Main Street Los Gatos, CA 95030 ● (408) 354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 12/13/2022 ITEM NO: 1 DATE: December 1, 2022 TO: Mayor and Town Council FROM: Laurel Prevetti, Town Manager SUBJECT: Adopt a Resolution Certifying the November 8, 2022, Los Gatos General Municipal Election and Declaring the Election Results for Measure J, an Ordinance to Modify the Business License Tax, and Three Full Term Council Member Seats RECOMMENDATION: Adopt a resolution certifying the November 8, 2022, Los Gatos General Municipal Election and declaring the election results for Measure J, an ordinance to modify the Business License Tax, and three full term Council Member seats. BACKGROUND: A General Election was held in the Town of Los Gatos on Tuesday, November 8, 2022, for the purpose of electing three (3) full term Council Member seats and considering Measure J to modify the Business License Tax. At the direction of the Town Clerk, the Santa Clara County Registrar of Voters canvassed the returns of the November 8, 2022, General Municipal Election pursuant to Town Council Resolution No. 2022-033. The Registrar of Voters (ROV) is required to provide the Certification Results and the Canvass of the Election Returns, pursuant to California Elections Code Section 10262. Pursuant to California Elections Code Section 10263, the Town Council shall adopt a resolution declaring the results of the election. The proposed resolution declares Rob Moore, Mary Badame, and Rob Rennie as elected to the Office of Council Member of the Town of Los Gatos for full terms ending December 2026. PAGE 2 OF 2 SUBJECT: Certify the November 8, 2022, Los Gatos Municipal Election Results DATE: December 1, 2022 BACKGROUND (continued): Additionally, the proposed resolution deems Ordinance No. 2336 “ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 14 OF THE TOWN CODE REGARDING BUSINESS LICENSE TAXES” (Measure J). The Town has received the certification of the November 8, 2022, General Municipal Election from the Santa Clara County Registrar of Voters. The certification information (Exhibit B) includes the election results, the total number of votes for three (3) Council Member seats, the total number of votes for Measure J, and the Statement of Votes Cast. COORDINATION: The preparation of this report was coordinated with the Town Manager and Town Attorney. FISCAL IMPACT: The estimated cost from the ROV for the election of three (3) Council seats, not including the candidate statement fee, is approximately $84,858, and the estimated cost of Measure J is approximately $59,000. The funding for the Council Member seats and Ballot Measure J are included in the adopted Fiscal Year 2022/23 Operating Budget. ENVIRONMENTAL ASSESSMENT: This is not a project defined under CEQA, and no further action is required. Attachments: 1.
