TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 110 East Main Street, at 7:32 p.m., Monday, February 1, 1993, in regular
session.
ROLL CALL
Present: Randy Attaway, Steven Blanton, Linda Lubeck,
Patrick O'Laughlin and Mayor Joanne Benjamin.

SCHEDULE OF PUBLIC HEARINGS (01.01)
Informational report regarding currently scheduled public hearings was received and filed.
COUNTY REFERRALS (02.47)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council approve the recommended
action concerning County Referrals:

Informational item presenting future Town Meetings for Council and other Town Boards and
Commissions was received and filed.
PAYROLL/RATIFICATION/JANUARY 1993 (05.V)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council ratify the accompanying check
registers for payroll of January 3 through January 16, 1993 in the amount of $238,681.28 paid
on January 22, 1993.

ACCOUNTS PAYABLE/RATIFICATION/JANUARY 1993 (06.V)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council ratify accompanying check
registers for accounts payable invoices in the amount of $361,244.78 paid on January 15 and 22,
1993. Carried unanimously.
SUVIEW DRIVE 15400/RIGHT-OF-WAY ABANDONMENT/HACKE'IT (07.08)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council continue this item at the
request of Mr. Hackett. Carried unanimously.
ABANDONED VEHICLE ABATEMENT PROGRAM/POLICE INTERN (08.07)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council establish a Police Community
Service Intern Position assigned to the Abandoned Vehicle Abatement Program. Carried
unanimously.
SISTER CITY/LISTOWEI BALLYBUNION/IRELAND (09/20)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council establish Sister City _.
relationship with Listowel-Ballybumon, Ireland. Carried unanimously.
STREET MAINTENANCE AGREEMENT/DEPARTMENT OF TRANSPORTATION
STATE OF CALIFORNIA/RESOLUTION 1993-22 (10.13)
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council adopt Resolution 1993-22
entitled, RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN
MANAGER TO EXECUTE AN AGREEMENT WITH STATE OF CALIFORNIA DEPARTMENT
OF TRANSPORTATION FOR MAINTENANCE OF STATE HIGHWAYS IN THE TOWN OF
LOS GATOS. Carried unanimously.
LOS GATOS BUSINESS IMPROVEMENT DISTRICT/RESOLUTION 1993-23 (11.43)
Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council adopt Resolution 1993-23
entitled, RESOLUTION OF THE TOWN OF LOS GATOS TO RENEW AND REDEFINE THE
BUSINESS IMPROVEMENT AREA KNOWN AS THE DOWNTOWN LOS GATOS BUSINESS
IMPROVEMENT DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS FOR FISCAL
YEAR 1993 AND AMENDING ORDINANCE 1876 and confirm the public hearing for March
1, 1993. Carried unanimously.

Motion by Mr. Blanton, seconded by Mr. O'Laughlin, that Council adopt Ordinance 1930
entitled, ORDINANCE OF THE TOWN OF LOS GATOS TO ALLOW EXISTING USES TO
REMAIN CONFORMING THAT WOULD OTHERWISE BE NONCONFORMING DUE TO
A CHANGE IN ZONING FROM LM (COMMERCIAL- INDUSTRIAL) TO C-1
NEIGHBORHOOD COMMERCIAL). Carried unanimously.
HEARING
TRAFFIC IMPACT MITIGATION FEES/HEARING (14.46)
Mayor Benjamin stated that this was the time and place duly noted for public hearing to consider
adoption of resolution revising Town -Wide Traffic Impact Mitigation Fees.
There was no one from the audience to address this issue.
Motion by Mr. Blanton, seconded by Mrs. Lubeck, to continue this public hearing to March 1,
1993. Carried unanimously.
MINUTES OF JANUARY 19, 1993 (15.V)
Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council approve the Minutes of January
19, 1993 as submitted. Carried unanimously.
ROOF INSTALLATION/HAZARDOUS FIRE AREA/SAFETY ISSUES/TOWN CODE (16.13)
Mayor Benjamin noted that this was the time and place so noted for Council to consider the
reintroduction of ordinance amending Chapter 9 of the Town Code regulating the installation
of roofs in the Hazardous Fire Area and Chapter 6 of the Town Code regulating the installation
of roofing tiles over existing wood roofs.
The following persons addressed Council regarding this issue:
Gary Smith, of Gage, Babcock find Associates of Walnut Creek, a fire protection, engineering
and consulting firm, representing the Steel Workers Manufacturing Assoc., requested Council's
consideration regarding metal roofing.

ROOF INSTALLATION/HAZARDOUS FIRE AREA CONT.
Bill Bruckart, Town staff representative, explained the Town's ordinance and the fire safety
concerns and the flexibility to use various roofing materials within the guidelines of the
ordinance.
No one else addressed Council on this subject.
The Town Clerk read the Title of the Draft Ordinance.
Motion by Mr. Blanton, seconded by Mr. O'Laughlin, to waive the reading. Carried
unanimously.
Motion by W. Blanton, seconded by Mr. O'Laughlin, that Council introduce Draft Ordinance
entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 9 OF THE
TOWN CODE REGULATING THE INSTALLATION OF ROOFS IN THE HAZARDOUS FIRE
AREA AND CHAPTER 6 OF THE TOWN CODE REGULATING THE INSTALLATION OF
ROOFING TILES OVER EXISTING WOOD ROOFS. Carried unanimously.
GEOMATRIX/PARKING/LOT 4/8805 PROJECT/OFF-SITE MONITORING SERVICES (12.35)
Motion by Mr. Attaway, seconded by Mr. O'Laughlin, to continue this item to February 16, 1993
for staff to report on comparative industry figures for these services. Carried unanimously.
COUNCIL REPORTS (17.10)
Mayor Benjamin reported on the annual report on recycling given by Phil Couche of Green
Valley. The report is broken down by cities for easy reference and comparisons. The Santa
Clara County Cities Assoc. organized a meeting with the mayors and managers to meet with
their state representatives regarding the budget crisis facing municipalities at this time. There
was talk of restructuring municipal government so as to meet this challenge. By consensus this
subject will be on the Agenda for Council's consideration February 20, 1993.
