Minutes of the Town Council Special Meeting – Closed Session
Tuesday, February 18, 2025
5:00 P.M.
The Town Council of the Town of Los Gatos conducted a special meeting in person to hold a
Closed Session.
MEETING CALLED TO ORDER AT 5:00 P.M.
ROLL CALL
Present: Mayor Matthew Hudes, Vice Mayor Rob Moore, Council Member Mary Badame,
Council Member Rob Rennie, and Council Member Maria Ristow.
Absent: None.
VERBAL COMMUNICATIONS (ONLY ON ITEMS ON THE AGENDA)
Maureen Cappon-Javey
- Commented on the existing litigation case and requested the Town support Vice Mayor Rob
Moore and Council Member Maria Ristow.
Karen Rubio
- Commented in support of the Town providing legal support for Vice Mayor Moore and
Council Member Ristow in the existing litigation.
Kristine Goldberg
- Commented in support of the Town providing legal support for Vice Mayor Moore and
Council Member Ristow in the existing litigation.
Lee Fagot
- Commented on the existing litigation case and providing a response.
Lynley
- Commented on the Town’s social media policy and spoke about the existing litigation case.

2. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION (Government Code
§54956.9(e)(1)) Significant exposure to litigation pursuant to Government Code
§54956.9(e)(1): 2 cases.
3. EMPLOYEE PERFORMANCE EVALUATION Pursuant to Government Code Section 54957(b)(1)

The Town Council reconvened in open session.
Gabrielle Whelan, Town Attorney, stated the first closed session item was a discussion of
existing litigation pursuant to Government Code section 54956.9, and authorized pursuant to
subsection h of that code section, and that discussion has been continued to Friday, February
21, 2025; and with regard to the other two closed session items, one regarding conference with
legal counsel regarding anticipated litigation and the other is an employee performance, those
discussions will occur after the regular meeting of the Town Council.
The Mayor reconvened the Closed Session at approximately 9:40 p.m.
THE TOWN MOVED TO CLOSED SESSION ON THE FOLLOWING ITEMS:
2. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION (Government Code
§54956.9(e)(1)) Significant exposure to litigation pursuant to Government Code
§54956.9(e)(1): 2 cases.
3. EMPLOYEE PERFORMANCE EVALUATION Pursuant to Government Code Section 54957(b)(1)

The Town Council reconvened in open session. Gabrielle Whelan, Town Attorney, stated the
Town Council met in closed session to discuss anticipated litigation and employee performance
and there was no reportable action.

The meeting adjourned at approximately 10:50 p.m.
