petition is being circulated among the Ashler Avenue residents in cyder to
show their support for the proposed solutions. This petition will be presented at the Town
Council meeting on October 18.
In closing I would like to thank you for your attention to this matter. Although the
residents of Ashler Avenue are relatively few in number.._we are a voice which will be
heard

I have 1 ived in my home on Ashler Avenue for over 20 years. I have
seen many changes in my end of town during this time, most of them
I must say for the better. I realized years ago, that along with the
growth in the valley, I was bound to see an increase in activity level
in our sleepy part of town as well I have seen the addition of the
DMV, various businesses come and go in the Olde Northside Market
location, and the addition of Sarah Center During all of these
business additions, the town went out of its way to insure that
increases in.traffic, operating hours and types of establishments
were compatible with the area. Over the last year, this concern by
the Town has definitely disappeared.
The single, most disruptive change in our neighborhood in the 20
years I have lived here has been the addition of Kinko's on the corner
of Ashler and Santa Cruz Avenues. Since I live next door to this
property, I personally visited the planning department and went
through the files for this building, and reviewed modifications
and changes as the project moved forward. Nowhere in any of those
files was there an indication of the type of business which was
slated to move into this location. The thing that is still amazing to
me is that the Town approved the operation of a 24-hour, 7 days a
week business, in a residential area which has been here long before
any of us were born, with absolutely no notice to the residents that
this permit was being considered. The first, and only notice we had
that a 24-hour business was moving in, is when the sign went up on
the outside of the building.
Two major issues have not been addressed, by either Kinko's or the
Town. One is the horrendous traffic conjestion which has resulted
from this business. Not only is this now a busy corner late into the

If this request is not acted on, we do nave one more avenue we can
take. 1 have lived here long enough to remember a time in the past
when the town was placating developers and business interests
over the interests of its citizens. The entire council and town
leadership was thrown out around the cry "ENOUGH IS ENOUGH" Based
on the recent lack of concern shown for our North Santa Cruz Avenue
neighborhood and the residents in the 85 corridor, we see a trend
developing which is unsatisfactory. It may be time for history to
repeat itself once more.

I am writing to inform you that the existence of Kinkos Copiers on the corner
of North Santa Cruz and Ashler Avenue has not been a welcome addition to the
neighborhood. This type of business is not suitable or desirable in such
close proximity to private residences. This business has interferred, dis-
rupted, and destroyed all peace, pleasure, and tranquility that this neigh-
borhood once had.
The presence of Klnkos in this location has created numerous, disturbing
adverse effects, becoming an incessant problem and public nuisance! Public
Nuisance is defined as "Anything which is injurious to health, or is indecent
or offensive to the senses, or an obstruction to the free use of property so
as to interfere with the comfortable enjoyment of life or property..." Re. to
Section 3479 California Civil Code.
The problems are identified mainly as:
1. Extreme increase in traffic congestion
2. Saftey hazards generated by motorists and street logistics
3. Inadequate space for commercial parking, encroaching upon residential
space
4. Glaring, bright lighting during evening hours --"silent noise"
Many neighbors have been affected and aggravated by these problems, especially
feeling the repercussions of the invasion of traffic.
Residents closest to Kinkos feel the brunt of these nuisances. These problems
have become a constant, relentless, irritation without any relief since Kinkos
has been allowed to operate seven days a week, twenty-four hours a day!!!
I, in particular, feel that the intrusion of the offensive lighting as well as
the traffic problem has most definitely interferred with the free use and com-
fortable enjoyment of my property! Also, because of these problems, I am
greatly concerned about the negative effect this Kinkos establishment has upon
the value of my property in a future resale as it is now a factor which lessens
the desirability of ownership in the eyes and mind of potential buyers.
Since Kinkos opened for business last Spring, I have made repeated phone calls
to town officials, to Dan Rogers, Kinkos; Manager, andEto Torn Parri§h,`District
Manager in order to discuss and alleviate these problems, to no avail.
It has long been the intent of the Town to preserve the integrity of its neigh-
borhoods. However, it seems that in this instance of granting a permit to
Kinkos, all caution has been ignored and elements that used to be scrutinized
and rejected have been allowed in the construction and operation of this
business. It seems as if the permit was granted for more exposure, more con-
gestion, more hazards, and more headaches!
These problems could have been avoided. However, none of the residents
received notification beforehand that such a business, operating twenty-four
hours a day, seven days a week, was being considered for this location. Other
Kinkos in the Santa Clara County area are not located close to private
residences: Whether there are few voices here or many as in the neighborhood
group concerned about the over -development of the Highway 85 area, our input
needs to be recognized and considered.
It is my proposal that Kinkos relocate elsewhere! Or, at least, it's operation
be restricted to normal business hours.
I am requesting that the Town reevaluate the suitability of this type of
business remaining in such close proximity to private residences and that this
matter be placed on the Town Council agenda for discussion.

ADOPTING STANDARDS FOR REVIEW OF
24 HOUR BUSINESS OPERATIONS
WHEREAS, The Town has experienced an increase in 24 hour business operations
over the last few years;
WHEREAS, Twenty-four hour businesses can have an adverse impact on adjoining
neighborhoods concerning noise, glare and traffic;
WHEREAS, It is the Town's responsibility to protect the health, safety and welfare
of its residents;
RESOLVED: The Town Council adopts the following standards to be used for review
of any Conditional Use Permit for a 24 hour business.
1. Noise emitted from 24 hour businesses adjacent to residential zones shall not
exceed those noise standards established for the residential zone.
2. Window coverings shall be employed for windows facing residential properties
to minimize light and glare during late night and early morning hours.
3. Deliveries shall not be allowed between the hours of 9 PM and 7AM.
4. No restaurants shall be permitted to operate 24 hours adjacent to residential
zones.
5. Business operations shall be oriented toward the commercial frontage.

Mayor Benjamin stated that this was the time and place duly noted for public hearing to consider
introducing ordinance amending the Town Code to require any business that remains open for
24 hours a day or that is open between the hours of 2 a.m. and 6 a.m. to have an approved
conditional use permit. Zoning Ordinance Amendment A-93-10. Applicant: Town of Los Gatos.
The following people from the audience spoke to this issue:
June Miller, 19 Ashler, is in favor of the ordinance and would like consideration of the parking
and lighting problem. She submitted a petition from the neighbors.
MaryBeth Rotermund, 15 Ashler, does not feel the ordinance is necessary but would like the
parking and lighting problems addressed.
Paulette Coffman, 39 Ashler, was concerned about parking, traffic, noise and lights. She
requested a preferential parking district in the area.
Ron Ramsey, 26 Ashler, notes problems with parking.
Kurt Walton, 16719 Farley Rd., noted that he was experiencing the same problems due to a
business on Los Gatos Blvd.
Dan Rogers, Manager of Kinko's, 575 N. Santa Cruz Ave., expressed his wish to respond to his
neighbors concerns, and was seeking methods of mitigation at this time.
No one else from the audience addressed this issue.
Motion by Mr. Attaway, seconded by Mr. Blanton, that Council close this public hearing.
Carried unanimously.
Motion by Mr. Attaway, seconded by Mr. O'Laughlin, that Council find that the ordinance

appeal of a Planning Commission decision to deny a request for permission to exceed the
allowable floor area ratio for an existing two-story residence and to add additional floor area
to the second floor on property in the R-1:8000 zone, Architecture and Site Application S-93-
19. Property owner: Keith and Jan Goodwin. Applicant: Jeanine of the Residential Designer.
The following people from the audience spoke to this issue:
Keith Goodwin, 615 San Benito, asked Council's consideration regarding the addition to his
home.
Kathy Fisher, resident of Francher Crt, spoke for herself and other neighbors who are fully in
favor of this proposal.
Jeannine, of the Residential Designer, spoke regarding her clients plans.
No one else from the audience addressed this issue.
Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council close the public hearing.
Carried unanimously.
Motion by Mrs. Lubeck, seconded by Mrs. Benjamin, that Council grant the appeal finding that
the Planning commission erred by not giving sufficient weight to the decisions of the Historic
Commission, and finding that the design theme, sense of scale, the materials and details are
consistent with our residential standards; that the lot coverage, set backs and the FAR are
compatible with the surrounding lots as examples 52 Ashler, 96 Fancher, and 629 & 633 San
Benito. Carried by a vote of 3 ayes. Mr. Attaway and Mr. O'Laughlin voted no.
LAND USE PERMITS/ZONING AMENDMENT/A-93-4/HEARING (35.46)
Mayor -Benjamin stated that this was the time and place duly noted for public hearing to consider
adoption of ordinance amending the Town Code providing authorization to the Development

from this business. Not only is this now a busy corner late into the
night when everything else has long closed down, but the street
conjestion is exacerbated by the fact that Kinko's instructs its
employees to park on the neighborhood streets and not in their own
parking lot. The safety hazard which existed with cars parked on
both sides of a very narrow street at such a busy corner was some-
what relieved by the "red zone" recently painted on the curb as you
enter Ashler Ave. However, this also had the effect of moving the
street parking further up the block, so that even more neighbors are
affected than ever before. We have seen no further attempt at
addressing this issue.
The second issue, affecting a lesser number of us is the bright
lighting that is glaring out at the back of the store, facing the
residential area. Several of us have requested that Kinko's place
blinds on the back windows to cut down on the light shining into our
bedroom windows all night long. This seems like a pretty reasonable
request to us. A few blinds were added already, however, we were
told that they were being used only to cut down on the glare to the
computer screens in the late afternoon. The one blind installed on
the back of the store for this purpose, is opened again at night. This
is interpreted as a blatent lack of concern for the neighborhood they
have invaded. Requests to the town have fallen on deaf ears, as
Kinko's is apparently not violating any "ordinances". This lighting is
a public nuisance to the residents directly surrounding the store.
Bright lights all night on the Santa Cruz Avenue side of the store
would not bother any of us, and would allow viewing into the
building late into the night for security reasons. The fact that this
nuisance is still an issue, when it could be so easily resolved is just
ridiculous.
I applaud the citizens who have banned together over the 85 develop-
ment issues. They had better be heard before the fact, because once
the businesses get in, the Town is proving it will not lift a finger to
resolve problems. I don't hold any high expectation that a few
piddling letters will light a fire under anyone, although we hope you
will act on our request to either reconsider the use permit for
Kinko's in this location, or at the least, insist that they resolve the
invasion of harsh lighting into our windows all night long, and
instruct their employees to park in their own parking lot.
If this request is not acted on, we do have one more avenue we can
take. I have lived here long enough to remember a time in the past
when the town was placating developers and business interests
over the interests of its citizens. The entire council and town
leadership was thrown out around the cry "ENOUGH IS ENOUGH" Based
on the recent lack of concern shown for our North Santa Cruz Avenue
neighborhood and the residents in the 85 corridor, we see a trend
developing which is unsatisfactory. It may be time for history to
repeat itself once more.
