Historic Preservation Committee -- Commissioner Thomas O'Donnell reported that the
committee met last week and recommended approval of an Architecture and Site (A&S)

application for demolition of a pre-1941 single-family dwelling at 134 Loma Alta, gave advice
on a Building Permit to replace redwood siding at 255 Los Gatos Boulevard, and recommended
approval of an A&S application for demolition of a pre-1941 single-family dwelling at 399
Nicholson Avenue.
General Plan Committee -- Commissioner John Bourgeois reported that the committee met
earlier today and made a recommendation regarding the property at 375 Knowles Avenue to
ensure that the General Plan designation and the zoning matched, and made recommendations
for changes to the Zoning Ordinance amendments based on the implementation of the Town's
State Certified Housing Element and an associated Town Council resolution.

Commented that he appreciates being able to see multiple applications for the site at the same
time.
Asked about parking requirements for restaurant use.

Commented that currently the applications for restaurant use are not complete and staff does
not have the proposed number of seats or square footage for the two restaurants.
Principal Planner Joel Paulson
Commented that parking for the restaurants will be allotted based on the spaces available in
the parking analysis. The restaurants will not exceed the overall parking requirements for the
site.

Asked if the hospital is under any specific governmental regulations.
Asked if there are inspections for daily operations of the hospital.
Brian Maxwell
Commented that there are no specific oversight regulations and that the only piece of
equipment that requires special permitting is the x-ray machine and they have a State permit
for the machine.
Bryan King, Architect
Commented that there are requirements for radiation shielding that requires a physicist to
study the radiation exposure based on the adjacent occupancies. The report is submitted as
part of the Building Permit application and the Health Department or the State will review it
as part of the application process. There is an ongoing licensing requirement for periodic
inspections to ensure that the equipment is operating within expected parameters.
Summer Holmstrand
Commented that throughout the year, local agencies inspect for safety procedures. The two
organizations that can come in at any time and inspect for hospital safety are the California
Veterinary Medical Association and the American Animal Hospital Association. They have
had very successful inspections with both organizations.
Commissioner Kendra Burch
Asked about hazardous waste disposal.
Brian Maxwell
Commented that they contract with a company for weekly hazardous waste disposal. The
hospital uses special containers for needles. The storage of the hazardous materials will be
secured inside the premises.
Vice Chair Margaret Smith
Asked about parking for the 22 employees.
Commented that it will create a problem if staff parks in the neighborhood and she would
encourage the employees to park in the least used area of the commercial site.
Brian Maxwell
Commented that all employees will not be working at the same time and they are following
the Town's parking guidelines. They have not worked out all of the parking issues yet.
Commented that the hospital will ensure that there is parking available for clients and
customers. Veterinary staff may have to commute in or find offsite parking.
Bryan King
Commented that this type of business is their specialty and that jurisdictional parking
requirements are based on formulas using number of staff and square footage. The majority
of the people at the hospital at any given time will primarily be staff. The client -based

parking requirements are minimal because it is cyclical, short-term parking. The Town's
parking requirements should be sufficient.
Summer Holmstrand
Commented that she explored parking for the veterinary staff on Placer Oaks Road and
would recommend that staff not go into residential areas.

Commented that this development took years to approve and the Placer Oaks neighborhood
was very concerned about parking on their street.

Commented that staff will be directed not to park in residential areas.
Chair Charles Erekson
Commented that the standards of the Town assume that it has parking capacity on the site for
all users and employees and cautioned the applicant about stating on the record that
employees will be parking somewhere else.

Asked about soundproof windows for animal noise.
Asked about outdoor pens.
Asked if dog training will be offered.
Asked if they plan to sell animals.
Bryan King
Commented that the maximum sound level where dogs are barking in a kennel is 100
decibels and the exterior walls and windows will buffer that level by 50-60 decibels. That
level of noise is barely audible and about the sound level of an open office environment.

Commented that they will not have outdoor pens.
Commented that the retail portion of the hospital may offer puppy classes, if allowed, but
they have not committed to that.
Commented that they do not plan to sell animals.

Commented that if the hospital decided to do puppy training other than one-on-one training,
the retail component would need a Conditional Use Permit (CUP) as well.

Commented that he has a concern regarding the location of this business to the park. The
park was meant to be a public amenity for the residents and a link to the commercial center.
He hopes it does not turn into a dog park because that was not the intent of the park and he
wanted to be sure the owners of the hospital were cognizant of that.

Commented that they base their mix on 80 percent commuter and 20 percent cafe. That
varies from store to store and they look to find the appropriate mix for specific communities.
Commented that the typical food offering is a simple line up of food such as pastries,
burritos, yogurt, juices, and water. The merchandise will be Philz-branded merchandise such
as T-shirts and tumblers along with whole coffee beans of their blends.

Commented that the lighting is 24 hours and is set by law. The light is directed down for

Asked for clarification on the ATM vestibule and the ATM room.

Commented that the ATM room services the exterior ATM and it is the interior of the ATM
where they fill it with money. There is only one ATM machine that faces the exterior. The
internal ATMs in the vestibule are accessible after hours with an ATM card. This area

is separated from the interior of the bank after hours with a gate. There are also ATMs inside
the bank for use during banking hours.

Commented that he is not certain of how many branches are in Town, but this is a new

Commented that no signage is proposed as part of this application, but Chico's would have to
apply for a new sign permit that would need to be consistent with the sign program of the
center.
Brian Sorlie, Amy Alameda, and Aileen Larson, Applicants, introduced themselves and gave
a presentation on the proposed project, noting that there will be new, more contemporary signage
at the new location.

Asked what stores Chico's has partnered with in its grassroots outreach.

Commented that Chico's has worked with Los Gatos Roasting Company, Icing on the Cake,
Everything Bundt Cakes, Willow Street Pizza, and The Mmoon. Chico's also partners with
the History Club of Los Gatos with annual fashion shows for the Club's fundraiser. In 2011,
the fashion show raised $10,000 for the Los Gatos Library.

6. Report from Director of Community Development
a. Principal Planner Joel Paulson reported the following actions of the Development
Review Committee:
1) On May 28 -- Approved a Conditional Use Permit for a minor restaurant at 15466
Los Gatos Boulevard.
2) On June 18 -- Approved Architecture and Site applications for 715 Bicknell Road
for demolition of a single-family residence and construction of a new residence,
exterior modifications to a commercial structure at 140 S. Santa Cruz Avenue,
and approved a Certificate of Compliance application for three parcels at 60
Central Avenue.
3) On June 25 -- Approved an Architecture and Site application to demolish an
existing single-family residence and construction of a new residence at 110
Drysdale Drive.

b. Principal Planner .Joel Paulson reported the following actions of the Town Council:
1) On June 3 -- Approved the Albright Planned Development and Architecture and
Site applications with modifications and certified the EIR (Environmental Impact

2) On June 17 -- Adopted regulations relating to firearms. Land Use regulations for
firearms is tentatively scheduled to come to the Planning Commission in August.
c. Principal Planner Joel Paulson thanked Linda Rowlett for her service to the
Commission and the Town as Recording Secretary.
7. Commission Matters
a. Chair Charles Erekson reported that there will be two meetings in July and in
August.
b. Commissioner Joanne Talesfore asked if there will be a sign program for the
Swanson Ford site applications and if the information will be relayed to the
Commissioners.
Principal Planner Joel Paulson responded that there will be a sign program for the
Swanson Ford site and that information will be provided to the Commission when it
becomes available.

BACKGROUND:
The Country Club is comprised of three parcels totaling 125 acres. The site currently contains a
clubhouse, a recreation room and snack shack, swimming pool, 18-hole golf course, putting
green, and driving range. In 2010, the Town approved a Conditional Use Permit (CUP)
modification, which included upgrading the swimming pool and surrounding area. The
swimming pool area has seen an increase in use since those upgrades. The golf balls that
occasionally land in the driving aisle of the parking lot to the west of the swimming pool bounce
into the swimming pool area. The club would like to prevent that from occurring given the
increase in use of the upgraded swimming pool area.
PROJECT DESCRIPTION:
A. Architecture & Site Application
The applicant is requesting approval of an Architecture and Site application (A&S) to
install a safety barrier to cover a portion of parking lot west of the swimming pool and
prevent golf balls from entering the swimming pool area.

The applicant is proposing a 30-foot tall safety barrier that would be 70 feet wide and 200
feet long (14,000 square feet). The safety barrier would consist of 12 — 16-inch diameter
steel poles, three of which would be anchored by '/2-inch diameter galvanized steel cables.
The poles would be spaced 40 feet apart along the length of the safety barrier.
Approximately 14,000 square feet of horizontal netting would be placed across the top of
the poles. The safety barrier would be open on all four sides. The netting would be one -
inch mesh size polyester netting with '/z-inch diameter sewn rope borders. The color of the
netting would be black. A sample of the netting will be available at the Planning
Commission meeting.
The applicant provided a description of the project (Exhibit 4), justification for the project
Exhibit 5), and development plans (Exhibit 7).
B. Location and Surrounding Neighborhood
The project site is located south of Wedgewood Avenue, and west of Clearview Drive. The
site is surrounded by single-family residential properties.
C. Zoning Compliance
The maximum height of the zoning designation is 30 feet.
ANALYSIS:
A. Architecture & Site Application
The proposed safety barrier does not exceed the height limit of the zoning designation.
Given the mesh netting design and the black material color, the safety barrier will blend
into the surrounding environment. The safety barrier netting would not be visible offsite.
The applicant installed story poles and orange netting to verify that the safety barrier would
not be visible offsite.
B. Tree Impacts
The safety barrier poles would be supported with galvanized cables anchored into the
ground. The Town Arborist reviewed the proposed project. There are trees along the
parking lot and the golf course. The Town Arborist made some recommendations to
eliminate or reduce potential tree impacts, which are incorporated as conditions of approval

C. General Plan
The goals and policies of the 2020 General Plan applicable to this project include but are
not limited to:
Policy LU-3.1 — To preserve existing trees, natural vegetation, natural topography,
riparian corridors and wildlife habitats, and promote high quality, well -designed,
environmentally sensitive, and diverse landscaping in new and existing developments.
Policy OSP-6.4 — Consider health, welfare, and public safety in the design of open
space facilities.
D. Environmental Review
The project is Categorically Exempt according to Section 15303 of CEQA as adopted by
the Town, which exempts permitting appurtenant structures.
PUBLIC COMMENTS:
At this time, the Town has not received any public comment regarding this application.
SUMMARY AND RECOMMENDATION:
A. Summary
There would be no traffic or parking impacts as a result of this project. The proposed use
would create a safer recreational facility. The safety barrier netting would not be visible
offsite. The proposed use is in conformance with Town Code and is supported by the
General Plan.
B. Recommendation
Based on the summary above, staff recommends approval of the Architecture and Site
application subject to the recommended conditions of approval. If the Planning
Commission concurs with staff's recommendation, it should:
1. Find that the proposed project is categorically exempt, pursuant to Section 15303 of the
California Environmental Quality Act as adopted by the Town (Exhibit 2); and
2. Make the required considerations as required by Section 29.20.150 of the Town Code
for granting approval of an Architecture & Site application (Exhibit 2); and
3. Approve Architecture & Site Application 5-13-047 with conditions contained in
Exhibit 3.

TO THE SATISFACTION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT:
Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the conditions
of approval listed below and in substantial compliance with the plans approved and noted
as received on June 14, 2013. Any changes or modifications made to the approved plans
shall be approved by the Director of Community Development, the Development Review
Committee, the Planning Commission, or the Town Council depending on the scope of the
changes.
2. EXPIRATION: The approval will expire two years from the approval date pursuant to
Section 29.20.320 of the Town Code, unless the approval has been vested.
3. GENERAL: All existing trees shown on the plan and trees required to remain or to be
planted are specific subjects of approval of this plan, and must remain on the site.
4. ARBORIST RECOMMENDATIONS: All recommendations made by the Town Arborist
shall be implemented to eliminate or minimize construction -related impacts on the trees to
be retained. All recommendations for Protection Measures before and during development,
encompassing fencing, removal of hardscape, demolition, work within tree canopies, etc,
shall be implemented. Tree protection specifications shall be printed on the construction
plans. A Compliance Memorandum shall be prepared by the applicant and submitted with
the building permit application detailing how the recommendations have been or will be
addressed. These recommendations must be incorporated in the building permit plans, and
completed prior to issuance of a building permit where applicable.
5. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a permit or entitlement from the Town shall defend,
indemnify, and hold harmless the Town and its officials in any action brought by a third
party to overturn, set aside, or void the permit or entitlement. This requirement is a
condition of approval of all such permits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.

6. PERMITS REQUIRED: A building permit shall be required for the structure. Separate
permits are required for any associated electrical work as necessary.
7. CONDITIONS OF APPROVAL: The Conditions of Approval must be blue -lined in full on
the cover sheet of the construction plans. A Compliance Memorandum shall be prepared
and submitted with the building permit application detailing how the Conditions of
Approval will be addressed.

8. SIZE OF PLANS: Four sets of construction plans, maximum size 24" x 36".
9. TITLE 24 ACCESSIBILITY — COMMERICAL: For any proposed tenant improvements,
on -site parking and general path of travel shall comply with the latest California Title 24
Accessibility Standards. Work shall include, but not be limited to, accessibility to building
entrances from parking facilities and sidewalks. For any proposed tenant improvements,
the building shall be upgraded to comply the latest California Title 24 Accessibility
Standards. Necessary work shall first be investigated by the Design Architect and then
confirmed by Town staff.
10. PLANS: The construction plans shall be prepared under the direct supervision of a

Size to be approximately 200 feet long and 70 feet wide across the parking lot with 5 painted
flat black new steel poles at a height of 32 feet. Netting material is black with sewn rope
borders.
Maintenance:
La Rinconada Country Club maintenance staff will ensure debris is removed daily from the
vertical netting and will maintain trees so they are healthy and within the height tolerance of
the netting structure.

In April 2011, we completed the renovation of our pool and fitness facility. The pool and
fitness facility was a positive addition which has created an increase in usage and
additional foot traffic to the area. Since that time, we've experience concerns and
complaints from members and guests regarding near misses of errant golf balls. In an
effort to assure the safety of members and guests, we engaged David Ginkle Design and
Robert Trent Jones Jr., golf course architects, to solicit ideas. We performed our own
analysis of errant golf shots and where and how they enter the pool area. This study
suggested that every ball that could possibly fly into the swimming pool area has to hit
the paved parking lot first. We hired Tanner Consulting Group, a risk assessment
company, to provide us an accurate, defensible position to justify the changes we
explored. We consulted with 2 netting contractors for their input and suggestions.
The highest priority on our check sheet was to insure the safety of all individuals in the
parking lot and the swimming pool. The next priority was to maintain some if not all of
the integrity of the 5th hole.
The options explored were to:
1) Shorten the golf hole and relocate the tees to the right and the new green closer to the
4th fairway resulting in a 175 yard hole from the tees.
2) Leave the golf hole at its temporary playing distance of 130 yards.
3) Leave the golf hole as it is and install netting, either vertical or horizontal.
4) Reroute holes 3-4-5 and tee off from the current area of hole #5 towards the current #4
green.

5) Remove the parking area from the swimming pool area and install irrigation and turf.
Make the "overflow" parking area by the main entrance truly a parking lot. The new turf
area could accommodate the overflow parking issue for those events that require its use.
After consulting with Tanner Consulting Group, our risk assessment company, they told
us that Option 1 would only reduce the number of errant golf balls by 34% and would
still require vertical netting to a height of 80 feet. Option 2 would reduce the number of
errant shots by a larger percentage, but would still require a net in the 50 foot range to
accomplish our #1 priority. Option 3 requires a vertical net of 130 feet or a horizontal net
covering the parking area. Option 4 did not address the likelihood of shots from the new
tee hooking onto the 12th tee or 1 lth green. This did not seem to be a realistic solution at
this time.
Option 5 would not protect those using the "overflow" parking lot, as well it presents
several logistical challenges (staff movement, staging of bulk materials, etc). There are at
least, on average, one event per month that requires the use of additional parking beyond
what we currently offer as paved parking spots.
This was not an easy decision to make, but in order to accomplish our #1 priority.... safety
and to preserve the integrity of the 5th hole, we felt that the horizontal net was the best
choice of many undesirable options.

As requested , I went out to Rinconada Golf Course June 20th and inspected the parking area where the proposed Safety
Barrier -Netting is to be installed. There are 10 Crape Myrtles Lagustromia) and 3 Magnolia( Magnoliaceae) which are
located in the barrier area. I see no issue with the installation of barrier in relation to the trees. I would only suggest that
tree be kept trimmed at a height that will not interfere with the barrier once it is in place.
