RE: Condition of Approval 82 – Final Grind and Overlay
Dear Mr. Ebrahimi,
This is in response to your letter of June 30, 2022 regarding the timing for the implementation of Condition of Approval (COA) 82 within the December 1, 2020 agreement between North 40 and the Town. This COA requires the grind and overlay along Los Gatos Boulevard between Lark Avenue and Burton Road, and along Lark Avenue form the Highway 17 northbound on-ramp to Los Gatos
Boulevard.
With Summerhill’s suggestion to complete the grind and overlay work now rather than at the end of
the work, the Town has agreed that there are benefits to expediting this work. The Town understands that this is not the typical timing for this final pavement overlay work and agrees that the Town will not look to SummerHill to repair any damage done to this section of roadway that is done by anyone other than SummerHill.
