RECOMMENDATION:
Consider the following actions related to Certain Sections of Blossom Hill Road:
a) Accept the 2023 Engineering and Traffic Survey Update; and
b) Introduce an Ordinance Amending Section 15.30.235 of the Town Code Establishing
Speed Limits (Attachment 2).
BACKGROUND:
Speed zones (other than statutory speed limits) are established by an engineering and traffic
survey (E&TS)that has been performed in accordance with standard traffic engineering
practices and in compliance with the California Vehicle Code (CVC) and the California Manual
on Uniform Traffic Control Devices (CAMUTCD). The CVC requires engineering and traffic
surveys to be completed at least once every five, seven, or fourteen years to support radar
enforcement of prima facie speed limits (e.g., speed limits that are not statutory as noted
above). Attachment 3 is a detailed description of the methods by which speed limits are set and
the associated legal standards.

DISCUSSION:
A summary table of the current speed limits and updates proposed as part of this action is in
Attachment 4. During the latest E&TS, the speed on three road segments along Blossom Hill
Road resulted in a recommendation for a lower speed limit as described below.
Blossom Hill Road from Camino Del Cerro to the East Town Limits —Recent changes to CVC
Section 40802 allow an E&TS to be extended from ten years to fourteen years if no significant
change has occurred to the character of the roadway. Therefore, the 2013 E&TS for this
segment is valid through 2027. It is recommended that this segment of Blossom Hill Road
remain posted at 35 mph (Attachment 5).
Blossom Hill Road —North Santa Cruz Avenue/Winchester Boulevard to Camino Del Cerro—
This segment is currently posted at 35 mph. Recent bikeway improvements as well as lane
reductions along this section of Blossom Hill Road (BHR) are considered a significant change and
necessitated new engineering and traffic surveys for the following street segments:
• BHR from Santa Cruz Avenue/Winchester Boulevard to Highway 17 (Attachment 6),
• BHR from Los Gatos Boulevard to State Route 17 (Attachment 7), and
• BHR from Los Gatos Boulevard to Camino Del Cerro (Attachment 8).
These sections of Blossom Hill Road are adjacent to facilities that generate high concentrations
of bicyclists or pedestrians, especially those from vulnerable groups such as children and
seniors. The attached engineering and traffic surveys justify the reduction of the posted speed
limit from 35 mph to 30 mph in accordance with CVC 627, 22358.7, and 22358.8. This
recommendation requires a modification to Section 15.30.235 of the Town Code as proposed in
Attachment 2.
Staff believes that based on the results of the engineering and traffic surveys, these speed limits
will facilitate the orderly movement of vehicular traffic and are reasonable and safe. The
California Vehicle Code specifies prima facie speed limits which shall be effective when
appropriate signs giving notice thereof, as necessary, are erected upon the street.
Council approval of the current Engineering and Traffic Survey Update is required before the
document can be sent to the Municipal and Juvenile Courts for "Judicial Notice."Judicial Notice
is where the court recognizes the engineering and traffic surveys as containing facts that are
self-evident, and no additional speed limit study evidence is necessary in a particular speed
violation case.

CONCLUSION:
The speed limits along Blossom Hill Road between Santa Cruz Avenue/Winchester Boulevard
and Camino Del Cerro should be approved at 30 mph based on the attached Engineering and
Traffic Surveys. Staff recommends Town Council introduce an Ordinance Amending Section
15.30.235 of the Town Code Establishing Speed Limits to reduce the speed limit along the
identified sections of Blossom Hill Road from 35 mph to 30 mph. Should the Council approve
the introduction of the ordinance, staff will bring an item back to the Town Council at the
December 3, 2024, Town Council meeting for a second reading of the ordinance. Following the
second reading, appropriate signs will be posted and the Police Department may legally enforce
the revised speed limits using radar.
COORDINATION:
This report was coordinated with the Town Attorney's Office and Police Department.
FISCAL IMPACT:
Changing the speed limit on Blossom Hill Road would require the posting of new speed limit
signage. There is a need to replace eight (8) 35-mile-per-hour (mph) signs with 30 mph signs.
The cost to replace the signs is approximately$300 per sign for a total cost of$2,400 and the
Adopted Fiscal Year (FY) 2024/25 Parks and Public Works Operating Budget (Streets) includes
sufficient funds to cover the cost.
ENVIRONMENTAL ASSESSMENT:
This is not a project defined under CEQA, and no further action is required.

AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AMENDING SECTION 15.30.235, "ESTABLISHING SPEED LIMITS ON CERTAIN
STREETS," OF THE TOWN CODE ESTABLISHING SPEED LIMITS
WHEREAS, the Town recently completed a "road diet" project along Blossom Hill Road
between Camilla Terrace and Cherrystone Drive to enhance bicycle and pedestrian safety along
the corridor in the vicinity of Blossom Hill Elementary School;
WHEREAS, the project resulted in a reduction of vehicle travel lanes along Blossom Hill
Road between Camilla Terrace and Cherrystone Drive;
WHEREAS, the Town conducted an Engineering Traffic Survey (ETS) to evaluate the
project's impact on the travel speeds along the Blossom Hill Road corridor between Los Gatos
Boulevard and Camino Del Cerro in conformance with California Vehicle Code Section 40802
which requires the reevaluation of non-statutory speed limits on segments of roadways that have
undergone significant changes since the last review,such as the addition or elimination of parking
or driveways,changes in the number of travel lanes,changes in the configuration of bicycle lanes,
changes in traffic control signal coordination, or significant changes in traffic volumes;
WHEREAS, the ETS determined that the speed limits along this segment of Blossom Hill
Road could be reduced from 35 mph to 30 mph;
WHEREAS, the Parks and Public Works Engineering Division also has an ETS on file that
justifies the reduction of speed limits along Blossom Hill Road between Santa Cruz
Avenue/Winchester Boulevard and Los Gatos Boulevard from 35 mph to 30 mph;
WHEREAS, California Vehicle Code Section 22357 states that, whenever a local authority
determines upon the basis of an engineering and traffic survey (ETS) that a speed greater than
25 miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon any street other than a state highway otherwise subject to a prima
facie limit of 25 miles per hour, the local authority may, by ordinance, determine and declare a
prima facie speed limit of 30, 35, 40, 45, 50, 55, or 60 miles per hour or a maximum speed limit
of 65 miles per hour, whichever is found most appropriate to facilitate the orderly movement of
traffic and is reasonable and safe;
WHEREAS, California Vehicle Code Section 22358.7 authorizes the Town to reduce the
speed limit by an additional 5 mph if the roadway is adjacent to any land or facility that generates
high concentrations of bicyclists or pedestrians, especially those from vulnerable groups such as
children, seniors, persons with disabilities, and the unhoused; and

this Ordinance takes effect 30 days from the date of its passage. The Town Council hereby
directs the City Clerk to cause this Ordinance or a summary thereof to be published or posted in
accordance with Section 36933 of the Government Code of the State of California.

SECTION II. Severability.
In the event that a court of competent jurisdiction holds any Section, subsection,
paragraph, sentence, clause, or phrase in this Ordinance unconstitutional, preempted, or
otherwise invalid, the invalid portion shall be severed from this Section and shall not affect the
validity of the remaining portions of this Section. The Town hereby declares that it would have
adopted each Section, subsection, paragraph, sentence, clause, or phrase in this Section
irrespective of the fact that any one or more Sections, subsections, paragraphs, sentences,
clauses or phrases in this Section might be declared unconstitutional, preempted, or otherwise
invalid.

Adopting this Ordinance is not a project subject to CEQA because it can be seen with certainty
that reducing the speed limit by five miles per hour will not impact the environment (CEQA
Guidelines Section 15378).
SECTION IV. Publication.
In accordance with Section 63937 of the Government Code of the State of California,
this Ordinance takes effect 30 days from the date of its passage. The Town Council hereby
directs the City Clerk to cause this Ordinance or a summary thereof to be published or posted in
accordance with Section 36933 of the Government Code of the State of California.

There are two main types of speed limits in California: maximum speed limits and prima facie
speed limits. The maximum limits apply everywhere. They are 65 miles per hour(mph) (or 70
mph if posted)for larger highways and 55 for smaller two-lane roads. The prima facie speed
limits are set for other roads and range from 15 to 60 mph. The law sets forth a default prima
facie limit(statutory speed limit) of 15 mph for an uncontrolled railroad crossing, approaching
an uncontrolled intersection without a clear and unobstructed view, and any alley as well as a
default prima facie limit of 25 mph for business and residential districts, school zones and senior
zones. Often,these speeds are not reasonable for the prevailing conditions, so jurisdictions are
allowed to modify them.
An Engineering and Traffic Study is a required in compliance with CVC 40802 to reevaluate
non-statutory speed limits on segments of roadways that have undergone significant changes
since the last review, such as the addition or elimination of parking or driveways, changes in the
number of travel lanes, changes in the configuration of bicycle lanes, changes in traffic control
signal coordination, or significant changes in traffic volumes. If there are no significant changes
the speed limit surveys can be completed up to fourteen years from the date of the last survey.
Per CVC 22357, when a local authority determines upon the basis of an engineering and traffic
survey that a speed greater than 25 miles per hour would facilitate movement of vehicular traffic
and would be reasonable and safe, then the local authority may,by ordinance, determine and
declare a different prima facie speed limit. The speed limit can be 30, 35, 40, 45, 50, 55, or 60
miles per hour or a maximum speed limit of 65 miles per hour, depending on what the
engineering analysis has determined to be most appropriate to facilitate the orderly movement of
traffic and is reasonable and safe. The declared prima facie or maximum speed limit is in effect
when appropriate signs giving notice of the speed limit are erected on the street.
The engineering and traffic survey includes an analysis of the prevailing speed of free-flowing
vehicles (the speed which 85% of motorists drive at or below on that particular segment, also
known as the 85th percentile speed)and considers accident history, traffic and roadside
conditions not readily apparent to the driver, and also the safety of bicyclists and pedestrians,
with increased consideration for vulnerable pedestrian groups including children, seniors,
persons with disabilities, users of personal assistive mobility devices, and the unhoused. In
accordance with CVC 22358.6. (a)The Department of Transportation has revised the California
Manual on Uniform Traffic Control Devices to require the Department of Transportation or a
local authority to round speed limits to the nearest five miles per hour of the 85th percentile of
the free-flowing traffic. However, based upon the considerations noted above and in compliance
with CVC Sections 627 and 22358.5, The California Manual on Uniform Traffic Control Devices
allows the posted speed limit to be reduced by 5 mph.
In summary, we adjust to the nearest 5 mph increment from the 85th percentile speed (i.e., if the
85th percentile is 36 or 37 mph, we round to nearest 5 mph or 35 mph),then based upon the other
considerations and engineering judgement we can take an additional 5 mph speed reduction(i.e.,
from 35 mph to 30 mph).

In accordance with the California Vehicle Code (CVC) Section 40802, Speed Trap, a posted
speed limit must be justified with an engineering and traffic survey that is conducted within
seven to ten years prior to the date of the alleged violation.
CVC 40802.(c).(2).(B).(i).
"A particular section of a highway or state highway with a prima facie speed limit that is
provided by this code or by local ordinance under paragraph(1) of subdivision(b) of Section
22352, or established under Section 22354, 22357, 22358, or 223 5 8.3, if that prima facie
speed limit is not justified by an engineering and traffic survey conducted within one of the
following time periods, prior to the date of the alleged violation, and enforcement of the speed
limit involves the use of radar or any other electronic device that measures the speed of
moving objects:
(I) Except as specified in subclause (II), seven years.
(II) If an engineering and traffic survey was conducted more than seven years prior to the date
of the alleged violation, and a registered engineer evaluates the section of the highway and
determines that no significant changes in roadway or traffic conditions have occurred,
including, but not limited to, changes in adjoining property or land use, roadway width, or
traffic volume, 10 years."
Engineer Evaluation
There have been no major roadway improvements or modifications to this roadway section
for the past seven years. The roadway configuration, land use, and traffic condition have been
reviewed based on field observation and knowledge of traffic flow, roadway improvements,
and land use developments. It is determined there have been no significant changes that would
necessitate a new engineering and traffic survey.
It is therefore, the posted speed limits are recommended to remain 35 mph until July 9, 2023.
