COUNCIL AGENDA REPORT DATE: November 8, 2000 TO: MAYOR AND TOWN COUNCIL FROM: TOWN MANAGER SUBJECT: CONSIDER AMENDING THE TOWN ZONING ORDINANCE TO RE -ADOPT THE EXISTING ZONING MAP OF THE TOWN. ZONING CODE AMENDMENT A-00-02. APPLICANT: TOWN OF LOS GATOS RECOMMENDATION: 1. Hold the public hearing and receive public testimony. 2. Close the public hearing. 3. Introduce the ordinance: a. Direct the Clerk to read the title b. Waive the reading c. Introduce the ordinance BACKGROUND: On October 25, 2000, the Planning Commission voted unanimously to forward the revised zoning map (Attachment 4) to the Town Council with a recommendation to re -adopt it. The report to the Commission for the agenda of October 25, 2000 includes additional background information (see Attachment 1). DISCUSSION: Changes to the zoning map include corrections to zoning designations that were not accurate. Many of these errors occurred when the zoning map went from being hand drawn to computer generated. Changes to zoning were also made for sites that have had a zone change and/or planned development approved since the map was last adopted. Boundary changes were made to incorporate parcels of land that have been annexed into the Town. The format of the map has been modified to make a better presentation and to make it easier to read and use. Exhibit B of Attachment 1 summarizes all of the changes that have been made to the map. There are a number of groups of addresses that correspond to a single site but individual addresses are listed separately to correspond to assessor's parcel numbers. Desk Item 2 (Attachment 3) notes that a correction will be made to properties currently zoned RM:5-20. These sites were changed to RM: 12-20 and the legend designation was changed so the zoning is consistent with the designation on the General Plan Land Use Map. This change has already been made on the maps distributed to the Town Council (Attachment 4). BACKGROUND: The Town zoning map was comprehensively adopted in 1998. Since that time changes have been made to the map when ordinances for zone changes or resolutions for annexations were adopted. As t map is updated to reflect zone changes and annexations, the ordinance or resolution number and date are listed on the map. Periodically the map needs to be re -adopted so that all of the re -zonings and boundary changes are formally incorporated into the map and the listing of changes can be removed. Ordinances that are approved following adoption of the zoning map will be listed on the new map. B. REMARKS: A number of changes were made to correct zoning designations that were not accurate. Re -adopting the zoning map is an administrative action and does not change the zoning of any parcel. Any proposal to change the zoning of a specific property would require a formal application and public hearing before the Planning Commission prior to consideration by the Town Council. C. RECOMMENDATION: Staff recommends that the Planning Commission forward the revised draft ordinance and zoning map to the Town Council with a recommendation for adoption, with any desired changes to the map. SECTION II This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. There are five properties on the zoning map that have the current designation of RM:5-20 (brown color). The zoning on these properties are intended to be changed to RM:12-20 as will the zoning designation in the legend. This change will make the zoning consistent with the land use designation on the General Plan Land Use Map.
