REMARKS: Attachment 4 contains Board Member comments that will be incorporated into further refinement of the HCD Draft Initial Review Housing Element after receiving initial feedback from HCD. Attachment 5 contains public comments received between 11:01 a.m., Friday, October 14, 2022, and 11:00 a.m., Thursday, October 20, 2022. On June 7, 2022, the Town Council accepted the Site Inventory as recommended by the Housing Element Advisory Board at their May 19, 2022, meeting. Since the June 7, 2022 Town Council meeting, the following modifications have been made to the Site Inventory: 1. Added Site I-1, 401-409 Alberto Way as the property owner submitted a Property Owner Interest form and a Conceptual Development Advisory Committee Application to the Town for a mixed-use project with 54 housing units; 2. Removed 404 North Santa Cruz Avenue, 420 North Santa Cruz Avenue, and 430 North Santa Cruz Avenue (Los Gatos Shopping Center) per the property owner’s request and therefore deleted the North Santa Cruz Avenue Area; 3. Removed 16535 Camellia Terrace and parcel number 523-02-005 (El Gato Village) as no Property Owner Interest form was submitted and with the addition of Site, I-1, 401-409 Alberto Way to the Site Inventory, the Town’s proposed number of housing units would further exceed the Regional Housing Needs Allocation (RHNA) and 15 percent buffe r; 4. Revised the housing density used for the calculation of projected housing units in the Site Inventory from the maximum density to the typical density, to be consistent with the 2040 General Plan Residential Buildout; 5. Increased the maximum housing density within the Affordable Housing Overlay Zone (AHOZ) from 20 dwelling units per acre to 40 dwelling units per acre to area to align with Implementation Program BF; 7. Modified the distribution for each income category to be consistent with the California Department of Housing and Community Development (HCD) Housing Element Site Inventory Guidebook, which allows jurisdictions to use a higher density (default den sity of 30 dwelling units per acre) as a proxy for lower income affordability; 8. Created a Senate Bill 9 (SB 9) projection which accounted for 96 housing units over the eight- year period; 9. Modified the number of housing units generated in the Pipeline Projects from 202 units to 176 units based on the creation of a new SB 9 projection, Planning applications that have been withdrawn, and projects that have received their Certificate of Use and Occupancy; 10. Decreased the overall total number of housing unit s in the Site Inventory from 2,448 units to 2,371 units, as a result of the changes listed above, a reduction of 77 units; and 11. Created a separate Appendix H, Site Inventory Form per HCD formatting requirements, which does not include the housing units associated with the Accessory Dwelling Unit (ADU) and SB 9 projections, as well as the Pipeline Projects. These additional housing units are identified in Appendix D of the HCD Draft Initial Review Housing Element. ATTACHMENTS: Previously received with the October 20, 2022, Staff Report: 1. I noticed that draft does not display all of these in numerical order and wanted to better understand the final methodology for the order. 2)In Section 10.6 Implementation Programs: Programs C and G refer to policy HE 1.5 Town Resources however there does not appear to be such a policy? 3) Program J refers to 1.7 Universal Design policy (should be changed to 1.6) 4) Program AI: Label format for "which policy" should be HE 3.1 instead of just 3.1. 5)All references to HE 2.11 should appear as Smart Growth instead of Policy Smart Growth. 6) Program AO: Change policy label from 2.10 to 2.11. What a travesty!! Houses everywhere and no stores. What are you thinking??? The traffic will be horrible and no one will be able to afford any of them because, like in the past, they will be million dollar houses/condos which no average person can afford. AND....it will further ruin the charm of Los Gatos. It really saddens me to see what is happening to our "Town". We're turning it into San Jose!! I am strongly opposed to this development!!
