RE: Revised - Story Pole Material Exemption Request

Dear Mayor and Town Council,
On November 1, 2022 Town Council directed Swenson Builders to add a second row of
flagging to the story poles in order to accommodate a replacement solution for the required
netting called out in the Town’s Height Pole and Netting Policy. Unfortunately, due to the
winter weather in 2022 and multiple atmospheric storms that have taken place in 2023,
the story-pole vendor has been unable to install the additional flagging. The property site
has remained very wet and muddy, and the equipment needed to install the additional
flagging cannot access the site.
Swenson is requesting an exemption from the Town’s Height Pole and Netting Policy due to
the physical challenges brought by recent and continued storm weather activity. The
current conditions of the sites and continuous weather make the November 2022 direction
from Town Council physically impossible without causing a safety risk during install, and a
continued safety risk to the community and public.
As an alternative, Swenson is proposing to provide a virtual 3D model video to convey the
overall massing of the proposed project in context of the surrounding neighborhood and
existing neighboring structures as directed in the policy exception section to establish
accuracy of a visual simulation. Additionally, we would like to provide additional signs of
four feet by 6 feet on Shelburne Way and Winchester Blvd that depict the appropriate
rendering for the respective street frontages.

Additionally, please find the link to our current renderings that we have for the project,
that were included in our plan set. Of these renderings, we are offering to add additional
signage for each street frontage of the council's choosing to further highlight the

Please accept this written request for an exemption to the Town’s Height Pole and Netting
Policy regarding our proposed project located at 15860 Winchester Boulevard. Under the
“exceptions” section of the Town’s Height Pole and Netting Policy, if the story poles or
materials cause a threat to public health or safety, other alternative representations may be
utilized. Given the continuous extreme weather, and in an effort to further prevent delay of
the project application, we respectfully request an exemption and wish to provide a 3D
model video alternative as well as the additional proposed signage.
