RECOMMENDATION: Accept the Annual Progress Report for General Plan and Housing Element implementation. REMARKS: Government Code Section 65400 mandates that cities and counties submit an annual report on the status of their General Plan and any progress in its implementation to their legislative bodies. Annual Progress Reports (APRs) must be presented to the local legislative body for its review and acceptance, usually as a consent or discussion item on a regular meeting agenda. After review and acceptance, a copy of the APR is required to be filed with the Governor’s Office of Planning and Research (OPR) and the Housing and Community Development Department (HCD). There is no standardized form or format for the preparation of the General Plan APR. The attached APR meets the statutory requirements of State law and highlights key aspects of the Town’s General Plan and Housing Element implementation during the calendar year of 2023 (Attachment 1). Given the State requirements, Exhibit A of Attachment 1 contains a significant amount of data. For enhanced readability, Exhibit A is best reviewed electronically to adjust to the individual reader’s needs. FISCAL IMPACT: There is no fiscal impact from accepting the APR. PAGE 2 OF 2 SUBJECT: Annual Progress Report for General Plan and Housing Element Implementation DATE: March 14, 2024 CEQA: The General Plan Annual Report is not a project under the California Environmental Quality Act (CEQA). It is a type of activity that is Categorically Exempt, Class 6 (Information Collection) based on Section 15306 of the CEQA Guidelines. Attachment: 1. 2023 General Plan Annual Progress Report, with Exhibit A GENERAL PLAN 2023 ANNUAL PROGRESS REPORT ATTACHMENT 1 2 INTRODUCTION The Town Council adopted the Town of Los Gatos 2020 General Plan on September 20, 2010, after an extensive two-year community process to update and build upon the strong foundational framework established by the Town’s 2000 General Plan. On May 5, 2015, the Town adopted its 2015-2023 Housing Element which is a required sub- element of the General Plan. The State Housing and Community Development Department (HCD) certified the Housing Element on May 20, 2015. On June 30, 2022, the Town Council adopted the Town of Los Gatos 2040 General Plan after an extensive four-year process. On August 16, 2022, signatures were submitted to the Town in support of a referendum on the Land Use and Community Design Elements of the adopted 2040 General Plan. The referendum proposes that the Land Use and Community Design Elements of the 2040 General Plan be repealed. Once the referendum signatures were verified by the County Registrar in late September, the 2040 General Plan Land Use and Community Design Elements were suspended in accordance with Elections Code Section 9237. On October 4, 2022, Town Council adopted a Resolution to confirm suspension of the 2040 General Plan Land Use and Community Design Elements and provide that the 2020 General Plan Land Use and Community Design Elements govern during the suspension period. On January 30, 2023, the Town adopted its 2023-2031 Housing Element which is a required sub-element of the General Plan. The HCD has not yet certified the Housing Element. The Town continues to work with HCD to respond to their comments. Government Code Section 65400 mandates that cities and counties submit an annual report on the status of their General Plan and any progress in its implementation to their legislative bodies. Annual Progress Reports (APRs) must be presented to the local legislative body for its review and acceptance, usually as a consent or discussion item on a regular meeting agenda. 2023 SIGNIFICANT PROJECTS The following significant Planning efforts made progress or were completed in 2023: • Housing Element Update The Housing Element update process started in 2021 and continued through 2023. The work included numerous meetings of the Housing Element Advisory Board (HEAB) and extensive community outreach. A Draft Housing Element was developed and submitted 3 to HCD in October 2022, and adopted by Town Council on January 30, 2023. Work to resolve outstanding comments from HCD is ongoing. • Land Use and Economic Recovery Amendments On April 26, 2023, Planning Commission reviewed and recommended approval of amendments to Town Code regarding land use and economic recovery. On June 20, 2023, Town Council approved these amendments that went into effect on September 1, 2023. • Zoning Changes to Implement the Housing Element Zoning changes required for implementation of the 2023-2031 Housing Element, including the creation of a Housing Element Overlay Zone (HEOZ) and application of the overlay to the sites in the site inventory of the 2023-2031 Housing Element, were completed and went into effect on December 21, 2023. • Accessory Dwelling Unit (ADU) Ordinance As a result of changes in recent years to the State’s laws addressing ADUs and Junior ADUs the Town initiated a process to update local regulations for consistency with current State law. On September 13, 2023, Planning Commission reviewed and recommended approval of a draft ordinance. On November 7, 2023, Town Council approved the updates to Town Code which went into effect on December 21, 2023. • Height Pole and Netting Policy Amendment As part of the implementation of the 2023-2031 Housing Element the Town initiated modifications to the existing Height Pole and Netting Policy (Story Pole Policy). On April 26 and May 24, 2023, the Planning Commission considered and made recommendations for modifications. On August 1 and December 5, 2023, the Town Council considered and made further recommended changes. These changes are expected to be finalized in the first half of 2024. HOUSING ELEMENT ANNUAL PROGRESS The Housing Element Annual Progress Report for 2023 is attached as Exhibit A.
