SUBJECT: Authorize the Town Manager to Execute a First Amendment to the
Memorandum of Agreement with the Santa Clara County Recycling and
Waste Reduction Technical Advisory Committee to Allow Satellite and
Auxiliary Teleconferencing Attendance in Meetings
RECOMMENDATION:
Authorize the Town Manager to execute a First Amendment to the Memorandum of
Agreement with the Santa Clara County Recycling and Waste Reduction Technical Advisory
Committee to allow satellite and auxiliary teleconferencing attendance in meetings.
BACKGROUND:
County-wide coordination of mandated and discretionary recycling and solid waste planning,
collection, and disposal services is provided by the Santa Clara County Recycling and Waste
Reduction Commission (RWRC). The RWRC is chartered by the Board of Supervisors and is
made up of elected officials representing cities, the County of Santa Clara, and Valley Water.
The Santa Clara County Cities Association appoints a RWRC member to represent the West
Valley communities of Los Gatos, Campbell, Saratoga, and Monte Sereno.
A Technical Advisory Committee (TAC) advises the RWRC. The TAC is made up of city
representatives, the County, and representatives of the solid waste industry, recyclers, San Jose
State University, and environmental organizations. Los Gatos is represented on the TAC by the
Town’s the West Valley Solid Waste Management Authority.

DISCUSSION:
In February 2023, the Implementation Committee, a special Technical Advisory Committee led
by RWRC, provided direction to jurisdictions to revise the language of the 2013 Recycling and
Waste Reduction Committee Memorandum of Agreement (MOA) (Attachment 1) to allow
teleconference participation by staff, voting members, and the public.
Attorneys of all participating jurisdictions provided feedback to ensure compliance with the
Brown Act for the proposed First Amendment (Attachment 2).
CONCLUSION:
Staff recommends that the Council authorize the Town Manager to execute a First Amendment
to MOA with the Santa Clara County Recycling and Waste Reduction Technical Advisory
Committee to allow satellite and auxiliary teleconferencing attendance in meetings.
FISCAL IMPACT:
This is no fiscal impact for this item.
ENVIRONMENTAL ASSESSMENT:
This is not a project defined under CEQA, and no further action is required.
