RECOMMENDATION :
1. Direct the Clerk to read the title
2. Move to waive the reading
3. Introduce ordinance establishing the official posting locations for Town's legal notices as required by
Government Code Section 36933(a).
DISCUSSION :
The Town Council adopted Ordinance 1840 January of 1991. This ordinance requires that public notices be
posted in three locations within the Town of Los Gatos as shown in Sec. 1.10.105of the Los Gatos Town Code:

When required by law to be posted, public notices shall be posted at the Town Hall Bulletin
Board, the Fiesta Way Kiosk and the Main Post Office on Montebello Way as the designated
places for posting public notices for the Town pursuant to Government Code Section 36933(a).
The Town Hall Bulletin Board has been a convenient location for staff and constituents to access, and to keep
up to date with current notices, ordinances and agendas. The Brown Act requires all public meetings to be
noticed to the public within 72 hours of the meeting. Our 24 hour bulletin board provides easy access and is
available at all times to the public.
We have found that the Town Library has worked very well as a second location for our notices. The Library
has regular hours which extend to evenings and weekends. There is a convenient bulletin board by the front
door with which constituents have become accustomed and which facilitates noticing to the public by our staff.
All Town business, ordinances, agendas, fee schedules, and other information for the public can be
accommodated there.
We have found that the temporary board in front of the Planning and Building Department has been well
received and attracts a good deal of interest. This board was placed during the reconstruction of the deck at
which time the public could not access the permanent 24 hour posting corner. The location at the foot of the
stairs is easily noticed especially by people who have an interest in planning and development items. Staff has
suggested that this location be considered for an additional 24 hour Town posting board.

The Fiesta Way Kiosk has proven unsatisfactory due to the use of the public to post a variety of personal notices.
The Town's information has been covered and removed, and during inclement weather the notices become wet
and blow away.
The Post Office has also not proven satisfactory for posting Town notices. Post Office staff, unfamiliar with the
policy, remove the Town's items before a proper length of time has expired. Now the Post Office has a wide
display of items for sale posted throughout their lobby and no one can locate our notices nor probably find an
interest in doing so.
We are suggesting changing the Town's posting ordinance by removing the Kiosk and Post Office and substituting
the Library and Planning/Building Department locations. The cost of this project would be a permanent bulletin
board to be mounted on the wall downstairs, the savings will be to staff in having three easily accessible posting
locations, and community good will be generated with service to our constituents which make public notices more
conveniently available.

ORDINANCE OF THE TOWN OF LOS GATOS AMENDING
TOWN CODE SECTION 1.10.105 ESTABLISHING THREE OFFICIAL
POSTING LOCATIONS FOR THE TOWN OF LOS GATOS PUBLIC NOTICES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS:
SECTION I
This ordinance is intended to establish three official posting locations for the Town of Los
Gatos public notices required by Government Code section 36933(a).
SECTION II
Section 1.10.105 is amended to read as follows:
Sec. 1.10.105. Posting public notices.
When required by law to be posted, public notices shall be posted at the Town Hall Bulletin
Board, the Planning Bulletin Board and the Town Library the Fiesta Way Kiosk and the Main
Post Office on Montebello Way as the designated places for posting public notices for the Town
pursuant to Government Code Section 36933(a).
SECTION III
This ordinance was introduced at a regular meeting of the Town Council of the Town of Los
Gatos on and adopted by the following vote as an ordinance of the Town of Los Gatos
at a regular meeting of the Town Council of the Town of Los Gatos on . This
ordinance takes effect 30 days after it is adopted.
