RECOMMENDATION:
1. Clerk to read title;
2. Waive reading of the attached ordinance amending Sections 15.10.025 and 15.10.030 and adding
Section 15.10.026 of the Town Code regulating skateboarding, in -line skating and roller skating
(requires unanimous vote);
3. Move to introduce and adopt the urgency ordinance (four votes are necessary);
4. Instruct Clerk to publish the ordinance within 15 days after adoption.
5. Authorize a reduction in the Economic Reserve for Uncertainty Account (100-36510) by $2,625.00
and increase the Police Department budget (account 4030-60500) by $2,625.00.
BACKGROUND:
A study was completed using information derived from the Los Gatos Police Department's dispatch activity
log for the months of June, July, August, November, and December of 1992 and January of 1993.
Information was recorded by dispatch every time a civilian called to report an incident regarding
skateboarding, in -line skating, and roller skating and shows an average of approximately 9.5 reported
incidence per month, occurring mostly in parking Tots that are adjacent to or are bounded by a business.
Most commonly, a group of users, mostly juveniles, in groups of two to twelve persons were reported.
A further study was done by gathering input from business owners or employees in the downtown area.
Of the 67 businesses contacted, 68% were in support of an ordinance that would regulate skateboarders,

in -line skaters, and roller skaters. Many of them expressed particular concern with the use of sidewalks
and parking Tots by skateboards and other skaters.
DISCUSSION:
The present Town Code that regulates skateboarding, in -line skating, and roller skating is vague with no
authoritative powers to protect life and property. Each of these devices has a potential to cause serious
bodily injury or extensive damage to property. These devices have no type of braking control mechanism
as do bicycles or cars. Therefore, a person who has lost control on one of these devices has no way to
safely stop to avoid a collision. This ordinance does not ban the use of these devices entirely from the Town
limits, but it does restrict users from areas that have a high potential for bodily injury and property damage.
This ordinance applies to the Central Business District and publicly owned facilities. Staff has identified 35
locations where signs will be required in order to properly post the Civic Center, public parking lots, and the
Central Business District. The ordinance would also prohibit this activity on private property, including
parking Tots, where the owner has first posted signs on the property. The signs minimium size and content
are specified in the ordinance.
Pursuant to Council instructions, the ordinance is an urgency ordinance and will take effect immediately.
ENVIRONMENT REVIEW
This ordinance is not a project as defined under CEQA.
FISCAL IMPACT:
No funds are budgeted for this project. Staff recommends reducing the Economic Reserve For Uncertainty
Account (100-36510) and increasing the Police Department budget (Account #4030-60500) by $2625.00.

SECTION I
This ordinance is an urgency ordinance to take effect immediately. The ordinance
is adopted for the immediate preservation of the public peace, health and safety. The facts
constituting the urgency are as follows:
1. The use of skateboards, in -line skates and roller skates in the areas restricted
by this ordinance has created a significant hazard of injury to pedestrians,
many of them elderly, since the skaters dart in and out of foot traffic in close
proximity to the pedestrians;
2. The use of skateboards, in -line skates, and roller skates in the areas restricted
by this ordinance has created a significant hazard of injury to the skaters,
since the skaters dart in and out of motor vehicle traffic;
3. The use of skateboards, in -line skates, and roller skates in the areas restricted
by this ordinance has resulted in damage to public and private property
including benches and cars in parking lots; and
4. With the recent advent of warmer spring weather, the use of skateboards, in -
line skates, and roller skates in the areas restricted by this ordinance has
increased substantially thereby increasing the potential for injury to persons
and damage to property.

hereby added to the Code of the Town of Los Gatos to read as follows:
Sec 15.10.025. ., Use of

(f) the Civic Center of the Town of Los Gatos at 110 East Main Street
which includes but is not limited to the fountain, parking lot, stairs,
walls, and all walkways, sidewalks, and curbs within the Civic Center
area or bounded by it. The Civic Center also includes the Town
Library, Neighborhood Center and its parking lots.
(g) during darkness as defined by California Vehicle Code Section 280, in
any publicly owned area not otherwise prohibited by this article.
(h) on privately owned property open to the public, including a parking lot,
if (1) the owner of the property has first placed signs in plain view at
each vehicular entrance and/or exit to the lot, and (2) the signs are not
less than 17 by 22 inches in size with lettering not less than one inch
in height, and the signs state: "Unlawful to ride or propel skateboards,
in -line skates, or roller skates on this property. Los Gatos Town Code
Section 15.10.025(h)."
Sec 15.10.026. Regulations for operation of skateboard, in -line skates, or roller
skates - highways or roadways.
No Person shall violate the provisions of this section. A person riding or
propelling a skateboard, in -line skates, or roller skates on highways, or roadways.
(a) shall proceed on highways or roadways in the opposite direction that
vehicles are required to be driven upon a highway or roadway.
(b) shall not impede or interfere with the flow of vehicular traffic.
(c) shall yield to all pedestrians on highways or roadways, including at or
in marked and unmarked crosswalks.
(d) shall yield to approaching vehicles when entering any highway, roadway
or intersection.
(e) shall not suddenly leave a curb or other place of safety and travel into
the path of a vehicle which is so close as to constitute an immediate
hazard.
Sec 15.10.030. Use of skateboard, in -line skates, or
roller skates - yield to pedestrians.

Ariiong the positive things .about living in downtown Los Gatos is
walking around the commercial section. I've had to dodge all the above on
far too many occasions. Since the weather has brought out more bicycles
etc., I've been spending more time in my car. I've been hit before and it

surprised it hasn't become an issue before. When people are walking
downtown they are often iookint in store windows or otherwise relaxed

state. In other words, not alert to sornelone speeding up on thern on one of
•the above conveyances. A couple of friends from out of town recently
complained to me that they didn't give way fast enough on the sidewalk to
some clown speeding at them on a bike. They got a ration of hostility from
him because of their slow response. Aside from the obvious dangers, that
sort of thing doesn't generate good PR for Los Gatos. I'm sure they're not the
only pedestrians who have been confronted in this manner. I've seen too
much or it myself.
The perpetrators are not just kids. My experience has shown that
these incidents are not age specific. Some of the perpetrators are rude and
inconsiderate by intention. Others appear careless because of ignorance. I
believe that both extremes are in evidence. In any case, the practice is
dangerous to themselves and others.
I'm not suggesting that any of the mentioned forms of transportation
are less dangerous to pedestrians then another. I have personally seen and
been involved in far more incidents with bicycles. They're bigger and there
are more of them. I have also been hit by skateboarders. In most
circumstances, I would expect that a bicycle offers the potential for more
damage.

A number of police officers have told me that they would be glad to
enforce rules about this problem if they were given a mandate or directive
towards increased 'vigilance from the city council. I believe the usual
procedure with a new preventiori effort would include a period of warnin's
followed by citations with vines. Once the message started netting around
that police were enforcing the rules, the problem just like cruising, would
begin to disappear.
think it is essential that signs are placed in obvious locations such
as in front of the the Coffee Roast and at the begining of each access route
that espouse a common-sense message about the "rules", potential fines and
maybe a note about simple courtesy. These could be referred to in flyers
and news articles that would bring attention to their message. Also, when a
pedestrian is confronted by a violator, he or she could refer to the signs
thus avoiding an assault. Hopefully, the suns would serve to educate,
initiate a gradual positive change and instill a sense of courtesy, at least
among some the riders. Especially among the myriad weekend bike tourists.
I'm not suggesting that Los Gatos should become "bike etc. unfriendly". Just
don't ride them on the sidewalks. It may also be necessary to paint signs on
the corners to inform riders that the ramps are for wheelchairs and not for
their convenience.

Dear Mayor Benjamin:
I am writing you on behalf of the Los Gatos Village Square regarding our
concerns of the skateboarding, In -line skating, and Roller Skating problems
at the Los Gatos Village Square Shopping Center.
We have discouraged these activities in our parking lot and walkways,
however, we have little control over the situation without an ordinance to
enforce. Our concern is for the safety of the customers, clients, and tenants
of the center as well as for the safety of the skateboarders, in -line skaters
and roller skaters. Another concern that we have is the cost to repair any
damages caused to the parking area and walkways by the use of
skateboards, in -line and roller skates.
The Los Gatos Village Square, Ltd. supports the passage of the
proposed Ordinance Sections #15.10.025, #15.10.026, and #15.10.030 to

We are writing regarding the proposals on the three skateboard
related ordinances, Sections 15.10.25, 15.10.26, and 15.10.30.
We have personally witnessed several incidences in our parking lot
at Los Gatos Village Square. Notonly is skateboarding through a
busy parking lot dangerous for the child, but we have seen the
skateboarders hanging on to cars, screaming obsenities at drivers
when they honk and racing on our upstairs walkway, again screaming
obsenities and disturbing the entire floor of tenants. We have
called the police but they seem little help without an ordinance
to enforce.
Our staff at All Property Management supports the passage of the
proposed ordinances. Please feel free to call me if you have any

Re: Proposed ordinances: Sections #15.10.025, regarding

I have been informed by my landlords, Los Gatos Village
Square, Ltd. that the above 3 ordinances are to be addressed
at the April 19, 1993 council meeting.
As a Los Gatos business owner, I wish to encourage the Town
of Los Gatos to put the above ordinances into effect.
As it is now, I am concerned about damage to my property,
and the property of Los Gatos Village Square.
The skate boarders are often very rude to my customers and
many have commented about how distasteful it is to run a
gauntlet of skateboarders to get into my restaurant for
lunch and/or dinner.
When considering the above stated 3 proposed ordinances,
please take the economic well-being of the Los Gatos
business community into consideration.

Liability is another great concern. Although we have made numerous
attempts to eliminate these activities from occurring in our center;
there is nothing in place to reier to as an entorcement nor is there
anything to protect our businesses from a suit despite our ettorts.

urdinance Sections #15.10.025, #15.10.02b, and #15.10.030 to alleviate
these concerns.

COMMUNITY SERVICE SEMINARS/FINANCIAL PLANNING (09.23)
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council authorize the Town to co-
sponsor three community service seminars on financial planning, entrepreneurship and career
changes. Carried by a vote of 3 ayes. Mr. O'Laughlin was absent. Mrs. Lubeck voted no
stating that she felt this was not a government matter and that the Town should not be
sponsoring seminars on financial planning.
MINUTES OF APRIL 5, 1993 (21.V)
Mrs. Lubeck requested a correction of order on pages 4 and 5 to reflect the closure of the public
hearing on the General Plan Amendment 92-4A to follow the listing of the speakers.
Mrs. Lubeck requested the reasons for Mr. Blanton's no vote be reidentified under the General
Plan Amendment 93-1 hearing on page 5.
Mayor Benjamin requested the proper spelling of Mr. Lemons name on page 8 under the
skateboarding issue.
Motion by Mr. Attaway, seconded by Mr. Blanton, that Council approve the Minutes of April
5, 1993 as amended. Carried by a vote of 4 ayes. Mr. O'Laughlin was absent.

SKATEBOARDING/IN-LINE SKATING/ROLLER SKATING/CODE AMENDMENTS (23.46)
Mayor Benjamin stated that this was the time and place duly noted to consider introduction
and adoption of urgency ordinance amending Sections 15.10.025 and 15.10.030 and adding
Section 15.10.026 of the Town Code regulating skateboarding, in -line skating and roller skating.
The following people from the audience spoke against this issue addressing the problems of
damage to the new parking facility, damage to benches at the Sarah Center, damage to curbs,
damage to store fronts, the safety issue of this equipment competing in traffic, and need for
regulations for these activities:
