Adopt an Ordinance of the Town Council of the Town of Los Gatos Repealing Chapter 6, “Building Regulations,” and Chapter 9, “Fire Prevention and Protection,” of the Town of Los Gatos Municipal Code, and Replacing Them with a New Chapter 6, “Building Codes and Regulations,” that Includes the New 2025 California Building, Fire, and Reach Codes as Amended. Amendments Include Updated Fire Safety Requirements in Wildland Urban Interface Areas for New, Renovated, or Repaired Structures, as well as Reach Codes Affecting Air Conditioning Replacement and Electrical Readiness in Renovations/Alterations. RECOMMENDATION: Adopt an Ordinance, repealing Chapter 6, Building Regulations, and Chapter 9, Fire Prevention and Protection, of the Town Code, and replacing them with a new Chapter 6, Building Codes and Regulations, that includes the new 2025 California Building, Fire, and Reach Codes as amended. Amendments include updated fire safety requirements in Wildland Urban Interface (WUI) areas for new, renovated, or repaired structures, as well as Reach Codes addressing Air Conditioning replacement (AC to Heat Pump) and Electrical Readiness. 8. Authorize the Town Manager to Execute Agreements for Environmental Consultant Services with David J. Powers and Associates, EMC Planning Group, Inc., and Raney Planning and Management, Inc. RECOMMENDATION: Authorize the Town Manager to execute agreements for environmental consultant services with David J. Powers and Associates, EMC Planning Group, Inc., and Raney Planning and Management, Inc. 9. Authorize the Town Manager to Execute the First Amendment to an Agreement for Services with Los Gatos Monte Sereno Safe Routes to School Program for an Amount of $371,158.26 Plus Annual CPI Increases, and Budget Adjustments in the Amount of $88,457 to Recognize Annual Funding from Valley Transportation Authority’s Measure B Education & Encouragement Program (CIP No. 812-0134) RECOMMENDATION: Authorize revenue and expenditure budget adjustments in the amount of $88,457 to fully recognize annual allocations from the Valley Transportation Authority’s Measure B Education and Enrichment Program; and Authorize the Town Manager to execute the First Amendment to an Agreement for Services with Los Gatos- Monte Sereno Safe Routes to School to update and replace the compensation section, increasing the total agreement amount from $350,950 (plus annual CPI increases) to $371,158.26 (plus annual CPI increases). 10. Authorize the Town Manager to Execute a Fourth Amendment to the Agreement for Services with Sequoia Ecological Consulting Inc. RECOMMENDATION: Staff recommends that the Town Council authorize the Town Manager to execute a Fourth Amendment to the Agreement for Services with Sequoia Ecological Consulting, Inc. (Sequoia) to extend the agreement end date to December 31, 2027, for Vegetation Management – Townwide Open Spaces Project (4218507, CIP No. 832-4508). 11. Authorize the Town Manager to Reopen the Building Replacement at Corporation Yard Project (4118715; CIP No. 821-2302) and Authorize an Expenditure Budget Adjustment in the Amount of $83,565.38 RECOMMENDATION: Authorize an expenditure budget adjustment of $83,565.38 from the General Fund reopening the Building Replacement at Corporation Yard project Page 4 of 6 (4118715; CIP No. 821-2302) to complete previously planned shelving and forklift purchases that were delayed by manufacturing and supply chain issues. 12. Approval of a Two-Year Work Plan for the Los Gatos Youth Commission (2026 - 2028) RECOMMENDATION: Approve the Town of Los Gatos Youth Commission's proposed two- year work plan covering the 2026 -2027 and 2027 - 2028 school years. 13. Authorize the Town Manager or Designee to Enter into a First Amendment to the Contract for Litigation Legal Services for FY 2025-26 with Goldfarb and Lipman to Increase the Contract Amount by $150,000.00, for a Total Contract Amount Not to Exceed $350,000.00 and Authorize an Expenditure Budget Adjustment of $150,000.00 from the General Fund Unassigned Fund Balance RECOMMENDATION: Authorize the Town Manager or designee to enter into a First Amendment to the Contract for Litigation Legal Services for FY 2025-26 with Goldfarb and Lipman in an amount not to exceed $350,000.00 and authorize an expenditure budget adjustment of $150,000.00. 14. Authorize the Town Manager to Execute a Fifth Amendment in substantially the form presented with Hinderliter de Llamas & Associates dba HdL Companies for Sales or Transaction and Use Tax Management and Audit Services; Adopt a Resolution as Required by the California Department of Tax and Fee Administration (CDTFA), Authorizing Certain Town Representatives and a Town Contractor Access to Sales or Transactions, and Use Tax Records Pursuant to Revenue and Taxation Code Section 7056; and Rescind Resolution 2025-051. Adopt a Resolution Modifying the Hours of Enforcement for Passenger Loading Zones on East Main Street Adjacent to Los Gatos High School RECOMMENDATION: Adopt a resolution amending the hours of operation for 10-minute passenger loading zones on East Main Street to 7:30 a.m. – 8:30 a.m. and 2:00 p.m. – 3:00 p.m. on school days. Resolution Terminating Membership in the Pooled Liability Assurance Network Joint Powers Authority and Authorizing Membership in the California Joint Powers Insurance Authority to Obtain Risk Management and Insurance Coverages RECOMMENDATION: Adopt a resolution authorizing the Town Manager and Town Attorney to issue written notice of termination of the Town’s membership in the Pooled Liability Assurance Network Joint Powers Authority (PLAN JPA) at the end of the fiscal year and to execute all necessary agreements to join the California Joint Powers Insurance Authority (CJPIA) and obtain risk management and insurance coverages.
