Adopt resolution establishing newsrack storage fee.
BACKGROUND:

On March 20, 1995 the Town Council adopted a newsrack ordinance which established standards for the design and
placement of newsracks in the public right of way. The Ordinance authorized the Town or its representatives to remove
and store newsracks determined to be in violation of Ordinance requirements, and requires equipment owners to pay
a fee for the actual costs to the Town for the transportation, storage, and disposal of their equipment.
DISCUSSION:
The Parks, Forestry, and Maintenance Services Department has determined that $92.28 is the fair market cost of the
labor and equipment required to remove each unauthorized newsrack. This estimate includes approximately one hour
for an Administrative Secretary at $28.59 per hour to process each newsrack, one and a half hours (1 1/2) for a
Maintenance Worker III at $30.46 per hour to physically remove each newsrack, and the $12.00 per hour cost of
operating a Town flat bed truck. The costs to store each newsrack at the Town's Miles Avenue Facility is estimated at
$10 per month for the maximum three month storage period specified by the Ordinance. This $10.00 per month storage
fee is based on staffs estimate of the price to store similar equipment at a private storage facility.
The Newsrack Committee reviewed the costs and agreed that they are reasonable. After the three month storage period
any abandoned newsracks may be disposed of by the Town as specified by Civil Code Section 2080.6. The Planning
Department estimates that a maximum of 30 newsracks may be removed during the initial implementation year of the
newsrack ordinance. Less than 5 newsracks per year are estimated to require removal and storage after this
implementation period.

ENVIRONMENTAL ASSESSMENTS:
It has been determined that this project is a Statutory Exemption to the California Environmental Quality Act pursuant
to Public Resources Code 21080(b)(8).
FISCAL IMPACT:
Assuming that 30 newsracks are removed and stored during the implementation period, the Town will receive a
minimum of $3,000.00 in fees this first year. Subsequent years will generate less than $500.00 in fees depending on
the number of newsracks stored. Revenue from this fee will be deposited into Building Maintenance Program 6011.

cost to the Town for services to be provided.
