RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING AN UPDATED TRAFFIC IMPACT POLICY
WHEREAS, Chapter 15, Article VI of the Town of Los Gatos Town Code provides for the
establishment of Traffic Impact Mitigation Fees;
WHEREAS, on August 5, 1991,the Town of Los Gatos adopted Resolution 1991- 174
adopting a Traffic Impact Policy;
WHEREAS,the Policy has been updated from time to time including most recently on
December 12, 2021;
WHEREAS, staff recommends updating the Policy to reduce the transportation impact
fees charged for affordable housing, to provide that transportation impact fees will be collected
for accessory dwelling units in excess of 750 square feet, and to update the way development
and redevelopment projects might be provided with credits; and
WHEREAS, Attachment 2, Project list, has not been modified since 2014 and many of
the projects have been completed and therefore needs to be updated.
NOW,THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Los Gatos that:
1. The Transportation Impact Policy attached as Exhibit A to this Resolution is hereby
adopted and the previous Traffic Impact Policy is rescinded.
2. Adoption of this updated Policy is not a project subject to CEQA because it can be
seen with certainty that it will not have a significant impact on the environment.

PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 7th day of October, 2025, by the following vote:
