RECOMMENDATION: Approve the employment agreement between the Town of Los Gatos and Gabrielle Whelan for appointment to Town Attorney and authorize the Mayor to execute the agreement (Attachment 1). BACKGROUND: In accordance with the Town’s Municipal Code, the Town Attorney is appointed by the Town Council. The terms and conditions of employment historically have been set forth in an employment agreement between the appointee and the Town. The employment agreement is established at the time of appointment and updated periodically on an as-needed basis. The Town contracted with an executive search firm, Teri Black & Company, for the recruitment of the new Town Attorney. The competitive recruitment process is now complete and the Town Council selected Gabrielle Whelan from a pool of highly qualified candidates for the position. DISCUSSION: The attached employment agreement sets forth the terms and conditions of Gabrielle Whelan’s appointment to the position. Under the proposed agreement, Ms. Whelan commences her position as the Town Attorney on Monday, May 16, 2022. The proposed annual base salary is $249,900. PAGE 2 OF 2 SUBJECT: Approve the Employment Agreement Between the Town of Los Gatos and Gabrielle Whelan for Appointment to Town Attorney and Authorize the Mayor to Execute the Agreement DATE: March 31, 2022 CONCLUSION: Approve the employment agreement between the Town and Gabrielle Whelan and authorize the Mayor to execute the agreement on behalf of the Town. FISCAL IMPACT: The adoption of this agreement results in no new costs to the Town. The funding to support the salary and benefits is authorized in the annual budget each fiscal year along with all other Town employee compensation and benefits. ENVIRONMENTAL ASSESSMENT: This is not a project defined under CEQA, and no further action is required. Attachment: 1. Employment Agreement – Town Attorney
