Dear Ms. Wood:
We represent John W. Hoffee, the new owner of the property located at 14915 Shannon Road, Los Gatos, California (APN 537-27-047) (“Property”).
On November 19, 2024, the Town of Los Gatos (“Town”) is holding a hearing to Consider
Adopting a Resolution of Necessity to authorize the Town to acquire a portion of the Property by
eminent domain for the Shannon Road Capital Improvement Project (“Shannon Road Project”). The total amount of the Property to be taken is approximately 29,807 square foot portion of the Property that consists of an approximately 21,929 square foot strip of land within the existing Shannon right of way and an approximately 7,878 square foot strip of land along the Property
frontage on Shannon Road.
We are submitting this letter regarding two issues: (1) whether the Shannon Road Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; and (2) whether the subject Property sought to be acquired is necessary for the Shannon Road Project.

The former Property owner (Elam) was informed by Town staff that an approximately
19,000 square foot strip of land for a public storm drain easement was required for the land use
entitlement application pending with the Town. (General Plan Amendment Application GP-22-001; Zone Change Application Z-22-001 and Subdivision Application M-22-003 “Application”)) In addition, an approximately 29,000 square foot strip of land north of the Shannon Road right of way and south of the proposed storm drain easement would also be required. See attached maps.
These easements have not been included in the Town’s Offer Pursuant to Government
Code section 7267.2 dated October 14, 2024, or in the November 1, 2024, Notice of Hearing to Consider Adopting a Resolution of Necessity. We understand that these easements may be necessary for the Shannon Road Project and have not been considered in the total valuation offered by the Town. In addition, these easements may or may not be required through the Application
process. Therefore, the Town must consider these public easements and the potential valuation of
them at this time. We understand that the amount of compensation to be paid for the Property will not be decided at this hearing. However, we believe it is important to bring these easements to the Town’s attention because it may affect the amount of Property to be taken.
The Town has indicated that it would like to resolve this matter by agreement since the
Town believes that a negotiated purchase best serves the parties’ interest.1 We agree and look
forward to further discussions with the Town regarding the Shannon Road Project and the pending Application.
