Yes BACKGROUND: On April 25, 2018, the Historic Preservation Committee (Committee) approved a proposal for exterior alterations and an addition to the main residence (Attachment 1). The decision of the Committee was appealed by a neighbor to the Planning Commission. At its meeting of June 13, 2018, the Planning Commission denied the appeal, upholding the decision of the Committee (Attachment 2). Building Permit B18-0688 was issued for the project on December 7, 2018. During construction, the extent of demolition approved with the Building Permit was exceeded when all the existing exterior siding and trim was removed. Under the Town’s Demolition Policy, the work carried out resulted in a technical demolition of the residence and reclassified the residence as new, requiring processing of an Architecture and Site application, which the applicant submitted on March 6, 2019 (S-19-013). The application was recommended for approval by the Committee on March 27, 2019 (Attachment 4) and was approved by the Development Review Committee on May 7, 2019 (Attachment 5). The residence was not removed from the inventory because of its location within a historic district. On March 23, 2022, a request for construction of exterior alterations and a second-story addition greater than 100 square feet to an existing single-family residence (HS-22-012) was recommended for approval by the Committee (Attachment 6). DISCUSSION: The applicant is requesting approval for modification to the roof of the street-facing façade of a detached structure in front of the existing residence (Attachments 9 and 10). Changes to the rear elevation of the detached structure include an addition of approximately 70 square feet. No other exterior modifications are proposed to the home as part of the application request. Pursuant to the Town Code, a request for exterior alterations to a property within a Historic District shall be reviewed by the Committee. CONSIDERATIONS: A. Considerations Sec. 29.80.290. Standards for review. In evaluating applications, the deciding body shall consider the architectural style, design, arrangement, texture, materials and color, and any other pertinent factors. CONCLUSION: The applicant requests approval for construction of exterior alterations to a detached structure in front of an existing single-family residence located in the Almond Grove Historic District. Tyler Atkinson Questioned what type of outreach and noticing was done for this public hearing. He expressed concerns about the project and not being able to see the property in person. Mark Carlquist Expressed concerns about current height of the project. Vlade Herman Stated he would like to see the current height of the property stay the same. He wants to work with the property owners to come to some sort of solution to solve surrounding neighbors’ concerns. Closed the Public Comment. Committee members discussed the matter. Project Planner: Sean Mullin Consider an appeal of an Historic Preservation Committee decision approving a request for exterior alterations to a non-contributing single-family residence (HS-18-018); and an appeal of an Historic Preservation Committee decision approving a request for an addition to a residential accessory structure less than 450 square feet which is visible from the street (HS-18-031) on property located in the Almond Grove Historic District zoned R1-D:LHP. Sean Mullin, Associate Planner, presented the staff report. Opened Public Comment. Tyler Atkinson, Appellant - He represents the appellants. The Planning Commission must deny this application on the basis of the applicant asking the Commission to approve construction on his clients’ property, and they disagree with the staff report on that point. The applicant has made emotional and misleading accusations against his clients. Two things about the application that should give the Planning Commission great concern are: 1) The applicant is asking the Commission to approve a project that encroaches on clients’ property; and 2) A pattern of deceit from the applicant starting with the failure to do strongly recommended community outreach. They request the Commission deny the garage application outright, and continue the residence application to a date certain with specific direction that the Town’s Building Department inspect the project to determine any unauthorized construction. Vladimir Kanevsky, Applicant - He has had at least four meetings with the Historic Preservation Committee to ensure the house they are building conforms to the neighborhood codes and building codes, and he met with Town staff many times to ensure the original plan they submitted in February 2018 conforms. He knocked on the appellant’s door many times but they were never home, and he tried to relay a message through staff to the appellants asking them to call him, but they did not. They did meet eventually and he tried to work with them, but they said his proposed solutions were not enough. He has made many changes to accommodate the appellant’s concerns, but has not had any communication from them. The appellant’s complaints are always sent to him on the last possible day of every appeal period without PAGE 3 OF 4 MINUTES OF PLANNING COMMISSION MEETING OF JUNE 13, 2018 N:\DEV\MINUTES - PC\2018 PC Minutes\LOS GATOS ACTION MINUTES 6-13-18.docx 7/12/2018 9:22 AM any communication in between. Their last appeal was made based on technicalities and process, and none of the complaints are actually about his house. Tyler Atkinson - The applicant has tried to jam through various changes, and it is simply not the case that the appellants ignored him, and the record reflects that; nor is it true that they waited until the last possible day to assert their rights. These appeals to emotion should not govern the Planning Commission’s decision. What the applicant calls “technicalities” is actually the law. Building on another person’s property, or building a roof that extends into the airspace above a person’s property, cannot be done, and the Commission cannot give a blessing to such behavior. Closed Public Comment. Commissioners discussed the matter. MOTION: Motion by Commissioner Burch to deny an appeal of Historic Preservation Committee approval of minor development in an Historic District Applications HS-18-018 and HS-18-031 for 223 Massol Avenue, with the added condition of approval that there is no further increase in the size of the roof over the garage that encroaches on the neighboring property. Seconded by Commissioner Badame. Commissioner O'Donnell requested the motion be amended to remove the additional condition of approval, because the new construction will not further encroach. The maker of the motion accepted the amendment to the motion. The seconder of the motion accepted the amendment to the motion. Commissioners discussed the matter. VOTE: Motion passed unanimously. Mary Roach - Commented on the condition of the magnolia trees behind the proposed CVS location on Los Gatos Blvd. and the memorial oak tree in the median on Los Gatos-Almaden Road at Los Gatos Blvd.; and stated she would like to see the Tree City USA designation brought back to Los Gatos. Opened Public Comment. Applicant presented the project. Brett Brenkwitz, Applicant The proposal is to replace an existing parking lot with a new home and rear detached garage. To lessen the massing impact, they are setting the second story forty feet back from the front property line. Also, the main upper roofline slopes upward towards the rear. The front setback is fifteen feet to the porch. The porch is six feet deep. The total is twenty-one feet from the front property line to the front door. To determine the proposed front setback to the porch, they averaged the space between the house and the neighboring house, as well as to the commercial property on the other side. The garage is placed to the rear corner of the parcel for a reduced visual impact. The proposed project would use gable roof forms common to the neighborhood. Additionally, they are proposing to use similar colors and materials to fit in with the neighborhood: such as wood, siding, stucco, and stone; to fit in with the neighborhood. Committee members asked questions of the applicant. Brett Brenkwitz, Applicant Regarding height questions, there are a few other two-story homes in the neighborhood. According to staff: the proposed home size at 2,084 square feet would be the seventh largest in FAR. It’s on the smaller side for the immediate neighborhood. There is a shadow study included in the plan set to address shade concerns. Closed Public Comment. Committee members discussed the matter. More compatible than a parking lot. They followed every recommendation of the consulting architect. Analysis was thorough and well-reasoned. The FAR is not maxed out. The second story is set back. Troubled by the setback issue. Other residential properties have greater front setbacks. The commercial property is the outlier on the street. The other homes have larger front setbacks. Further analyze the proposed front setback in relation to the other residences in the surrounding neighborhood to verify neighborhood compatibility. Will take off the 1979 T-111 siding and do 360 architecture. The right side projection, that is visible from the front, is a bay window. Addition is visible on both sides from the street but mitigated by the fence. Reverting from 1979 to 1905 style by matching the siding, shingles, and windows. Only the front two windows, one on left, and one on the right are original. Can match windows to the addition, but the existing windows are single-paned aluminum. Applicant presented the project. Sandra Paim, Architect This is a stand-alone request to remove the property from the Historic Resources Inventory. There are conflicting documents on when the house was built. The Polk directory telephone records show occupancy in 1923, 1924, 1934, and 1941. The property stayed in the Truckner family in 1941. There was no record of that address on the Ann Bloomfield survey. The structure is not associated with any significant event or person. Any distinctive characteristics were greatly compromised. According to the 1941 tax assessment, there was a rustic exterior wall and the front and rear porches had covers. Changes were made to the window trim, molding, wood siding, and front porch. Entry way is keyhole. A second story was added. The front façade was altered more than 50%. Committee members asked questions of the applicant. Sandra Paim, Architect They didn’t request removal the first time in 2020 because they didn’t feel it necessary. The owner is not planning to remodel, and asked for her help in research. There are differences between the photos. In the 1970’s, the front porch takes up more than 50% of the front façade. The scale, character, front massing is entirely different. Asking for removal now even though the applicant is no longer doing renovations. Any future renovations would have to go before HPC. Closed Public Comment. Committee members discussed the matter. Once removed it would not return to HPC for review. In an overlay zone HPC would have jurisdiction and it could not be removed. It has not lost all historic details. If there are no plans to remodel, why ask for removal now? There is no clear reason given for removal. There hasn’t been any drastic remodeling. Just roof and sewage permits. Like that it can be painted. Would consider a substitution to the original application. The replacement windows seem reasonable. The Committee is more concerned about preserving the appearance of versus the use of a specific material. It’s a good way to maintain the historical integrity of the structure while keeping up with the times. The new materials will make the structures more durable and long lasting. In it's current form, the roof was changed to a shallow hip that cannot be perceived from the street. It appears as a flat cut off roof, very much out of character with the home, and has no aesthetic value. We believe our proposal to bring the gable roof back will blend with the main house gable and greatly enhance the aesthetic value of the house.
