Item 5 Staff Report Setting a Public Hearing for Adoption of 1982 Construction CodesCOUNCIL ITEM Date: 2/21/84 TOWN OF LOS GATOS Council Agenda Report DATE: February 15, 1984 TO: MAYOR AND TOWN COUNCIL FROM: TOWN MANAGER SUBJECT: SETTING A PUBLIC HEARING FOR ADOPTION OF 1982 CONSTRUCTION CODES RECOMMENDATION: Item No. 5 That Town Council set a public hearing for March 19, 1984, to consider the adoption of the 1982 editions of the Uniform Building Code, Uniform Mechanical Code, Uniform Housing Code, Uniform Code for abatement of Dangerous Buildings and Uniform Plumbing Code with certain amendments as included in the attached ordinance. DISCUSSION: State Law mandates adoption of the latest edition of the referenced codes within the year after adoption by the State Department of Housing and Community Development. The 1982 Codes (1981 Electrical) are the latest editions. The referenced codes are pub- lished every three (3) years and have been adopted by the Department of Housing and Community Development. Currently the Town is using 1979 editions (1981 Electrical), and this ordinance updates Town Code by adopting the latest editions. Amendments to the text of the codes are minimal, relating to local conditions, and are identical to amendments made to the 1979 codes. Amendments to the Plumbing Code are made to be consistent with State law relating to the use of plastic piping in buildings: Any expansion on the use of plastic piping beyond text of 1979 Code is prohibited; therefore, Sections 401, 503 and 1004(a) have been amended to comply. PREPARED BY: ARCHIE WATSON, Building Official Reviewed by: Attorney Clerk Treasurer TOWN COUNCIL ACTION DIRECTED TO: ACTION OF COUNCIL: COMMENTS: ADOPTION OF 1982 CONSTRUCTION CODES -- 2 February 15, 1984 It has been determined that the adoption of the referenced codes is categorically exempt, pursuant to Section 15309 of the State Environmental Guidelines as adopted by the Town. By law, adopting any amendments to the Uniform Codes requires resolution of find- ings, showing what local conditions justify the amendment. If the Council does agree with the facts stated in the resolutions, it should adopt them before introducing the ordinance. Copy of said findings is required to be filed with the Department of Housing and Community Development. Government Code Section 50022.3 requires a Notice of Public Hearing before Building Codes are adopted by reference. The notice has to be published once weekly for two successive weeks. It is there- fore recommended that Council set a hearing for adoption of referenced codes on March 19, 1984, and instruct the Town Clerk to publish the notice. NOTICE IS GIVEN THAT on Tuesday, March 21, 1984 at the hour of 7:30 p.m., at Los Gatos, California, the Town Council will hold a public hearing under the provisions of Government Code section 50022.3 concerning the question of whether to adopt the following codes: 1. Uniform Building Code, 1982 Edition 2. Uniform Mechanical Code, 1982 Edition 3. Uniform Housing Code, 1982 Edition 4. Uniform Code for the Abatement of Dangerous Building, 1982 Edition 5. Uniform Plumbing Code, 1982 Edition, together with the changes, additions and deletions to each recommended by the Town Building Official. Copies of each of these codes together with changes, additions, and deletions proposed are on file with the Town Clerk and are open to public inspection between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday at the Civic Center, Los Gatos.
