RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS CONFIRMING
TOWN POLICY ON GREENHOUSE GAS EMISSION REDUCTIONS EMANATING FROM
BUILDINGS
WHEREAS,the Town of Los Gatos Sustainability Plan addresses the major sources of
greenhouse gas (GHG) emissions in Los Gatos and sets forth a detailed and long-term strategy
that the Town and community can implement to achieve the GHG emissions reduction target;
and
WHEREAS, Section 17958(b) of the California Health and Safety Code generally restrict
local agencies from adopting changes applicable to residential units in the provisions adopted
pursuant to Section 17922 and published in the California Building Standards Code unless the
changes meet an exception; and
WHEREAS, Section 17958 (b) (5) of the California Health and Safety Code specifies that
local changes applicable to residential units in the provisions adopted pursuant to Section
17922 and published in the California Building Standards Code may be adopted if the changes
or modifications are necessary to implement a local code amendment that is adopted to align
with a general plan approved on or before June 10, 2025, and that permits mixed-fuel
residential construction consistent with federal law while also incentivizing all-electric
construction as part of an adopted greenhouse gas emissions reduction strategy; and
WHEREAS,the Town of Los Gatos adopted a General Plan on June 30, 2022; and
WHEREAS, Policy 9.6 of the Environment and Sustainability Element of the Town of Los
Gatos General Plan specifies to promote energy conservation in business and residential uses
by encouraging installation of fixture and appliance upgrades, installation of solar panels, and
other retrofits to existing structures; and
WHEREAS,the Town of Los Gatos has adopted a Sustainability Plan that identifies
actions that the Town may take to reduce greenhouse gas emissions in commercial and
residential buildings; and
WHEREAS, buildings constitute a significant source of greenhouse gas emissions in the
Town of Los Gatos of approximately 42%, and taking reasonable regulatory actions to reduce

greenhouse gas emissions from buildings is an important component of the Town's strategy to
reduce greenhouse gas emissions; and
WHEREAS,the Town intends to adopt ordinances making changes to the provisions
adopted pursuant to Section 17922 and published in the California Building Standards Code for
residential units that require new and replaced air conditioning units to be capable of both
heating and cooling, and to require certain building modifications to include electric readiness
components.
NOW,THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Los Gatos
finds that:
1. As described in the Town's Sustainability Plan, it is the Town's policy to reduce
greenhouse gas emissions, including by reducing greenhouse gas emissions from
buildings.
2. The Town's proposed changes to the provisions adopted pursuant to Section 17922 and
published in the California Building Standards Code for residential units are a part of the
Town's adopted greenhouse gas emissions reduction strategy in its Sustainability Plan.
