TOWN CODE REGULATING FARMERS' MARKETS
RECOMMENDATION:
1. Direct the Clerk to read title.
2. Waive the reading.
3. Introduce ordinance amending Section 14.100.020 (d) of the Town Code.
BACKGROUND:
The South Bay Farmers' Markets are operated 8 months a year on Sunday from 7:00 A. M. to 1:00 P.M. at
The Plaza Park. In the past the Market has closed temporarily during the winter months. On December 1,
1994, The South Bay Farmers' Markets made a request to operate 12 months of the year. The Sponsors
of the Farmers' Market have had continual requests from customers and farmers to stay open all year.
A study was conducted by the Farmers' Market gathering input from business owners affected by the market
and there was found to be no opposition to a 12 month Farmer's Market.
DISCUSSION:
The present Town Code regulates that any person intending to conduct or sponsor a regularly scheduled
farmers market may apply for a single special events permit for a period not to exceed 8 months. There is
no opposition to the farmers market permit being issued for a 12 month period and the farmers market permit
process allows the Town to reserve the right to schedule other non-profit events at the Town Plaza on the
dates approved for the Farmer's Market, if determined to be in the best interest of the Community.

ENVIRONMENTAL ASSESSMENTS:
This project is not a project as defined under CEQA.
FISCAL IMPACT:
None. There is no fiscal impact on the Police Department or Parks, Forestry and Maintenance. The applicant
issued a Farmers' Market Special Event Permit is required to pay any Town expenses as a condition of the
permit. Currently there are no police expenses. If additional park maintenance is required at some point in
the future, the Farmers' Market sponsors will be required to pay for the services. At this time, none are
anticipated. There may be additional sales tax revenue generated from the increased sales of products at
other businesses in the downtown business district who will benefit from a year long permit period. There may
also be a minimal increase in revenue from additional business licenses if more vendors are brought in to
supply seasonal produce.

Section 14.100.020(d) is hereby amended to read as follows:

ESTABLISH COUNCIL AUTHORITY TO REQUIRE RESIDENCY IN TOWN FOR MEMBERS
OF TOWN BOARDS AND COMMISSIONS, It was also noted that a resolution will follow the
adoption of this Ordinance. Carried unanimously.
TOWN MANAGER/LETTER OF AGREEMENT/RESOLUTION 1995-39 (15.10)
The following person from the audience spoke to this issue:
Andrew Palmisano, 702 More Ave., spoke regarding the cost to the taxpayers for increased
salaries and to his objection of the consideration of a utility tax.
Council Comments:
Mayor O'Laughlin summarized Council's support and appreciation of the manager's performance
and direction of leadership during a time of limited resources and severe constraints.
Motion by Mrs. Lubeck, seconded by Mayor O'Laughlin, that Council adopt Resolution 1995-
39 entitled, RESOLUTION OF THE TOWN OF LOS GATOS AMENDING LETTER OF
AGREEMENT BETWEEN THE TOWN OF LOS GATOS AND TOWN MANAGER, Carried
unanimously.
