FIGONE, TOWN MANAGER/EXECUTIVE DIRECTO SUBJECT: ADOPT RESOLUTION AUTHORIZING STAFF TO PROCEED WITH AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL LOS GATOS REDEVELOPMENT PROJECT TO EXTEND THE POWER OF EMINENT DOMAIN FOR TWELVE YEARS RECOMMENDATION: Adopt resolution authorizing staff to proceed with an amendment to the Redevelopment Plan for the Central Los Gatos Redevelopment Project to extend the power of eminent domain for twelve years. BACKGROUND: The Redevelopment Plan for the Central Los Gatos Redevelopment Project (the "Plan") was adopted by the Town Council on November 25, 1991. The Plan contains a provision allowed by Redevelopment Law that permits the Redevelopment Agency (the "Agency") to acquire property by use of eminent domain in certain circumstances. The eminent domain section specifically prohibits the Agency from acquiring by eminent domain single-family residential dwellings which are located upon R-1 (Single -Family Residential) and R-1D (Single -Family Residential Downtown) zoned properties as defined by the Los Gatos Zoning Ordinance. In addition, the Agency is prohibited from acquiring real property owned by public bodies that do not consent to such acquisition. Whereas the Town may only condemn property for a public use such as a street or park, the Agency's authority allows it to condemn property and then sell it or grant it to a private developer to carry out a project in conformance with the adopted Redevelopment Plan. The Agency's power of eminent domain can be an important tool in implementing key redevelopment projects. In addition, the power of condemnation allows the Agency to acquire property voluntarily "under the threat of eminent domain" which provides certain property tax advantages to the property owner of the property to be acquired. To date, the Los Gatos Redevelopment Agency has not used its power of eminent domain. DISCUSSION: Redevelopment law requires that eminent domain proceedings, if used, must commence within twelve years from the date the ordinance adopting the Plan becomes effective. In the case of the Los Gatos Redevelopment Plan, this means that the Agency's eminent domain authority will expire on December 25, 2003. Redevelopment law permits an extension of an agency's eminent domain authority, but this requires an amendment of the redevelopment plan which can take four to six months. This process requires an amendment to the Plan and notification of all property owners, business owners and tenants in the Redevelopment Area as well as information meeting (s) for those concerned about the amendment. At this time we do not know the level of concern from property owners, if any, however, since single family homes are exempt, it would seem that the level of concern would be diminished. At this time we need to begin our amendment process should we wish to extend our eminent domain authority. Although we have not used our eminent domain authority to date, it remains a tool that may prove useful to the Agency in the future as it further implements the Redevelopment Plan. Losing such a tool could restrict our ability to put projects together at some point in the future. CONCLUSION: The Agency's power of eminent domain will expire at the end of this year unless extended. Adoption of the attached concurrent resolution (Attachment A) will begin the process to extend this authority for a period of twelve years. The provisions of the power of eminent domain will remain unchanged in that single family homes on lots zoned R-1 and R-1D and the property owned by public bodies will not be subject to eminent domain by the Agency. The Agency will notify all property owners, tenants and business owners in the Redevelopment Project Area of the proposed amendment, hold an informational meeting (s) and conduct a formal public hearing as required by Redevelopment Law. PAGE 3 MAYOR AND TOWN COUNCIL/REDEVELOPMENT AGENCY SUBJECT: EXTENSION OF EMINENT DOMAIN AUTHORITY April 24, 2003 ENVIRONMENTAL ASSESSMENT: The action adopting the concurrent resolution by the Council/Agency is not a project defined under CEQA, and no further action is required. It is anticipated that the Town will prepare a negative declaration as the environmental documentation for the proposed Plan Amendment itself. FISCAL IMPACT: It is anticipated that the Plan amendment process may cost $10,000 to $20,000 including legal fees, public notice mailings, and other related costs. These costs will be paid for by the Redevelopment Agency. Attachments: 1. Carried unanimously MAYOR'S STATEMENT (XX.28) Mayor Decker welcomed the Council and audience and explained how she would like the tone of the Town meetings to proceed during the year. She spoke of a community that has been able to display respect for one another, to deliberate the business of the Town in an informed manner, and to accept and act upon the decisions made at public and open meetings. She noted that all of our residents deserve our respect and the respect of each other. She asked for and said she expects that the visitors to these Council Chambers will recognize and uphold these principles of respect and courtesy for one another. The Mayor noted that disruptive behavior would not be tolerated, nor allowed to interfere with these community meetings held in the spirit of cooperative and interactive government. She reaffirmed her desire to encourage respect and dignity within these chambers. VERBAL COMMUNICATIONS (XX.28) Ray Davis spoke in opposition to being limited to three minutes of verbal communication on the subjects he wished to address. REDEVELOPMENT PLAN AMENDMENT/RESOLUTION 2003-58 & 2003-13RD (13.27) Motion by Mr. Glickman, seconded by Ms McNutt, that Council/Agency adopt Resolution 2003-58 & 2003-13RD entitled, RESOLUTION OF THE TOWN COUNCIL/REDEVELOPMENT AGENCY OF THE TOWN OF LOS GATOS AUTHORIZING PROCEEDING WITH AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL LOS GATOS REDEVELOPMENT PROJECT TO EXTEND THE POWER OF EMINENT DOMAIN FOR TWELVE YEARS AND TAKING RELATED ACTIONS.
