GRAND JURY REQUEST FOR A WRITTEN CITIZEN COMPLAINT
PROCEDURE.
RECOMMENDATION:
Accept report on response to Santa Clara County Grand Jury request for a written citizen
complaint procedure.
DISCUSSION:
Prompted by the complaints of a neighbor of the Los Gatos Auto Mall concerning violations of
hours of operation, the Santa Clara County Civil Grand Jury initiated an investigation of the
Town's method of enforcing Conditional Use Permits. The final report issued by the Grand Jury
July 6, 2000, found that the Community Development Department should have a written policy
concerning responses to citizen complaints.
Staff has implemented the attached Code Compliance Program in response to the above
mentioned Grand Jury recommendation. The program outlines the Town's Code Compliance
policy, procedures and complaint process.
ENVIRONMENTAL ANALYSIS:
Responding to the recommendation of the Grand Jury is not a project as defined by CEQA.

Speakers continued:
David Shrigley, 471 Santa Rosa Drive, spoke of building their dream home in a neighborhood that
approved their design and plans. He noted that the Planning Commission had approved this project
on fairness to the applicant due to confusion occurring during the permitting process.
Ray Davis, resident and appellant, asked that Council deny the project, preserve the hillsides and
follow the new General Plan.
No one else from the audience spoke.
Motion by Mr. Blanton, seconded by Mr. Attaway, to close the public hearing. Carried
unanimously.
Motion by Mr. Glickman, seconded by Mr. Blanton, to deny the appeal. Carried unanimously.
Council Comments:
Due to the timing of this application and the number of approvals received from the Town, Council
concurs that the applicant should be allowed to proceed with the project although some mistakes were
made on the part of the applicant and on the part of the Town. Council concludes that it is fair and
appropriate to allow continuance of construction of the project in the manner that the Planning
Commission approved it. This is not a precedence setting action since the General Plan has since been
adopted and the Town now has ordinances and policies in place to not allow this size structure in the
Los Gatos hillsides again. On April 16, 2001 Council will have the opportunity to review the
demolition policy and Town Code Section 29.10.020 etc.. for any definitions of the process.

WRITTEN CITIZEN COMPLAINT PROCEDURE/CODE COMPLIANCE (09.38)
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council accept and file report on response
to Santa Clara County Grand Jury request for a written citizen complaint procedure. Carried
unanimously.
UNION PACIFIC RAILROAD/DE ANZA TRAIL/RESOLUTION 2001-33 (10.33)
Ray Davis, resident, spoke of the "Rails to Trails" association which would be interested and helpful
in initiating the ground work for implementing this trail.
Motion by Mr. Attaway, seconded by Mr. Blanton, that Council adopt Resolution 2001-33 entitled,
RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN MANAGER
TO EXECUTE A MEMORANDUM OF UNDERSTANDING TO PARTICIPATE IN A
FEASIBILITY STUDY OF THE UNION PACIFIC RAILROAD TRAIL. Carried unanimously.
BICYCLE LANES/LOS GATOS BOULEVARD/VTA FUNDS (12.41)
Town Manager, Debra Figone, introduced Assistant Manager, Jim Piper, who noted that the
requirements of a proposed grant application by the Town for Valley Transportation Agency (VTA)
funds to mark bicycle lanes on Los Gatos Boulevard might be inconsistent with the design and plans
that Council had set for the striping of Los Gatos Blvd. last year. Town could move forward with the
approved striping plan using existing Town Capital Improvement Program funds this year. Staff
suggested that a letter be sent to VTA requesting a carryforward of current year grant funds to be
used for a qualifying project in the following year.
