DRAFT RESOLUTION 2023- RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ACCEPTING PUBLIC IMPROVEMENTS CONSTRUCTED BY CHANG 2003 FAMILY TRUST
AT 16940 ROBERTS ROAD AND AUTHORIZING EXECUTION AND RECORDATION OF A
NOTICE OF COMPLETION AND CERTIFICATE OF ACCEPTANCE
WHEREAS, The County recorded a parcel map on July 14, 2022 indicating a dedication of
public right-of-way located on the northwest corner of intersection of Fisher Avenue and Roberts
Road to the Town of Los Gatos; and
WHEREAS, The Town issued Conditions of Approval of the subdivision that obligated the
Subdivider to enter into a Landscape Maintenance Agreement and a Subdivision Improvement
Agreement; and
WHEREAS, The Town Manager executed a Subdivision Improvement Agreement with the
Subdivider on July 13, 2022 to construct various off-site public improvements including streets,
sidewalks, curbs, gutters, and street signs. Faithful performance and labor and materials bonds
were collected from the Subdivider to ensure completion of the improvements.
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY
RESOLVE:
1. The Subdivider has completed the work for the public improvements per the
conditions of the Subdivision Improvement Agreement, and
2. The Town Manager is authorized to execute and record with the County a Notice of
Completion and Certificate of Acceptance.
