Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 11/07/2023 ITEM NO: 1 DRAFT Minutes of the Town Council Study Session Tuesday, October 10, 2023 The Town Council of the Town of Los Gatos conducted a special meeting in person and utilizing teleconferencing means on Tuesday, October 10, 2023, at 5:00 p.m. to discuss an update to the Traffic Impact Fee and a Proposed Vehicle Miles Traveled Impact Fee. MEETING CALLED TO ORDER AT 5:00 P.M. ROLL CALL Present: Mayor Maria Ristow, Vice Mayor Mary Badame, Council Member Matthew Hudes, Council Member Rob Moore, and Council Member Rob Rennie. VERBAL COMMUNICATIONS (ONLY ON ITEMS ON THE AGENDA) No one spoke. OTHER BUSINESS 1. Receive the Report and Provide Direction for an Updated Traffic Impact Fee and a Proposed Vehicle Miles Traveled Impact Fee. Nicholle Burnham, Public Works Director, presented the staff report. The Town Council Members asked preliminary questions. Mayor Ristow opened public comment. No one spoke. Mayor Ristow closed public comment. The Town Council Members asked questions and discussed the information. MOTION: Motion by Council Member Rennie to keep the Highway 17 Corridor Congestion Relief project on the list. Seconded by Vice Mayor Badame. VOTE: Motion passed unanimously. PAGE 2 OF 3 SUBJECT: Draft Minutes of the Special Town Council Meeting of October 10, 2023 DATE: October 19, 2023 MOTION: Motion by Vice Mayor Badame to accept the project list as presented in the staff report. Seconded by Council Member Moore. VOTE: Motion passed unanimously. MOTION: Motion by Vice Mayor Badame to retain the trip length factor in the calculations and adopting a reduced fee rate for specific land uses based on the Town’s goals for development. Seconded by Council Member Moore. VOTE: Motion passed unanimously. MOTION: Motion by Vice Mayor Badame to develop custom calculations of impact fees where a proposed land use’s trip generation characteristics differ substantially from those of the basic land use categories and understanding that calculations would be based on the adopted basic fee per dwelling unit equivalent or single-family dwelling unit hoping that this approach would provide for a different fee rate for medical office uses. Seconded by Council Member Moore. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Hudes to use 3,660 square feet as the basis for the single- family residential fee and 1,649 square feet as the basis for the multi-family fee per square foot fee calculation. Seconded by Mayor Ristow. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Rennie to include the Accessory Dwelling Units (ADUs) over 750 with the Traffic Impact Fee (TIF) and Vehicle Miles Traveled (VMT) fee and include it in the multi-family category. Seconded by Council Member Moore. VOTE: Motion passed unanimously. MOTION: Motion by Mayor Ristow to adopt the fully calculated fees for multi-family housing developments and consider credit programs to offset certain categories of units. Seconded by Council Member Moore. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Rennie to not reduce fees for moderate or low-income categories and waive or give a credit for extremely low and very low-income categories. Seconded by Council Member Moore. VOTE: Motion passed unanimously.
