Located at 110 Wood Road. APN 510-47-038. An Environmental Impact Report (EIR), Mitigation Monitoring and Reporting Program, and Modified CEQA Checklist have been Prepared for this Project. Planned Development Application PD-20-001 and Environmental Impact Report EIR-21-002. Applicant: Frank Rockwood. Property Owner: Front Porch Communities. Project Planner: Sean Mullin. REMARKS: Exhibit 18 includes high resolution versions of the visual renderings included on Sheet A408 of the Development Plans. Exhibit 19 includes additional public comments received between 11:01 am, Friday, November 8, 2024 and 11:00 am, Tuesday, November 12, 2024. Below are responses by staff to Planning Commissioner questions: 1. Is Senate Bill 330 (SB 330) applicable? If SB 330 applies, would this be the third hearing of the five allowed? This project is not a “housing development project” under the Housing Accountability Act. SB 330 only applies to housing development projects. 2. Please point me to the Housing Element Site’s Inventory related to Wood Road: The Housing Element Site’s Inventory included in the Town’s certified Housing Element is available through the following link. The subject property is not included in the Housing Sites Inventory, nor is any property on Wood Road. The existing development includes 130 parking spaces per an older Staff Report. The Current Staff Report on page 177 says it is 111 parking spaces. The proposal is for 214. Please advise me whether the existing parking is 111 or 130. The column included in the referenced table reflects what was permitted through the 1968 Planned Development Ordinance, 111 parking spaces. As indicated in their Letter of Justification (Exhibit 13), the existing site includes 130 on-site parking spaces (85 within the existing structure and 45 surface parking spaces). 4. Page 177 of the Staff Report includes a table showing the heights of some of the existing buildings are 30'-9” to 55'-2". Since the existing buildings are only two-stories, please help me to understand this entry as to building heights. Some of the existing buildings cantilever above the grade below. The existing building heights provided in the Development Plans are dimensioned from the grade. This condition is shown with the red outlines of the existing buildings included in the cross sections on Sheet A207 of the Development Plans (Exhibit 16). 5. If there is a Planning Commission recommendation of denial to the Council, and Council agreement, is the Town potentially subject to a claim for familial discrimination on the basis that it is housing for seniors, or on the basis of other California or federal statutory or case law? Anti-discrimination laws prohibit property managers from discriminating against residents , with exceptions for senior housing projects. There are no laws prohibiting the Town from making its required land use findings.
